Wilson to testify on March 16, in an effort by his committee to look into “whether White House officials followed appropriate procedures for safeguarding Plame’s identity.”
On March 16, 2007, at these hearings about the disclosure, Chairman Henry Waxman read a statement about Plame’s CIA career that had been cleared by CIA director Gen. Michael V. Hayden and the CIA:
During her employment at the CIA, Ms. Wilson was under cover.
Her employment status with the CIA was classified information prohibited from disclosure under Executive Order 12958.
At the time of the publication of Robert Novak’s column on July 14, 2003, Ms. Wilson’s CIA employment status was covert.
This was classified information.
Ms. Wilson served in senior management positions at the CIA, in which she oversaw the work of other CIA employees, and she attained the level of GS-14, step 6 under the federal pay scale.
Ms. Wilson worked on some of the most sensitive and highly secretive matters handled by the CIA.
Ms. Wilson served at various times overseas for the CIA.
Without discussing the specifics of Ms. Wilson’s classified work, it is accurate to say that she worked on the prevention of the development and use of weapons of mass destruction against the United States.

True, but that is not what is reported in the media, who let lies float into the atmosphere without challenge. When the CIA proved that Plame was undercover and working for an undercover operation, when they proved that her work as a so-called analyst for Brester Jennings was her cover as an agent — when her company was actually working on the detection and investigation of the proliferation of nuclear weaponry, and this case blew the entire operation — the media almost universally ignored it. They preferred to parrot the repugnican talking points of lies, smoke, slogans and jeers.

And for the record, Marc Rich was indicted for tax evasion and an illegal oil deal with Iran. Oil deal does that ring any bells. Iran, Reagan and Bush sound familiar. Scooter Libby, Rich’s attorney. Who do you think harangued Clinton into pardoning him?

A few points for our Republican friends:
1. THE CONVICTION AND SENTENCE: The conviction in Libby’s case resulted from an investigation requested by the CIA in a Republican controlled administration. The investigation was conducted by a special prosecutor selected by the Republicans DOJ. The investigating prosecutor was a life long conservative Republican with a national reputation for investigating corruption cases and for being even handed in his approach to the administration of justice. The jury convicted Libby after hearing all of the evidence. The judge imposing the sentence was a conservative appointed by the Republican demi-god Regan. The appeals panel rejecting a stay of the imprisonment pending appeal again consisted of judges appointed by Republican presidents in one of the most conservative appellate courts in the country. The sentence fell right in line under the federal sentencing guidelines. One would expect that under these circumstances that the conviction and sentence would be given great deference by the conservative base. Ha! Ha!
2. NO UNDERLYING CRIME: The primary defense of the right wing apologists is that Armitage leaked and there was no underlying crime or that Plame was not covert.
a. ARMITAGE LEAK IRRELEVANT: One person leaking classified information does not excuse subsequent leaks. Note that Libby discussed the information prior to Novak’s article and would not have known of the Armitage leak. Even if he did, it would not have excused such conduct. One could even find that Armitage had been given the information by White House insiders so that he could be used as a pawn (scapegoat) by others (Cheney?) However, we do know that Libby’s perjury and obstruction of justice did indeed interfere with the investigation of the leak of information and very likely made it difficult (if not impossible) to really determine whether a crime occurred as Fitzgerald noted when he brought the indictment.. One would find it hard to believe that this was not a serious matter as even the President conceded.
b. PLAME WAS COVERT: This much has been stated by the CIA. The Fitzgerald agreed based upon his review of the classified information provided to the judge. I would note that we can infer that the judge agreed by the seriousness of the sentence. We do know that while stationed at CIA headquarters, Plame was dispatched overseas a number of times in a NOC status. Pundits stating that the operative must be stationed overseas can not point to such a requirement in the statute. We do know that the cover corporation used by Plame was blown. We do know that others using the corporation as cover are now endangered. We do know that sources used by Plame or other operatives using the cover corporation are impacted. By the way, it does not matter that Plame worked at Langley. One can still drive to CIA headquarters every day and still not be know by the Iraqi’s, Saudi’s or Pakistani’s to be employed by the CIA. One can also work with private foreign companies and consultants who are involved in proliferation of nuclear technology and still work at Langley. Fortunately, most of our opponents in this arena do not have the resources to tag every CIA employee and track them to see if they go overseas.
3. CLINTON EXCUSE: The right wingers were obsessed with Clinton’s failure to be prosecuted for perjury. Let us note the difference:
a. The special prosecutor was appointed by independent judges (actually appointees by a prior Republican president). The special prosecutor (Kenneth Starr) was a well connected Republican who had been an active party member. Starr spent tens of millions of dollars in an investigation that ranged over every alleged scandal involving the Clinton administration (Whitewater, FBI documents, Foster’s death) and came up with no evidence of a crime with one exception. It should also be noted that the investigation was plagued with leaks by Starr’s office. Starr also seemed to live a lavish life style.
b. Clinton was finally charged with a crime. Note that the original issue involved Clinton’s testimony at a deposition in a civil case. Clinton was asked about a voluntary affair. The testimony was not relevant to or material to the case at hand (alleged sexual harassment). Indeed, the underlying case was later dismissed by the judge. Clinton was dragged before a federal grand jury investigating his deposition during the civil case. This became the “perjury”. The matter was never referred to a criminal prosecution. Don’t blame the Democrats. Starr reported to the Republican controlled Congress that tried to impeach Clinton. It failed much and the Republican actions seriously tarnished their image with the public.
4. BERGER EXCUSE: Berger purloined some classified documents from the archives to prepare for his 9/11 commission testimony. It was bad. He was charged by a Republican administration and plead guilty before a judge appointed by a Republican president. He was sentenced in accordance with the sentencing guidelines. The myths about the Berger case really are astounding. The most common is that Berger took the documents to destroy them and hide evidence of severe dereliction on the part of the Clinton administration. Tough luck, the Archive gives no one the original of a classified document as representatives of the Archive publicly noted. Thus Berger never endangered the classified documents.
5. PARDON AND COMMUTATION RECORDS: No one here is going to defend the pardons of past presidents. However, Bush has been particularly stingy in granting pardons compared to past presidents. No one condoned Clinton’s or Berger’s conduct. Too many right wingers find no problem with Libby’s conduct. Berger admitted his guilt while Libby did not (no contrition at sentencing) which also impacts sentencing. No, it seem that there is one law for the Republicans and another for the rest of us.

He not only outed a covert CIA agent, he also outed her cover company (Brewster Jennings) which means that he put the lives of a lot of agents in jeopardy. For all we know these agents could have been killed or captured. But, we can’t know because the CIA’s investigation into this is classified.
And to all you trolls who will scream “she was not covert”, please answer this question. If she was not covert, why did she need a cover company?

Fitzgerald determined that no federal statute was broken when then-Deputy Secretary of State Richard Armitage revealed that Valerie Plame Wilson, the wife of Bush critic Joseph Wilson, worked for the CIA. But Fitzgerald prosecuted Libby for allegedly not telling the truth in the course of the investigation.
