Bush and Gonzales want to get all of their crooks in place before they leave office. Although all of these appointed crooks will be relieved of their positions when a Democrat is elected President, they would have installed a person to shred all relevant documents and make an excuse that they wanted to start all over again. This confirms what I said two years ago. Bush and Cheney should have been impeached a year ago to save our Constitution. If you think I am wrong prove it. I am still waiting.

This protects Rep. Jerry Lewis and others who were under investigation. Bush is not subtle. He just thinks that scamming the rule of law protects his people. He and Gonzo and Rove do not have a place in their brain necessary for normal conscience and logic: The truth will come out.

With the bill on the president,s desk and with all the notoriety of the attorney scandal Gonzales uses the soon to be outed provision to by pass the senate and appoint or continue the appointment of a USA it could only be perceived as a slap in the face of Congress. Legal or not it was underhanded, unethical and unnecessary.

Gonzales did it on purpose and for all the wrong reasons just because he could upset congress by his actions. It's too obvious and shows his complete disdain for the integrity of his office. In other words (that jimbo dude can unhderstand) what an asshole.

<blockquote>"First there were blanket denials, lavish claims of executive privilege and invocations of national security. Then came repeated clarifications, previous statements declared 'inoperative,' and multiple promises of full disclosure. Subpoenas were resisted. The persistent Special Prosecutor was fired."</blockquote>

Everything old is new again. This was from Time Magazine, in 1974, regarding Richard Nixon. Sound a little too familiar?

To Sara: If Cardona is a man of integrity, why did Bush appoint him prior to signing the bill into law? This is what Bush and the other neo-cons and the corporatists behind them do not comprehend. The trust has not only been broken. It has been smashed to smithereens. Trust is the glue that binds us all together. Trust in the appointment system, trust in justice, trust in the election process, trust in the capacity for honest debate, trust in our news sources, all of it and more smashed to smithereens.

Sneaky little bastards aren't they?

But this is just "same s&it, different day" to any of us that have been following Bush's machinations since Gone-zales was appointed AG.

I was aware that Bush thought our Constitution was just a G.D. piece of paper, but I didn't know that he tore it to shreds, wadded it up and threw it in the fireplace in the Oval Office.

I'm a former DOJ lawyer who worked closely and extensively with George Cardona years ago. He is a highly experienced prosecutor; he's also very smart, responsible, and fairminded. He had high positions in two US Attorneys Offices under Clinton. And, at least in my experience with him, he was never an ideologue, right wing or otherwise. It's easy to assume that anyone Bush installs is going to be a political hack who will carry out the Bush agenda blindly, but I'm quite positive that's a wrong assumption to make here.

The Leahy staffer is wrong about the "bypass, " in the sense that:
1. Both before and after the president signs the S.214 bill, the A.G. retains the right to appoint interim U.S. Attorneys. It is stretching it to say that operating under the law is an "end run."
2. The new law merely reinstates the prior process, back to where it was before March 2006, before the USA PATRIOT Act Re-authorization was signed. (And that old law has its problems.)
3. The law applies to all<strong> interim</strong> U.S. attorneys. From the date the law is signed, all interim attorneys are on a 120-day term, and the clock is ticking for all of them.
4. <strong>Acting</strong> (not iterim) U.S. Attorneys are civil service employees "acting" as the U.S. attorney for the district. They can return to their civil service position of First Assistant U.S. Attorney, when either an interim or presidentially appointed USA is put in office. They have a 210 day term, (the "acting" USAs,) and S. 214 did not change their term.
5. There are still real problems with the USA<strong> interim </strong>appointment process, as it is apparently legal for the A.G. to appoint an<strong> interim</strong> USA for successive 120 day terms, especially if the district court is dis-inclined to appont anyone, and the Bush administration has already done this kind of thing before the USA Patriot Act Re-authorization was been signed. One interim USA had been in office for more than a year under this routine of successive 120-day appointments.
6. And it's still possible for the district court to appoint someone after the 120-day term, and if the president likes that appointee (pretty likely) then that appointee doesn't have to appear before the Senate. The USA for Maine is such a person, and is the only <strong>court appointee </strong>still in office--for years now, and without a Senate confirmation. She was a civil service First Assistant USA before her <strong>acting</strong>, then<strong> interim,</strong> and then<strong> court-appointed</strong> appointments.
7. There are at least 22 non-presidentially appointed USAs (out of 90-odd) in office right now. And the Bush administration has been reported having trouble finding people to apply for the open positions.
Hmmmm: Just 18 more months in office for the president (and then the USA might be dismissed because s/he was appointed by the wrong party), an Attorney General under fire, five top DOJ staff have resigned office. Then for the prospective USA, there's the confirmation and FBI check. These positions are mostly going to stay interim/acting until the end of the Bush presidency.

KNEW that bill should have been retro active! All the people ’snuck’ in should still have to have full Senate review!

Comment by Anoise — June 15, 2007 @ 4:16 pm

"[R]etro active" [sic] -- _ex post facto_ -- laws are unconstitutional.

Thus the effort to make legal, after the fact, Bush's commission of the war crime of torture is unconstitutional, null-and-void.

Another reason it is unconstitutional is that prohibitions against the use of torture are part of the Constitution, which cannot be altered by Congress, the Executive, or even both together with the approval of the Judiciary.

It is only the widespread ignorance of the Constitution on the part of the vast majority of We the people that gives the unconstitutional efforts to make it legal appear to them as a legalization of it.

In essence, torture cannot be made legal by any branch of our gov't, or by our or any country, by any means.

“Nothing” Bush does is legal?! There are plenty of legitimate concerns I have with this Administration, but going overboard like that impacts our credibility.

Comment by Nancy — June 15, 2007 @ 12:51 am

Bush was unconstitutionally appointed by an SC which, to do so, usurped the exclusive authority of CONGRESS to resolve election disputes such as that of 2000.

And it is a principle of law that anything which flows from an unconstitutional act is null-and-void -- unconstitutional.

Nothing Bush has done, beginning with his unconstitutional appointment to the office, is legal.

To all those who say there is no difference between Dems and Repugs, do you think any of this would be out there if the Repugs had retained their control of the Senate and House? Think please of the implications--non-scandal after non-scandal revealed days before the 2008 election; minorities disenfranchised through the fraud of voter fraud; Bushies controlling the law for their own purposes rather than performing their oath to the constitution; more Schlozman, van Spakovsky, Goodling shenanigans; the complete gutting of the Voting Rights and Civil Rights units of the DOJ; etc. A permanent Repug majority through on-going theft of our electoral rights. No the Dems are far from perfect, but they have already done an incredible service just by exposing this rot to the light of day. Each week more comes out and more investigations are started. We now "get their MO." I know all too well how difficult it is to be patient, but all but the worst Dems are better than all but the best Repugs. Yes we want indictments; yes we want impeachment; yes we want spine; but the alternative is Repugs, not the perfection that so many posters on this site appear to desire.

#101: I agree with your reading of the <i>old</i> law. It strikes me that that provision was what "encouraged" Griffin's recent determination that "public service" . . . "just isn't worth it" - but only after his interim status had more than 60 days expired without him leaving.

Right now, the government of the United States of America
is as far from being a government of and by and for the
people as it has ever been. How can 'we the people' be
heard? Consider this: most trials still use juries
selected from the people, and could not proceed without
these juries. What if every potential juror out there
refused to show up for jury duty until Antonio Gonzales
is fired?

To the Justice Department's current problem of a lack of
credible leadership, a jury duty strike would add complete
dysfunction. A jury duty strike would be the perfect and
most appropriate means of expressing dissatisfaction with
Gonzales: other means (e. g., writing your congressman)
have repeatedly shown themselves to be useless. A jury
duty strike would be effortless (a completely passive
resistance) and could not be prosecuted if done en-masse.

To those who claim Gonzales is but a puppet controlled by
Rove (or Cheney or Bush), I say we must start somewhere.
Ceausescu was a puppet of the Soviets, but that didn't
prevent him from being overthrown. Let us begin! Let
June 15 be the first day of a nationwide jury duty strike
until Antonio Gonzales is fired!

I wonder what they would have done had the GOP retained control of the Senate and the House? Glad there is still a chance to not find out...

Oh, and Nancy, the "official report" lists more than one cell phone call, and at altitudes higher than 5,000'.

Now, please, go to your "reason based website."
