Yesterday, the Senate Judiciary Committee issued subpoenas for documents related to the White House’s warrantless surveillance program. Today, White House spokesperson Tony Snow called the subpoenas “outrageous” and alleged that Congress was kept “fully informed all along the route:”
SNOW: [L]et’s just say it’s an outrageous request. What you have is a program that was briefed to members of Congress. Members of Congress were kept fully informed all along the route, as well as on the legal justifications and the legal findings behind them. … it is pretty clear that, again, members of Congress here are engaged in an attempt…to try to do what they can to make life difficult for the White House.
Snow’s claim is false. As ThinkProgress has noted, both former senator Bob Graham, who was chairman of the Senate Intelligence Committee, and his successor Jay Rockefeller (D-WV), said the briefings were inadequate and did not convey that the Bush administration would “abandon the FISA process and utilize warrantless intercepts of conversations.”

And don’t forget that some of those few that were briefed were told they’d be charged with leaking classified material if they said anything.

In fact, the fact that congress was aware of “some” of it is entirely irrelevant to the case. Bush has broken existing federal law (see United States vs. Nixon) and needs to be swiftly impeached and put out of office.
Whether anyone else was aware of some of what he was illegally doing certainly doesn’t make it legal in any way. It’s highly illegal and he needs to be adequately punished for breaking federal law.

Not made up. Pretty damn obvious. Bush’s military tribunals were ruled invalid by the American supreme court, that made them illegal. Bush’s wiretaps were done without a warrant (BTB: The required warrant could have been gotten up to 3 days AFTER listening in began, hardly onerous) and were thus illegal.
Further, what happens to a normal personw when they get a subpeona and they choose to ignore it? Yep, that’s a crime too.
Pelosi and the Democrats have AMPLE grounds for impeachment and conviction, the trouble is, they want to do exactly the same things as Bush is doing now. They want their president to have absolute power, and the best way for them to do that is to use Bush to generate a precedent for that power.
By accepting that a unpopular Republican President with under two years left in office, as being above the law, they can use the powers he grabbed when a more popular Democrat takes over. The Republican party is now for all intents and purposes dead, it is identified with corruption, incompetence and stupidity. The first two are a result of K Street and the 6 years the Republicans held all three houses, the last is due to the remaining 30 percenters.

Adverse inference: The President’s original admission of warrantless interrogations/surveillance is valid; and evidence of criminal activity.
Reynolds and NIxon are precedents which prohibit classification of illegal activity behind a claim of privilege or state secrets. Legal counsel like Clements who appear to have been engaged in illegal activity, and not stopping it, could be disbarred for not having resigned. Snow’s denials are fleeting, without merit, and not supported by the Preident’s fatal admissions to the contrary.

Fact: In July 2006 it was revealed that the Office of Professional Responsibility in the Justice Department — the office “responsible for investigating allegations of misconduct involving Department attorneys” — repeatedly attempted to investigate whether DOJ lawyers acted improperly concerning their role in the President’s warrantless eavesdropping program, but finally stopped their investigation because the President refused to give them the security clearances they needed to conduct the investigation.
Yet the President had no problem giving clearance to individuals, some who where civilians, when he wanted to find out who had leaked information regarding the warrantless wiretapping program to the public.
Bush has repeatedly claimed that the warrantless wiretapping program is legal. Yet he continues to hide (what is he afraid of?) and block any attempts at oversight. And spare me the argument that Bush made when he said that Congress was advised of the program. I didn’t know that Congress was made up of 8 members.
From recent testimony, it appears that not everyone in the administration was going along with this program. Until recently, Bush would have us believe that there was no disagreement. Had the investigation by the OPR been allowed to proceed, they surely would have found this out. However, up until the Democrats regained oversight power, the rubber-stamp Congress didn’t give a damn what this “president” did, despite members of the Republican party, among them Arlen Specter and Lindsey Graham, announcing that, yes, the warrantless wiretapping program was against the law and called for investigations yet ending up kissing Bush’s ass anyway.
Fact: President Bush says his warrantless wiretapping program, which involves communication in which one end of the call is in a foreign country, is a valid program because the NSA does not have enough time to go to the FISA court for a warrant. Mr. Bush says going to the FISA court would slow down the process of tracking terrorists and that they may get away.
However, Mr. Bush says that for domestic to domestic calls, he still goes to the FISA court.
So in other words, in one situation (domestic-international call), we don’t have time to go to FISA. But in another situation (domestic-domestic call), which could also involve one terrorist talking to another, Bush does go to FISA. Thus in one situation, he is “concerned” about time constraints, and in the other he is not. Bush’s rationale for avoiding the FISA court is blown to hell.
