1. Signing statements have no basis in law. Banning them only gives them more legitimacy than they already have. They have no more legal meaning than the doodles he does during security or hurricane briefings. Read the constitution. It's no where. He must follow the law as written. Period. They are used to give opinion or comment on a law. Thats fine, but that comment can't be "I won't follow it."
2. Spector (my senator) is full of it. He talks a big game, but in the end does nothing. It gets him on the TV though.

Supposedly was Specter's aide along with someone in the DOJ. Unless I missed an update somewhere. Has Specter ever explained how his chief counsel is able to act independently in such vital legislation?

Remember, the Rep leadership under Frist & Hastert did this too, adding bits to bills after they're released from committee but before a floor vote, and neglected to tell anyone.

I have never figured out how these signing statements can be legal.
If a President is clarifying a law, that's one thing.
What Bush has done in a variety of cases is effectively vetoed a bill without vetoing it.
Examples - Bill on torture. Bush says he's going to ignore it.
Treaty with India. Congress says he must respect atomic bomb treaties. Bush says he's going to ignore it.
In both cases, Bush has vetoed the bill, but Congress does not have the option (Constitutional) of over riding his signing statement.

Spectre is always a tool...I can only imagine how a bill, once introduced, where people start whining about need to compromise and blah blah blah...they pass a travesty of a bill that actually provides some legitimacy for signing statements where none ever existed. I can already hear concern troll war-lust Lieberman already whining about how, on national security issues signing statements ought to be recognized as an extension of the President's role as COC... ugh. It takes a lot more than that. It takes a devout 25% of the population suffering from the Führer-prinzip, a corrupt media wherein crooked financiers pay lickspittles to pooh-pooh any criticism of the frat-boy's crimes, and a cowed opposition. And, most importantly, the apathy of the 75%.
That last bit is essential. And it looks to me that's slowly being taken care of. When the apathy turns to rage, the opposition will (slowly, more slowly than we'd like) find its courage, the pundit lickspittles will shift with the prevailing winds, and things will change.
Not fast enough, but they will change.

I agree. The problem is the SCOTUS is so loaded with Bushites they will rule with Dick Cheney and say that Signing Statements are constitutional.
What we need first is term limits on the Supreme Court. 4-6 years max per jusitce including the Chief Justice. Otherwise we will have likes of Renquist who was a drug-addled psycho sitting on the court for 30 years or the current bunch (Roberts/Alito) who will be there for my entire life and I am only mid-40s.
