Giuliani Sacrifices Principles On Executive Clemency; Contradicts Past Statements

giuliani.jpgOn Tuesday, former NYC Mayor Rudy Giuliani said President Bush’s decision to commute former Cheney aide “Scooter” Libby’s 2 1/2 year sentence for perjury and obstruction of justice was “reasonable” and “correct,” despite the fact that the president “quickly made the decision” without consulting the Justice Department or the pardon attorney.

Giuliani hasn’t always believed that such a hasty process was “reasonable” for executive clemency. In 1982, when he was an assistant attorney general in the Reagan DoJ, Giuliani said clemency entailed “a complex, yearlong procedure“:

According to Associate Attorney General Rudolph W. Giuliani, executive clemency involves a great number of people and a complex, yearlong procedure. Every request is subject to a detailed inquiry by the Federal Bureau of Investigation, which conducts as many as 50 interviews to flesh out each application. That background investigation is as comprehensive as any the bureau conducts on a prospective United States Attorney, Mr. Giuliani said.

The case is next studied by the pardon attorney, who makes a judgment that Mr. Giuliani reviews. His judgment, in turn, goes to Fred Fielding, the White House counsel who re-examines the files and makes his own judgment. Then, according to Mr. Fielding, every request is presented to the President for his concurrence.

In 1982, Giuliani also said that remorse was important for bestowing clemancy. “We also look at the reason for the request and a recognition that the person knows he’s done something wrong,” said Giuliani. In fact, Giuliani even “recommended that the President deny the request of an embezzler who insisted he had committed no crime.”

In 2001, while castigating former President Bill Clinton for pardoning financier Marc Rich, Giuliani said it was important to confer with prosecutors before offering executive clemency:

The op-ed piece in The New York Times raises more questions than it answers. He’s left out the trading with Iraq. Somehow he thinks that a pardon is now intended to determine whether indictments are wrongful enough. But he doesn’t talk to the prosecutor, just the defense lawyers. Libby never admitted any guilt nor did Bush consult special prosecutor Patrick Fitzgerald prior to issuing his commutation. But that didn’t stop Giuliani from ignoring his previous standards and concluding that President Bush acted properly.

I think the questions the former president has created here put in doubt the pardon process, and it’s not just — you’re focusing on the Marc Rich part. He did about 50 that he didn’t run through the Justice Department.

Bush didn’t run the Libby commutation through the Justice Department either.

    Yet no President in the history of the US has effectively halted a criminal investigation of their own administration through pardons. That’s a whole different level of corruption, dishonest and hubris.

    In fact, of the 14 people convicted in the course of Ken Starr’s Whitewater investigation, not one had their sentence commuted before going to prison.

    Yet Ken Starr used offers of reduced sentences in order to try to obtain cooperation.

    One of the 14 died in solitary confinement.

    Faced with the circumstances of an investigation into corruption by a special prosecutor, President Clinton could have commuted the sentences or pardoned the guilty, but he didn’t.

    Clinton most certainly did not do it too. Any argument to the contrary must address the Whitewater investigation, the convictions, the prison times served by friends and associates of the Clintons.

    While I’m at it, has anybody noticed that the only people to serve jail time in the Plame case were the very reporters the Administration used to disseminate the leak?

    he didn’t say it was unjust — he said it was excessive. He let the conviction stand, which indicates that the conviction was just. He said that the sentence (which was within federal sentencing guidleines) was excessive.

    The reason jail time served is significant is that it is a standard basis for considering pardons.

    Yes, Bush was within his rights. The problem for him and for Republicans is that, because he ignored almost every standard benchmark in considering the commutation — jail time served, consultation with DOJ and prosecuting attorney, expression of remorse — it makes this look an awful lot like a move to make a potentially damaging story go away.

    Yes, the Libby commutation was legal. That doesn’t make it right, and it doesn’t make it just. If the only argument you have is that it was legal, then you’re drawing on a pretty weak hand.

    Read closer. I never said it was required. I agreed with you that the commutation was within his rights.

    The problem is that Bush ignored almost all of the procedures accepted as standard for considering these kinds of decisions.

    It’s not a legal issue. It’s an issue of moral judgment, of political opportunism and public image. It’s an issue of valuing the rule of law, or valuing power and the privileged.

    When I said you were drawing on a weak hand, I meant that you were sticking with the simplistic legalistic argument and ignoring the vast problems with this decision by Bush. Good luck with that.

    My sister told me that her daughter (early 20’s) says that “hippie” is quite an insult to the younger ones these days. Had to be the fault of the conservatives, demonizing a word, just like they did with “liberal”. Funny thing is, if you look up “liberal” in the dictionary, one definition is “open-minded”. Now naturally they had to demonize the word that best described their ideological opponents (as being the opposite of “close-minded”, like them). I’m proud to call myself a “liberal”, and I would be insulted if I was called a “capitalist”. After all, unlike “capitalists”, I care about people more than I care about making money.

    I think it has more to do with the fact that “hippies” were their parents’ generation, therefore scorned. Also, hippies are simply out-dated. No tattoos, either. Pfui.

    Old hippies do frequently look like they’re trying to hard, much like middle-aged guys still sporting mullets. Since I’ve still got a good head of hair (now gray), I’ve wondered what it would be like to let it grow back out. Probably too hot, though. :-)

    It was not within his authority if the reason why he granted clemency was to cover up for crimes that he and Chaney have committed. That is a criminal offense called….you guessed it…..obstruction of justice. Hopefully some Democrats other than just Gore will have the courage to accuse him of pardoning Libby to prevent Libby from telling what he knew about Bush and Chaney’s involvement in outing Valerie Plame. Then they should haul Libby back into court, give him immunity and then make him testify. If he lies again or refuses to testify, they can throw his ass in jail for obstruction of justice.

    Claiming that Clinton “did it first” implies that Bush did the same thing that Clinton did.

    Far from it.

    The fugitive felon Rich paid for his pardon by having his wife give political donations to the Clintons. Clinton also pardoned the McDougals, co-conspirators in the Whitewater affair, campaign contibutors, family members, cabinet members and other assorted lowlifes.

    In this town, they say you can indict a ham sandwich. When it came to the supposed “outing” of a supposedly “covert” agent, I didn’t even have enough evidence to do that.

    I rest my non-case.

    Those who claim that a lack of charges filed for that crime is proof that no crime occurred are mistaken at best, dishonest at worst.

    When it comes to Whitewater, cattle futures, billing records, and the like, I’m glad you finally agree.

    If this laughable story actually had any truth to it, you’d all be trying to recruit Mitt to run as a Democrat.

    But the truth is that Romney was on the board of directors of Marriot and didn’t try to intervene to stop the hotel chain’s sale of in-room pay-per-view pornographic movies, because, he says: “I am not pursuing an effort to try and stop adults from being able to acquire or see things that I find objectionable; that’s their right. But I do vehemently oppose practices or business procedures that will allow kids to be exposed to obscenity.”

    Now, if he HAD objected, you’d be whining about “fascism.”

    Regarding the Romney so-called “scandal”:

    As a member of the LDS Church, same as Romney, I happen to know for a fact that many “Mormons” also work in the casino/gaming industry in Nevada. It doesn’t mean we agree with gambling, it just means that we believe human beings have the fundamental right to choose for themselves the path they follow, and we actually FOLLOW those beliefs, rather than merely pay those beliefs lip-service and attempt to dictate how others should live.

    Mitt Romney followed the dictates of his religious beliefs, regardless of his personal opinion concerning porn. I would think you would respect him for his actions. Regardless, the whole thing is non-issue. What scandal? It’s not even being covered in the “normal” news outlets. Oh, but I did hear the story about how Mitt strapped the dogs car carrier to the roof of his car with the dog in it….they wen’t of vacation…and nothing happened! You all need to quite grasping at straws..but whatever floats your boat. By all means, keep discussing all this nonsense while the real world, and election cycle, goes by.

    That dog is pushing 35 years old. A good portion of today’s voting population doesn’t even know what Watergate is..they weren’t even friggin’ born yet! The only thing they know about President Nixon is what they’ve learned on “Futurama!” for chrissakes!! Keep on a’ wishin’ an’ hopin’ an’ prayin’ etc. etc.

    Watergate is ancient history, the story is old news, and won’t gain any traction. Who the hell reads the Huffington Post? Do you really picture a bunch of hard-core conservative Republicans huddled around the computer defecting to the Democratic party after reading the Huffington Post??? All I can say is: Dream On.

    Yup, Bill Kristol, Michelle Malkin, Rush Limbaugh, Sean Hannity…all reading the Huffington Post, looking for a new direction in life….man, is that funny!

    You just wrote a long defense of Mormons making money off of porn or working in the gambling industry, even though your religion is against such things. Now read this very carefully: there is a difference between saying “My religion doesn’t support that, but I won’t interfere with other people’s rights to engage in that,” and “My religion doesn’t support that, but I’ll make money off of it even though I don’t like it.” The former is tolerant behavior; the second is hypocritical behavior.
    I will not denounce the ACLU here, because I can agree with much of its work, though not all. There are good reasons why even known conservatives like former Congressman Bob Barr (very active in trying to impeach Clinton) work for it.

    Yes, you are a troll. However, TP allows trolls to post their arguments here, as long as they don’t get too vulgar, unlike rightwing blogs such as redstate, which ban even the mildest criticism of Bush and rightwing policies.
