BREAKING: Supreme Court Strikes Down Public School Desegregation Law»

brown.jpgIn the “biggest school desegregation ruling in more than a decade,” the Supreme Court today ruled 5-4 to reject public school assignment plans “that take account of students’ race.” The AP reports:

The decision in cases affecting schools in Louisville, Ky., and Seattle could imperil similar plans in hundreds of districts nationwide, and it leaves public school systems with a limited arsenal to maintain racial diversity. …

[The case] was led by parents challenging the way race is used to assign students to schools for the purpose of integration.

Like the multiple cases decided in favor of the Bush administration and corporations earlier this week, the majority was formed by Chief Justice Roberts and Justices Scalia, Thomas, Alito, and Kennedy.

UPDATE II: Chief Justice Roberts, who authored the majority opinion, wrote, “The way to stop discrimination on the basis of race is to stop discriminating on the basis of race.” In fact, a key study by University of Wisconsin professor Douglas Harris, using empirical data gathered from No Child Left Behind, shows that desegregation remains the most effective way of closing this gap:

African Americans and Hispanics learn more in integrated schools. Minorities attending integrated schools also perform better in college attendance and employment.
– Controlled choice and other forms of desegregation benefit minority students.
– Racial integration is a rare case where an educational policy appears to improve educational equity at little financial cost.

UPDATE III: In his dissent, Justice Stephen Breyer writes:

Finally, what of the hope and promise of Brown? For much of this Nation’s history, the races remained divided. It was not long ago that people of different races drank from separate fountains, rode on separate buses, and studied in separate schools. In this Court’s finest hour, Brown v. Board of Education challenged this history and helped to change it. For Brown held out a promise. … It sought one law, one Nation, one people, not simply as a matter of legal principle but in terms of how we actually live. […]

Many parents, white and black alike, want their children to attend schools with children of different races. Indeed, the very school districts that once spurned integration now strive for it. … The plurality would decline their modest request.

The plurality is wrong to do so. The last half-century has witnessed great strides toward racial equality, but we have not yet realized the promise of Brown. To invalidate the plans under review is to threaten the promise of Brown. The plurality’s position, I fear, would break that promise. This is a decision that the Court and the Nation will come to regret.

UPDATE IV: In his opinion for the majority, Chief Justice John Roberts writes, “Before Brown, schoolchildren were told where they could and could not go to school based on the color of their skin.” But as Justice John Paul Stevens notes in his separate dissent, there is a “cruel irony” in Roberts’s reliance on Brown:

The Chief Justice fails to note that it was only black schoolchildren who were so ordered; indeed, the history books do not tell stories of white children struggling to attend black schools. In this and other ways, the Chief Justice rewrites the history of one of this CourtÂ’s most important decisions.

UPDATE V: SCOTUSblog notes that this Supreme Court term has produced a “higher share of 5-4 decisions than any term in the last decade.”

UPDATE VI: According to AP, the Court has previously ruled that “schools have responsibility to desegregate, even in districts where schools had not been segregated by law.”

UPDATE VII: Roberts’s classification of the integration plans as “discrimination on the basis of race” is directly contradicted by well-respected conservative Judge Alex Kozinski, who wrote in the Ninth Circuit Court of Appeals opinion of the case that:

The plan does not segregate the races; to the contrary, it seeks to promote integration. There is no attempt to give members of particular races political power based on skin color. There is no competition between the races, and no race is given a preference over another. That a student is denied the school of his choice may be disappointing, but it carries no racial stigma and says nothing at all about that individual’s aptitude or ability.

    The wealthy whites in our society don’t want those of ‘color’ or of ‘minimal means’ going to their kids’ schools. They have been trying to find a way around Brown v. Board for 50 years now. First they tried bussing districts to keep segregation alive, then they ran to the suburbs to create new school districts that those pesky ‘colored’ folk couldn’t afford. Now they are doing this.

    if the child gets sick you have to drive for over a hour to get to school to pick him up.

    Because, face it, the infrastructure that wealthy anyone uses to build their wealth comes from those who built the system prior. Otherwise, each time, you’d have to start over, and if you had to build your own roads and water systems, you wouldn’t be able to amass any wealth ever.

    My graet grandparents were all immigrants. They all came here because they needed the help that our Democracy provides, that they couldn’t get intehir native lands. At least they knew it and were appreciative.

    Here in Dallas, which has a MISERABLE public school system, the number of hispanics has put whites and blacks in the minority to such a degree, it’s hard to find anyone speaking english on a consistent basis in most schools. Those who can afford it, send their kids to private school, while those who can’t have fled for the suburbs where the districts have been composed of primarily upper middle class families.
    Freedom FROM choice is what we want?

    @CT V_1: You misunderstand. The Seattle and Louisville plans were intra-district, i.e., no one was sent to another district!

    The Seattle was especially fair-minded. At the end of 8th grade, nearly every student in the district entered their top three choices for high school assignment. In fact, the first factors that were considered for assignment were actual proximity to the school and whether the student had any siblings in that school. Race was a tie-breaker factor that came into play after some time into the process, when popular high schools became oversubscribed and too imbalanced racially. In those instances, the district would try to place the student in her next two choices and, failing that, in another school entirely.

    Everyone was placed in a roughly equal high school setting–what’s wrong with that?

    im not a fan of forcing anything by race, whether it’s affirmative action, or this school swapping business… when i was at school, there was a lot of “oh…he’s just here cuz he’s black” being muttered in the background…and it causes resentment, which just proliferates the exact same thinking and attitude that it was trying to prevent. im not against sending money from rich schools to poor schools, or it being possible to choose which school you (or your kid) goes to… let those that want to succeed have the opportunity to do so… i just don’t agree with “25% of our students go here so they have some black kids, and 25% of their students come here so we get some white kids…” wtf is the point of that? redistribute the wealth, not so much the kids.

Your argument is genuine and considerate, but I feel that the court today struck down an overreaching and convoluted law. I don’t think this should be seen as a roll-back of rights, however. I feel that my state, Virginia, for example, has some good rates of minority achievement, and Virginia can do it without assigning students regularly in regard to race. Perhaps the states in question should be turning bad schools into good schools instead of scrambling to pick a few bright kids to leave the bad schools behind. Everybody deserves a good education.

    I hope that in the long-term, I won’t be wrong.

    The Dallas Independent School District’s examination into its now-defunct credit card program has ended with investigators filing detailed reports on 93 employees, including 44 principals and two assistant superintendents.

    Of the 93, five to eight probably will be referred to law enforcement for prosecution, according to the chief investigator. Names of the remaining employees have been given to DISD to mete out punishment.

    I would hope parents would want their children to attend the best schools, not the most diverse schools. If the best schools happen to be the most diverse well thats great, but they should be looking at the districts (and individual schools) performance when they are picking a school district and then school with in the district.

    Integrating our schools improves our entire society. We have children from every race who grow up together. It opens people to new ideas and different cultures. When you actually know people of a race, it helps you see things from their perspective. You give every race a “human face” in your mind, which leads to more compassion.

    It’s beneficial to combine white and Hispanic children for example because the Hispanic kids are better able to learn English and integrate into US culture while the white kids can learn more Spanish and Hispanic culture.

    You don’t improve racial and cultural tensions by just ignoring race/culture entirely. You only create more ignorance about anyone who are different.

    I’ll tell you what is wrong with the schools that don’t work. They don’t respect the kids. It really does boil down to the fact that every success story in education - including teh ones in which they make major motion pictures out of - starts with a teacher or a Principal who decides to give the students respect.

    In my own classroom experiences, I can tell you that the teachers who don’t respect the students have a lot of discipline issues, while the same students, are productive and respectful to the teachers who they feel respect them.

    We have punishment-oriented systems that DON’T work. It’s common sense that people will resist force, but accept relationships founded in respect. But the conservatives who control these systems get off too much on spanking a ‘bad’ kid to consider chaning it… Appalling.

    South Florida is the exception, not the rule. Hispanic communities in many other parts of the country are not as well-off as Miami. Do you really think you can compare a rich pre-Marielito Cuban neighborhood in Miami to a neighborhood of Guatemalan day laborers in West Virginia? Those are two vastly different economic situations.

    School integration is not about “whitey helping the brown people.” It’s about uniting people as Americans, not dividing them into separate but equal enclaves. Perhaps there wouldn’t be so many “racist Liberal” attitudes out there if our schools and neighborhoods were more integrated.

    What about the cruelest punisment of all?
    Making the teenaged body get up at 5:30 am to attend the first class at 7am?
    Why is it that an elementary child goes to school at 9am, while a teenager goes at 7am? Convience for the parent, no doubt.
    My teenaged daughter looks like Night of the Living Dead when she’s up that early, while my toodlers are practically bouncing off the wall.
    Incidently, a study from a school in Minnesota that implemented a later start for high-schoolers showed a drastic increase of grades. If I recall (and I’m too lazy to research), almost all graduating seniors where A students.

    Being a teacher, I would say that a school that walks its talk (mission statement of nurturing students) would be prefereable to one with a high rate of test grades. The test scores are meaningless. Go ask any high school student. They will tell you that they memorize trivia for the tests and then forget it because it is useless nonsense. Those tests measure very little of quality. Why do you think teachers are so against NCLB?

The fact is that people of color have been discriminated against and the point of integration is to eliminate any advantage or disadvantage due to race, color, sex, or ethnic origin.     This SCOTUS ruling is an abuse of two separate meanings of the word “discriminate” in the English language. The neutral meaning of the word is to “distinguish between”. However, social discrimination means to distinguish between people of class or race and to rank them and treat them unfairly.

    It’s a disgrace that the SCOTUS should abuse the word this way. They know perfectly well that all justice begins with discriminating between the act that is unfair and the act that is fair. Judges must discriminate between reasonable and unreasonable facts all day. The SCOTUS FIVE have merely chosen to be Weasel Racists.

    To distinguish between groups who, for various socio-economic and racial reasons, have been placed at an unfair disadvantage and those give an unfair advantage and to level the playing field throughout society. It can easily be seen that to leave things as they are –that is, to embrace laissez-faire– is to deny or abridge the rights of citizens.

    A person in a wheelchair has just as much of a right to use the stairs as any other citizen. Is there discrimination if one provides only stairs? Yes. Is there discrimination if one builds an access ramp? Yes. But the use of the word discrimination is not the same in each sentence. One implies disadvantage, while the latter suggests equality.

    Let’s face it. The Right wants a class society. They like privilege and distinctions of rank. They don’t want a level playing field. And the last thing they want is to have past wrongs righted.

Brazil is also considered Latinamericans, of course, although they speak portuguese and have a lot of black population, like Columbia, Ecuador, Venezuela and Peru and the Caribbean countries. BTW here in the DFW area, probaly like south FL. there are a lot of poor hispanics who are the recipients of discrimination all the time.     As a black man I beleive in school integration. I live in an upper middle-class area, so the school is integrated because my nieghbors are white and hispanic. If the nieghborhood is all black or hispanic and poor the schools will be segregated and often sub-par. Maybe the situations is based on economics. Nobody is clamoring to bus their kids to POOR white schools.

    The public school system is failing. Every school should offer the same standard of enducation. The problem can’t be about racism. The problem is bigger than that. And, no, I don’t have a solution to propose at the moment - but perhaps the government should take more of an interest in educating its people. Offer the same standard of education across the board. Make university enrollment available to all high school graduates. Offer incentives for performance. Offer vocational school and specialized training for those not interested or qualified to attend university.

    I’m not suggesting doing away with private schools, but perhaps raise the question as to the need. We should want to be united as a country and proud of our people. And, we can start by properly educating (and offering the opportunity) to each and every one.

    What about the cruelest punisment of all?
    Making the teenaged body get up at 5:30 am to attend the first class at 7am?
    Why is it that an elementary child goes to school at 9am, while a teenager goes at 7am? Convience for the parent, no doubt.

    I agree. It was originally so that the students could work on the farm, or in the family business. It remains that way to appease the footballcoashes. Every year, someone tries to change it in my district, and every year the coaches knock it down…

    My teenaged daughter looks like Night of the Living Dead when she’s up that early, while my toodlers are practically bouncing off the wall.

    Incidently, a study from a school in Minnesota that implemented a later start for high-schoolers showed a drastic increase of grades. If I recall (and I’m too lazy to research), almost all graduating seniors where A students. Food for thought is all

    Any parent who chooses C over A or B should have child services look into their parenting, and should have to pay a higher tax for welfare services, because their kids are more likely to need them

    The test scores are meaningless. Go ask any high school student. They will tell you that they memorize trivia for the tests and then forget it because it is useless nonsense.
    I would tell you that I learned the process of getting to the answer, and it’s why I did better than some of my peers beacuse they concentrated on learning the answer and not the process, so they can’t make educated guesses or logical conclusions to get questions they don’t know correct. The test results will show that difference between students, resulting in schools that do better at teaching the process than the answer having higher average scores.

    Why do you think teachers are so against NCLB?
    The bad ones because they are used to being unionized and not having to worry about accountability, the good ones because they aren’t getting the funding they need for it.

    Have you considered an argument that isn’t based on the evil conservatives/rich trying to screw everyone else over? I seem to remeber Teddy K being really involved in NCLB, maybe it sucks because of the stuff he got included. So my take on the situation is that it’s conservative administrators trying to fix all the problems Liberals introduced with their contributions to the current situation.

    But, and I really HATE to defend somewhat Joker, I do not live in the US and illegal immigrants (Mexicans and Central Americans, mostly) have adopted this “name” in order to defend their identity, IMO. They use it to differentiate themselves from the white, rich guys or the black population.

    In a cultural way, I agree with this description and this defense of identity, like Catalans or Basques, but taken it as an excuse to NOT integrate themselves in the community they live, I find it wrong.

    Your splitting hairs. I was using numbers given to me last year by the school system that nationwide the graduation rate is about 60%. I wasn’t that far off.

    The national graduation rate for the class of 1998 was 71%. For white students the rate was 78%, while it was 56% for African-American students and 54% for Latino students.

    Georgia had the lowest overall graduation rate in the nation with 54% of students graduating, followed by Nevada, Florida, and Washington, D.C.
