Just like the Hamdan case the administration will draw lines in the sand until they’re challenged in court and then they back off, but still maintain the power stretch they have extracted. The question is; would a split government scenario with a Democrat in the White HOuse and congress having a majority of Republicans allow these power grabs to continue?

This whole BS about the VP’s being part of the Executive Branch is very easily solved (for anyone with half a brain, at least). Just consider HOW the Vice-President gets his job. The PRESIDENTIAL nominee of the party (Democratic, Republican, Libertarian, Universal Galactic Peace) SELECTS the Vice-President as his RUNNING MATE. Then, on Election Day, the ELECTORAL COLLEGE votes for a President AND Vice-President.
If the Vice-President is to be separate from the President, then he (or she) should be elected separately by the People. Technically, the Electoral College *could* vote for a Republican President and a Democratic Vice-President, or vice versa, but it’s highly unlikely that would ever happen. However, in most states, the election ballots are printed to feature the Party’s Presidential and Vice-Presidential nominees as a single entity (other electronic systems similarly list each party’s Pres and Veep candidates on one line) so that when one picks a particular party’s Presidential candidate, one gets that party’s Vice-Presidential candidate as well.

Technically:

Bill Clinton is “right” because he can claim to define sex as penis to vagina penetration only, and exclude oral, anal, and masturbation.

Technically:

“The executive Power shall be vested in a President of the United States of America. He shall hold his Office during the Term of four Years,8 and, together with the Vice President, chosen for the same Term, be elected, as follows…”

Dick Cheney is “right” because he can claim to define the and as being connected with the second sentence pertaining to term, and not the first sentence pertaining to Executive power.

Of course people only drag out these “technical” definitions when the feces is about to hit the fan!
