BREAKING: Supreme Court Strikes Down Public School Desegregation Law
In the “biggest school desegregation ruling in more than a decade,” the Supreme Court today ruled 5-4 to reject public school assignment plans “that take account of students’ race.” The AP reports:
The decision in cases affecting schools in Louisville, Ky., and Seattle could imperil similar plans in hundreds of districts nationwide, and it leaves public school systems with a limited arsenal to maintain racial diversity. …
[The case] was led by parents challenging the way race is used to assign students to schools for the purpose of integration.
Like the multiple cases decided in favor of the Bush administration and corporations earlier this week, the majority was formed by Chief Justice Roberts and Justices Scalia, Thomas, Alito, and Kennedy.

UPDATE II: Chief Justice Roberts, who authored the majority opinion, wrote, “The way to stop discrimination on the basis of race is to stop discriminating on the basis of race.” In fact, a key study by University of Wisconsin professor Douglas Harris, using empirical data gathered from No Child Left Behind, shows that desegregation remains the most effective way of closing this gap:
– African Americans and Hispanics learn more in integrated schools. Minorities attending integrated schools also perform better in college attendance and employment.
– Controlled choice and other forms of desegregation benefit minority students.
– Racial integration is a rare case where an educational policy appears to improve educational equity at little financial cost.
UPDATE III: In his dissent, Justice Stephen Breyer writes:
Finally, what of the hope and promise of Brown? For much of this Nation’s history, the races remained divided. It was not long ago that people of different races drank from separate fountains, rode on separate buses, and studied in separate schools. In this Court’s finest hour, Brown v. Board of Education challenged this history and helped to change it. For Brown held out a promise. … It sought one law, one Nation, one people, not simply as a matter of legal principle but in terms of how we actually live. [...]
Many parents, white and black alike, want their children to attend schools with children of different races. Indeed, the very school districts that once spurned integration now strive for it. … The plurality would decline their modest request.
The plurality is wrong to do so. The last half-century has witnessed great strides toward racial equality, but we have not yet realized the promise of Brown. To invalidate the plans under review is to threaten the promise of Brown. The plurality’s position, I fear, would break that promise. This is a decision that the Court and the Nation will come to regret.
UPDATE IV: In his opinion for the majority, Chief Justice John Roberts writes, “Before Brown, schoolchildren were told where they could and could not go to school based on the color of their skin.” But as Justice John Paul Stevens notes in his separate dissent, there is a “cruel irony” in Roberts’s reliance on Brown:
The Chief Justice fails to note that it was only black schoolchildren who were so ordered; indeed, the history books do not tell stories of white children struggling to attend black schools. In this and other ways, the Chief Justice rewrites the history of one of this CourtÂ’s most important decisions.
UPDATE V: SCOTUSblog notes that this Supreme Court term has produced a “higher share of 5-4 decisions than any term in the last decade.”
UPDATE VI: According to AP, the Court has previously ruled that “schools have responsibility to desegregate, even in districts where schools had not been segregated by law.”
UPDATE VII: Roberts’s classification of the integration plans as “discrimination on the basis of race” is directly contradicted by well-respected conservative Judge Alex Kozinski, who wrote in the Ninth Circuit Court of Appeals opinion of the case that:
The plan does not segregate the races; to the contrary, it seeks to promote integration. There is no attempt to give members of particular races political power based on skin color. There is no competition between the races, and no race is given a preference over another. That a student is denied the school of his choice may be disappointing, but it carries no racial stigma and says nothing at all about that individual’s aptitude or ability.

The wealthy whites in our society don’t want those of ‘color’ or of ‘minimal means’ going to their kids’ schools. They have been trying to find a way around Brown v. Board for 50 years now. First they tried bussing districts to keep segregation alive, then they ran to the suburbs to create new school districts that those pesky ‘colored’ folk couldn’t afford. Now they are doing this.

@CT V_1: You misunderstand. The Seattle and Louisville plans were intra-district, i.e., no one was sent to another district!
The Seattle was especially fair-minded. At the end of 8th grade, nearly every student in the district entered their top three choices for high school assignment. In fact, the first factors that were considered for assignment were actual proximity to the school and whether the student had any siblings in that school. Race was a tie-breaker factor that came into play after some time into the process, when popular high schools became oversubscribed and too imbalanced racially. In those instances, the district would try to place the student in her next two choices and, failing that, in another school entirely.
Everyone was placed in a roughly equal high school setting–what’s wrong with that?

It’s simply untenable to make a school-assignment decision according to race. Your argument is genuine and considerate, but I feel that the court today struck down an overreaching and convoluted law. I don’t think this should be seen as a roll-back of rights, however. I feel that my state, Virginia, for example, has some good rates of minority achievement, and Virginia can do it without assigning students regularly in regard to race. Perhaps the states in question should be turning bad schools into good schools instead of scrambling to pick a few bright kids to leave the bad schools behind. Everybody deserves a good education.
I hope that in the long-term, I won’t be wrong.

I would hope parents would want their children to attend the best schools, not the most diverse schools. If the best schools happen to be the most diverse well thats great, but they should be looking at the districts (and individual schools) performance when they are picking a school district and then school with in the district.

June 28th, 2007 at 11:14 amIntegrating our schools improves our entire society. We have children from every race who grow up together. It opens people to new ideas and different cultures. When you actually know people of a race, it helps you see things from their perspective. You give every race a “human face” in your mind, which leads to more compassion.
It’s beneficial to combine white and Hispanic children for example because the Hispanic kids are better able to learn English and integrate into US culture while the white kids can learn more Spanish and Hispanic culture.
You don’t improve racial and cultural tensions by just ignoring race/culture entirely. You only create more ignorance about anyone who are different.

I’ll tell you what is wrong with the schools that don’t work. They don’t respect the kids. It really does boil down to the fact that every success story in education – including teh ones in which they make major motion pictures out of – starts with a teacher or a Principal who decides to give the students respect.
In my own classroom experiences, I can tell you that the teachers who don’t respect the students have a lot of discipline issues, while the same students, are productive and respectful to the teachers who they feel respect them.
We have punishment-oriented systems that DON’T work. It’s common sense that people will resist force, but accept relationships founded in respect. But the conservatives who control these systems get off too much on spanking a ‘bad’ kid to consider chaning it… Appalling.

South Florida is the exception, not the rule. Hispanic communities in many other parts of the country are not as well-off as Miami. Do you really think you can compare a rich pre-Marielito Cuban neighborhood in Miami to a neighborhood of Guatemalan day laborers in West Virginia? Those are two vastly different economic situations.
School integration is not about “whitey helping the brown people.” It’s about uniting people as Americans, not dividing them into separate but equal enclaves. Perhaps there wouldn’t be so many “racist Liberal” attitudes out there if our schools and neighborhoods were more integrated.

Making the teenaged body get up at 5:30 am to attend the first class at 7am?
Why is it that an elementary child goes to school at 9am, while a teenager goes at 7am? Convience for the parent, no doubt.
My teenaged daughter looks like Night of the Living Dead when she’s up that early, while my toodlers are practically bouncing off the wall.
Incidently, a study from a school in Minnesota that implemented a later start for high-schoolers showed a drastic increase of grades. If I recall (and I’m too lazy to research), almost all graduating seniors where A students.

‘Less PC more teaching’ seems to coincide nicely with getting rid of the people who maintain racial levels in favor of more actual education resources. So I’m not quite sure what was lacking in my communication skills.
No… It ties into the fact that many of you claim that teachers are pushing political agendas instead of teaching – when in fact, it is mostly conservatives in Administration who are pushing their personal agendas. However, there are liberal Administrators who are trying to fix the system, and this program in making sure that rich kids don’t get the better education at teh expense of the poor kids is something I support.
I would support ‘less self-agrandizing and more respect’ by Adminstrators so that teachers would be unincumbered to teach… Because, those administrators treat teachers just as badly as they treat the students – and when you assume the worst, you tend to get it, because it’s all you are looking for…

Being a teacher, I would say that a school that walks its talk (mission statement of nurturing students) would be prefereable to one with a high rate of test grades. The test scores are meaningless. Go ask any high school student. They will tell you that they memorize trivia for the tests and then forget it because it is useless nonsense. Those tests measure very little of quality. Why do you think teachers are so against NCLB?

This is, once again, the princple of Laissez-Faire applied to public policy. I prefer to call it Lazy Unfair. The fact is that people of color have been discriminated against and the point of integration is to eliminate any advantage or disadvantage due to race, color, sex, or ethnic origin. It is a perfectly valid program.
This SCOTUS ruling is an abuse of two separate meanings of the word “discriminate” in the English language. The neutral meaning of the word is to “distinguish between”. However, social discrimination means to distinguish between people of class or race and to rank them and treat them unfairly.
It’s a disgrace that the SCOTUS should abuse the word this way. They know perfectly well that all justice begins with discriminating between the act that is unfair and the act that is fair. Judges must discriminate between reasonable and unreasonable facts all day. The SCOTUS FIVE have merely chosen to be Weasel Racists.
To distinguish between groups who, for various socio-economic and racial reasons, have been placed at an unfair disadvantage and those give an unfair advantage and to level the playing field throughout society. It can easily be seen that to leave things as they are –that is, to embrace laissez-faire– is to deny or abridge the rights of citizens.
A person in a wheelchair has just as much of a right to use the stairs as any other citizen. Is there discrimination if one provides only stairs? Yes. Is there discrimination if one builds an access ramp? Yes. But the use of the word discrimination is not the same in each sentence. One implies disadvantage, while the latter suggests equality.
Let’s face it. The Right wants a class society. They like privilege and distinctions of rank. They don’t want a level playing field. And the last thing they want is to have past wrongs righted.

Solving this problem with policies that encourage the upward mobility of people within the less affluent districts would make this a non-issue.

mmmm…good question. Im a Latinamerican, a mixture between indians and europeans as the far majority in this continent. Brazil is also considered Latinamericans, of course, although they speak portuguese and have a lot of black population, like Columbia, Ecuador, Venezuela and Peru and the Caribbean countries. BTW here in the DFW area, probaly like south FL. there are a lot of poor hispanics who are the recipients of discrimination all the time. If good people do not step up and address discrimination it will continue and flourish, to the detrement of us all. Stick your head up your butt and pretend it does not exist, that won’t change the reality millions deal with every day. Segregation is still inherently unequal.
As a black man I beleive in school integration. I live in an upper middle-class area, so the school is integrated because my nieghbors are white and hispanic. If the nieghborhood is all black or hispanic and poor the schools will be segregated and often sub-par. Maybe the situations is based on economics. June 28th, 2007 at 11:48 amThe public school system is failing. Every school should offer the same standard of enducation. The problem can’t be about racism. The problem is bigger than that. And, no, I don’t have a solution to propose at the moment – but perhaps the government should take more of an interest in educating its people. Offer the same standard of education across the board. Make university enrollment available to all high school graduates. Offer incentives for performance. Offer vocational school and specialized training for those not interested or qualified to attend university.
I’m not suggesting doing away with private schools, but perhaps raise the question as to the need. We should want to be united as a country and proud of our people. And, we can start by properly educating (and offering the opportunity) to each and every one.

The test scores are meaningless. Go ask any high school student. They will tell you that they memorize trivia for the tests and then forget it because it is useless nonsense.

It’s about assuring that all students have access to the same first quality public education. Even with minority preferences and/or bussing, schools in affluent areas have more resources. That said, this is definitely a ruling by a racist court detremined to preserve white economic privilege.
Since these un-American men will be in situ for a long time, it will be necessary for those of us who love equality to find another way to give students access to equal educational opportunity. Education groups and the ACLU need to begin crafting strategies based on that inequality. Force rich schools to share with poor schools, fight for smaller classes and better teacher education for all students.
Strengthen the public schools – they are the most democratic institutions in this country. And that’s probably the primary reason conservatives hate them – conservatives prefer oligarchy.

Yes, fine work, now if you had bothered to look at my links, one of them even broke down black graduation rates by various accepted surveys. If you average them, you get a black graduation rate of: 65% as an average of 6 different surveys. If I wanted I could take just the highest one and add nearly 20% to your number, but even the average is 9% higher. 9% isn’t ’splitting hairs’ it’s pointing out intellectual dishonesty in your statistics.

If the Ice caps melt, the Gulf Stream won’t stop dead in it’s tracks. It may well be true that if the Ice caps melt then the Gulf stream may stop but this action/reaction will take some time. Time enough for massive flooding of coastal areas. If the Gulf Stream did stop then an Ice age is probable, but I would not expect it to happen in a day, or year or 10 years. Bottom line is if the Ice caps melt 100%, you will have an interesting view of the “Hispanic” Miami skyline!!!!

Wrong. First of all, being a teacher, I learned that the tests are biased. Therefore, the scores are irrelevant in how good a teacher is. One of the most interesting things I was taught in high school was when my otherwise worthless Career Awareness Coach/Teacher had us take out a piece of paper and just randomly pick A, B, C or D for a series of questions he didn’t even ask. Most of us scored well, just because the odds of guessing correctly are so much better than essay and problem solving questions (which is what I give my students, by the way. Takes longer to grade, but they have to demonstrate their knowledge, and therefore, to some degree, my ability to teach it to them).

Being assigned to a school to promote racial diversity is not preferential treatment. Preferential treatment would be if they asked Hispanics which school they wanted to go to and let them go wherever they wanted and didn’t offer the same option to white kids. That’s not what ever happened. If you are saying that getting to go to a good school is preferential, why do you feel that whites deserve to go to good schools while minorities don’t deserve the same preferential treatment?
I grew up in NC when busing took hold. They sent kids to schools outside of their neighborhoods because neighborhoods were so segregated at that time, it was easy to get a racial mix. Without a racial and ethnic mix in schools, Hispanics will never compete with Angelos until after school in your scenario.
Diversity builds the strongest neighborhoods. It’s be documented time and time again.

The good side, though, has been that by treating my so-called subordinates as equals, that aspect was and is always wonderful. They work hard, are loyal, and self-motivated. Of my friends who were former co-workers most of them have been people I managed because I did as you do – treated them as equals. I don’t understand why it’s so difficult for others to grasp that respect begets respect, while disrespect begets disrespect….

I have a friend with a 3rd grade child in a local school. We pay taxes for this school yet they bus in inner city kids. His boy was beaten up by 3 of these kids at least 4 times that I know of and the school says there is nothing they can do. If you don’t like it then send your kid to a private school.
Does this sound fair? Yes, his kid is “soft†and these city kids are rough. But why should he be denied and education, live in fear or have to cost more money? This is our town. We moved here, pay for houses and pay our taxes here and they don’t. I thought this was America. Does that not mean the land of opportunity? You are not guaranteed to be handed anything. You are given the opportunity to better yourself, work hard to give your kids more so they can do the same for their families and their futures.
Oh, I forgot. Cities are “blue†areas. Cities are full of crime and Democrats. They want this to be a socialist country. Notice I never mentioned anyone’s race here so don’t start that crap. It has to do with suburban verses rural attitudes.

I realize that some schools suck (IE Cincinnati public), and not all parents are able to move to a different district. (those of you who said that parents should pick better need to get in touch with an average person’s reality) However, if your kids school has issues, go after them with vigor to get it fixed! And also, it’s not just the schools responsibility to make sure that a kid gets a good education, it’s the parents as well! You can’t NEVER check little Johnny or Susies homework, and then bitch when they bring home a failing grade. That’s what being a responsible parent means. (checking homework, getting involved, ect)
Also, think of the kids in this aspect: If the “bussing” would have been allowed, you would take a kid who has been around the same classmates for several years, and thrust them into a new set of demographics, new personalities, new cliques, ect. This is hard on kids! Being Military, I have seen a lot of my friends school aged children regress when they transfer duty stations after several years.
Bottom line, let’s improve the schools we have, and not take the “grass is greener cross-town” approach.

No exceptions. Also, any child can apply to any school , in or out of catchment. The parents just have to get them there, it is on a first come first serve basis. I have always believed school acceptance should be at the level of the child’s social skills and intelligence. Not race, color or creed. If your child is a bozo he/she will only drag the other children down with him/her. We tried duel immersion here, that was a disaster. this became evident when it was discovered that the spanish speaking families where found to be illiterate in there own language and could not assist their children who where also found to be illiterate in both spanish and english as well. Redistribution of kids according to race is not about getting kids into a school with more money. Although a good supply of money helps, it is not the main issue at hand.
The aim of redistribution is exposure to value systems. Studies have been done that show how both Asian and White culture tends to stress academic performance for children in school more than anything, and Asians sometimes to an unhealthy degree. Hispanic culture on the other hand tends to stress familial and social performance–that family duties and social bonding is more important than academic progress.
Another study altogether identified one obstacle of African-American culture, that when placed in an interracial setting, striving to meet one’s academic potential is “acting white,” and puts one at odds with maintaining his/her own cultural identification. Yet another study done in a different region of the country found contradictory evidence.
It is possible that different regions have differing *reasons* behind the same problem, that this is not something that can be solved by a “one size fits all” approach. More studies must be done and with a sincere, non-ethnocentrical attitude to address how to improve minority children’s desire to succeed academically *where necessary*, but also to perhaps give a more complete view of the costs when a “win at any cost” attitude is taken and taught.

I guess you’re not familiar with the school funding formulas in many states, like NY and NJ, which do exactly what you’re talking about.
Problem is, it hasn’t helped all that much. The amount of money spent on these “problem” schools is staggering, but it’s not changing the results. And there are many reasons for that, the least of which is “racism” (and I’m not suggesting you made such an accusation). In order to believe that, one would have to believe that the school systems are conspiring to “keep minorities down.” An honest person would have to acknowledge that that’s just silly in this day and age.
Many have suggested more plausible explanations, like broken families, difficult urban life, poverty and the like. Seems more appropriate to take those factors into account in admissions, rather than race, because such factors can affect all races.

I am native to Los Angeles, and you’re actually wrong here. I have had many close Mexican-American friends growing up (due to the bussing back then) who’s parents came from many different backgrounds–some illegal immigrants, some first generation, some who’ve been here forever. I have noticed that the belief of “that’s all they can expect from life” does permeate throughout the culture in many Mexican families.
One friend who immigrated here from Mexico at a fairly young age, explained it to me that it may be because of the almost caste-like system that exists in Mexico today.. the rich are VERY rich, and the poor are VERY poor. Their elders, having no first hand or even second hand experience of the value of education, are unable to stress to their children sufficiently the value of obtaining a higher education since values are transmitted by immitation.
For example, one value that is transmitted sufficiently in Mexican culture, is the hard work ethic. At least in Los Angeles, everywhere you look, you will see Mexican-Americans cleaning homes and businesses, gardening and landscaping, building homes, and farther out, you will see them out picking crops under the midday sun.
In contrast, I also have friends native to Argentina who’s families were quite aware of the values of education. And they have gone on to complete their higher education becoming quite wealthy.
So you see, it’s not really an issue of pointing fingers, but an issue of enculturation; a process that becomes quite difficult when the ethnic saturation of an area acts as an actual barrier to obtaining the root which makes one “free”–not work or jobs, but the *desire* for academic success, and the likely outcome if it is so instilled and done.

The problem is the B of E teaches to the lowest common denominator. So, if you have a child that is semi literate with an IQ of 70 that is the gold standard to witch teachers instruct. Example, my son asked why his science teacher why the curriculum was so weak and ill formed. The teacher told him that when the other students would raise their levels of ability he would raise his level of teaching. I have a fairly intelligent son and he is in one on NYC’s finest high schools . You can make your assessments from there.

I have no Anglo blood according to a trace through 17 generations.
I live in a seaside house in Florida on a 1.5 acre lot, elevation 15 feet above high tide.
I did have a BMW and a Mercedes, but traded them in for a Prius and a Honda Civic hybrid. Both are loaded o the tune of 30 – 35 grand. Both sip gas.

That’s what confused me a bit, because normally, students going to the schools near their home usually results in most blacks going to majority black schools and vice-versa.

I frankly would like to see a system that offered at least a few options, so children aren’t forced into schools that their parents don’t believe is best for them. being a graduate of the jefferson county (ky) public school system (mayme s. waggener trad 2002) i think i could provide a unique perspective on this issue, especially one without the hateful invective being spewed by both wings of the social spectrum.
personally, i’m torn by this issue. i for one think that our bussing system was a good thing. louisville is pretty divided racially and economically- the blacks in the west end, the poorer people in the south end and the well off in the east end. fortunately for me, i was taught in the traditional program and that allowed me to attend the traditional schools that were closest to me, so i didn’t experience bussing first hand. but i will tell you this, it was most definitely beneficial for both races and both economic groups to come together in a common ground. it can’t not be a bad thing to get to know someone who looks different from you. i know it benefitted me because all the traditional schools i went to had kids of different economic and social backgrounds. i personally think that the brighter kids will always seek out those who are different than they are so that they learn life experiences that can’t be taught in the classroom.
however, i also think that using race as a basis of placing students is wrong, especially in the case of what happened here (which is something that i am more familiar with). i think that if there is room for a student in the local school, the percentage of a racial group should be irrelevant; the student should be left in.
so like i said, i am of a very mixed opinion here. had i been a justice today, i don’t know how i would have voted. i probably would have voted with the minority because i recognize its practical value, however i would have disagreed with the minority opinion somewhat. i basically agree with what was written by the minority, but i would have stated that in cases where there is room for a student that the racially mandated percentages should be thrown out.

Let me get this straight; the US is plagued by issues of race, so the best means of dealing with it among youth is to further segregate them from one another, which will lead to school populations made up of racial neighborhoods; rich neighborhood schools will prosper, while poor neighborhood schools will struggle.
Sounds a lot like Segregation to me.

Now the soldiers can come back and be treated like aliens. Their children will be denied equal education as the GOP continues to dismantle all the rights even in the 1964 Civil Rights Bill. I guess that’s what the White House means when it says support our troops just don’t given them the Freedoms other Americans have. These brave men and women didn’t know the United States of American really didn’t care about them at all.

The Visigoths ruled Spain 1st in the name of the Western Roman Empire then The Easten Empire from 415-711.

The Easten Empire lost it’s Southern provinces to….
The Muslims. That’s how they reached Spain in 711.
When the Muslims were finally thrown out in 1492, The Easten Empire had benn ruled by the Turks for 50 years.
So the Eastern Empire outlasted Visigothic Spain.
So explain how the Roman Empire disappeared before Visigothic Spain in 711 when there were Emperors in Constantinople until 1453?
