During the White House press briefing this morning, spokesman Tony Snow characterized President Bush’s commutation of Scooter Libby’s prison term as “routine.”
“The president spent weeks and weeks consulting with senior members of this White House about the proper way to proceed,” said Snow, adding, “I think it handled it in a routine manner in the sense that the president took a careful look.” Watch it:
There was nothing routine about this commutation. Although Snow said Bush consulted with White House advisers, the New York Times reported this morning that the decision “seemed to catch Justice Department officials, and even some of Mr. Bush’s closest aides, off guard. … They were floored.” Additionally, the Washington Post noted that Bush circumvented the normal route for commuting a sentence:
For the first time in his presidency, Bush commuted a sentence without running requests through lawyers at the Justice Department, White House officials said. He also did not ask the chief prosecutor in the case, Patrick J. Fitzgerald, for his input, as routinely happens in cases routed through the Justice Department’s pardon attorney.
Bush granted Libby clemency even though he was appealing his sentence and had not yet served any jail time. According to the Justice Department, commutation requests “‘generally are not accepted unless and until a person has begun serving that sentence,’ and they are generally not granted to those appealing their convictions.”
Additionally, Snow’s comment that Bush “spent weeks and weeks” figuring out how to proceed on Libby is contradicted by a senior administration official who said that “Bush quickly made his decision yesterday after hearing that the U.S. Court of Appeals had refused to keep Libby out of prison while his appeal ran its course.”

QUESTION: And just as a follow-up, can you shed any light on the president’s process of deliberations, his — how we went about thinking about this decision which you said he considered over weeks and weeks?
SNOW: Only to a very trivial extent because, as you know, there’s a very important debate going on in Washington about the importance of maintaining the sanctity of deliberations within a White House.
I will leave at this: The president spent weeks and weeks consulting with senior members of this White House about the proper way to proceed. And they looked at a whole lot of options and they spent a lot of time talking through the options and doing some very detailed legal analysis.
QUESTION: (inaudible) outside the White House?
SNOW: I’m not going to characterize beyond that. [...]
QUESTION: Can I follow on that? If there are more than 3,000 current petitions for commutation — not pardons, but commutation — in the federal system, under President Bush, will all 3,000 of those be held to the same standard that the president applied to Scooter Libby?
SNOW: I don’t know.
QUESTION: Tony, I’m trying to get a handle on it. Are you saying this White House handled this in an extraordinary manner or in a routine manner?
SNOW: I think it handled it in a routine manner in the sense that the president took a careful look. But it is an extraordinary case by virtue of the fact that not only do you have the extreme level of publicity, but also that in many ways the hand was called by a court decision to go ahead and send Scooter Libby to jail while he was still in the middle of his appeals process.
QUESTION: But how could it not be extraordinary to grant something to someone who didn’t even ask for it?
SNOW: I just think it’s just the president, again, using his commutation power to do what he thought was necessary to address what he thought was an excessive punishment.
QUESTION: But absent a request, he wouldn’t even have known about this case if it didn’t involve his formeraide.
SNOW: Well, no, I think you probably would have reminded him of it. The fact — you talk about if it had not involved a formeraide. This is the thing that has been in the headlines for quite awhile.

The trial to be honest, was somehwat aniclimatic. Fitzgerald, casting himself as Javert, demanded Libby get a harsh sentence as punishment for crimes he had not been convicted of.
The judge, casting himself as David against Goliath, demonstrated an impressive capicty for talking about himself. President Bush entered the stage like a character from another world, a world in which things make sense.
Of course the howlers howl. That is their assigned posture in this drama. The only thing you can count on is that their anger has been cynically manufactured from start to finish

What some are forgetting is that multiple people (Libby, Rove & Armitage) exposed Plame independently of each other. Don’t forget about Julie Miller & Matt Cooper’s sources. There wasn’t one instance of a crime, there were multiple.
Libby committed Perjury and Obstruction of Justice during the investigation of the total scope of the leak, not just the source of Novak’s article.

Victor Rita, convicted of perjury and obstruction of justice, asked for a lighter sentence based in part on his past military service. But the judge gave him 33 months, as suggested by the guidelines. The U.S. Court of Appeals for the 4th Circuit, based in Richmond, upheld the sentence, saying that penalties within the guidelines are “presumptively reasonable.”

(AP) The Bush administration is trying to roll back a Supreme Court decision by pushing legislation that would require prison time for nearly all criminals.
The Justice Department is offering the plan as an opening salvo in a larger debate about whether sentences for crack cocaine are unfairly harsh and racially discriminatory.
Republicans are seizing the administration’s crackdown, packaged in legislation to combat violent crime, as a campaign issue for 2008.
In a speech June 1 to announce the bill, Attorney General Alberto Gonzales urged Congress to re-impose mandatory minimum prison sentences against federal convicts — and not let judges consider such penalties “merely a suggestion.â€

The presidential power of pardon and commutation should require a majority senate vote (majority of voters present is sufficient – 50 isn’t necessary). There needs to be a check on this power. This President has taken executive power to a new level – a low in American freedom and prosperity. Do I agree with Clinton’s pardons?

Bogus Spin #1: Special prosecutor Patrick Fitzgerald went after Libby even after learning that Richard Armitage had been Bob Novak’s “primary source” for his column outing Valerie Plame Wilson as a CIA employee.
Wrong. Armitage made his admission in early October 2003, nearly three months before Fitzgerald was appointed. So it should be clear that Fitzgerald wasn’t appointed just to find out who leaked to Novak. In fact, this means that — even with Armitage’s confession in hand — there was so much evidence of wrongdoing that a longtime GOP loyalist like John Ashcroft felt he had no choice but to recuse himself and allow the appointment of a special counsel.
Bogus Spin #2: Even so, Libby wasn’t the only one who leaked about Plame.
Maybe not, but it turns out that every other Bush administration who leaked did so with information they got as a result of Libby’s actions. Ari Fleischer testified during Scooter’s trial that Libby told him over lunch about Plame working for the CIA, and Karl Rove reportedly told a similar story to the grand jury that indicted Libby. Meanwhile, Armitage and Bushite press flack Dan Bartlett both found out through a State Department memo that was produced in response to questions that Libby had asked a top department official about Wilson’s trip to Niger. If Libby (and his boss, Dick Cheney) had been content to reply to Wilson’s criticisms on their merits rather than by rattling cages in search of fodder for personal attacks, none of the other officials would ever have been able to leak about Plame.
Bogus Spin #3: The trial was just Libby’s word against that of a bunch of reporters.
Although three reporters did testify, they were preceded on the stand by six different government officials who each testified to having conversations with Libby about Joe Wilson’s wife before the date when Libby first claimed to have heard it from a reporter. It was these officials’ testimony, more than that of the reporters, that convicted Libby.
Bogus Spin #4: Libby was convicted for having a faulty memory.
It’s never mentioned in the mainstream media, but Scooter didn’t just “forget” telling reporters about Joe Wilson’s wife working for the CIA, and deny it when he really had told them.
No, Libby’s “faulty memory” caused him not only to deny where he had learned about Plame — a note produced in the trial showed Vice President Cheney had told him she worked in the Counterproliferation Department of the CIA (where the majority of employees are covert) — but to invent stories saying he HAD leaked to reporters when he hadn’t. He claimed to have been the first to tell Matt Cooper about Wilson’s wife, thereby covering up the fact that Karl Rove had done so. And he shielded Fleischer by falsely claiming to have told the Post’s Glenn Kessler as well, apparently trying to cover for the Post’s October 12, 2003 report that a journalist for the Post (who turned out to be Walter Pincus) had been leaked to — a news story that was found, with key passages underlined, in Libby’s files.
Thus Libby was convicted not just of perjury but of intentionally lying in order to obstruct the investigation. And what George Bush did yesterday was intended to make sure he got away with it.

Libby goes to trial and indicates he will call Chenney as a witness. His lawyers put Chenney on Scooter’s witness list. But everyone knows Chenney and Bush can not possibly allow Chenney to be cross-examined by Fitzgerald. He would be eaten alive publically and it would be a political disaster of the highest magnitude for the administration. In addition, he might have to commit purgery to protect himself and the President. . It simply can not take place. (Scooter and his attorneys KNOW that.) So…all of a sudden Chenney gets dropped from Scooter’s witness list and Scooter puts on a weak defense without him. Do you think maybe he did that because he was promised that if he agreed not to call Chenney, then no matter what happened he would never spend a day in prison? That’s what I think. He hedged his bet. Roll the dice at trial without calling Chenney to bolster his case…….but if he loses he has a promise of never having to go to prison, and eventually getting a full pardon. Scooter knew the moment his lawyers put Chenney on that witness list that he was home free. It sounds to me like nothing more than a continuation of the obstruction of justice in the case.
