Gore: Libby Had ‘Knowledge That Could Incriminate His Bosses In The White House’

This morning on NBC’s Today show, Vice President Al Gore called last week’s commutation of Scooter Libby’s prison sentence “very disappointing” and “improper,” specifically highlighting the fact that Libby had “knowledge that could incriminate his bosses in the White House which included the vice president and the president.”

Asked how Bush’s commutation was different than some of President Clinton’s pardons, Gore said, “Well it’s different because in this case the person involved is charged with activities that involve knowledge of what his superiors in the White House did.” Watch it:

Both President Bush and Vice President Cheney authorized leaks of classified national security information to the media to defend the Iraq invasion, and Cheney wrote notes on Joseph Wilson’s original Iraq op-ed asking, “[D]id his wife send him on a junket?” But the full extent of their direct involvement in the leak of Valerie Plame’s identity remains unknown.

As the New York Times opined last week:

Presidents have the power to grant clemency and pardons. But in this case, Mr. Bush did not sound like a leader making tough decisions about justice. He sounded like a man worried about what a former loyalist might say when actually staring into a prison cell.

On the day of Libby’s guilty verdict, juror Denis Collins famously told reporters, “It was said a number of times, ‘What are we doing with this guy here? Where’s [Karl] Rove … where are these other guys?‘”

Q. Before I let you go, I’d like to ask you about the Scooter Libby case and the fact the president commuted his sentence. What was your reaction to that?

GORE: Well, I thought it was very disappointing.

Q: Because?

GORE: Well, I thought it was improper. He is charged with having knowledge that could incriminate his bosses in the White House which included the vice president and the president. I thought it was very disappointing.

Q. And how is it different than when President Clinton pardoned, in some controversial cases…

GORE: Well it’s different because in this case the person involved is charged with activities that involve knowledge of what his superiors in the White House did.

    Tough to tell from that brief clip, but it didn’t sound like Gore handled that as cleanly as he could have.

    Libby wasn’t “charged with” having information about his superiors. He certainly does have that information, and it certainly was a factor in both the prosecution and the sentence, as a substantial amount of jail time can be an incentive to cooperate with the prosecutor. That possibility is gone now. But what I think Gore was trying to say is that the President had something to gain with this commutation, since Libby potentially holds the goods on some aspects of the administration that BushCo would like to be kept hidden.

    wow-The lack of evidence is directly due to Libby’s lying and misleading. THAT is why he should be in jail for tying up the investigation. The implications of wrong-doing stem directly from the Commuter in Chief going against evreything he’s become to be known for in Texas (a hard ass who would rather see retarded people put to death rather than commuting a sentence). The sentencing fit directly within the guidelines for these crimes as stated by the Rep. judge and the Rep. prosecutor involved. The parole boards recommendations (cited by the Bush team in determining that the sentence was too harsh) were for 16 months NOT NO TIME AT ALL! And even that panel had 2 Reps and 1 Dem.

    At this point, I’d like to see a full pardon, too. Then Libby could be called to testify and he wouldn’t be able to hide behind the Fifth Amendment. Of course, he’s already a convicted perjurer, so how trustworthy his testimony might be is anybody’s guess…

    What was “too harsh” about it? The sentence of thirty months fit squarely within the federal sentencing guidelines for these crimes. Does the President think that the federal sentencing guidelines are “too harsh”? That would certainly be a switch from an administration that has spent six and a half years trying to toughen sentencing guidelines…

    And unfortunately I have to remind everyone that President Clinton was acquitted of perjury and obstruction of justice charges.

Just “saying” someone is “guilty” of a crime carries nowhere near the weight of Libby’s actual adjudication in a court of law by a jury of his peers.     The fact that even the jurors were wondering why Scooter was the sacrificial lamb makes you question the actual intensity of the investigation. I know Fitzgerald said that Scooter effectively “threw sand in the eyes of the umpire,” but if it was clear from the court testimony that he was covering up for Rove, et al, it certainly seems strange that Fitzgerald couldn’t find any other avenues for getting at the higher ups. I’d like to believe that Fitzgerald was one of the good guys, but something just seems wrong here. If so many people appear to have knowledge of the involvement of the White House, isn’t there some other way to get at it other than relying on the honesty of one clearly dishonest man? I will admit to being naive about the legal intricacies of this case, but it is alarming to me that this group can legally shield themselves from prosecution in this manner. Is there any recourse?

    Equally unlikely is the idea that Fitzgerald would want Scooter Libby to cooperate. For a prosecutor, trying to make a case based on the testimony of a convicted perjuror is akin to a would-be suitor showing up on a first date wearing a wedding ring: it creates serious credibility hurdles. As if that weren’t enough of a problem, Libby would be testifying as a cooperating witness regarding the very matters about which a jury has already found that he lied. As to those, Libby has made extensive prior statements chock-full of inconsistencies, fodder for days of devastating cross-examination. And then, to top it all off, there would be the pesky fact that Libby’s entire defense at trial was based on an attempt to prove that the man has a terrible memory. A convicted perjuror with a memory problem may be a great premise for a bad joke, but it is a terrible premise for a criminal case against the vice president of the United States.

    This post is about yet another sidestepping of justice he has committed. Gore is correct and this has no comparison to Clinton’s pardons. I can’t wait until KARMA serves up a dose of justice to these clowns. We’re taking from your own by supporting the antics of these people. Open your eyes! This doesn’t fare well for anyone and now that the onus is on “the administration” to answer for the crimes, we know that won’t happen and it opens the doors for white-collar criminals to just keep going with it. America is so full of intimidation and fear, we can’t even bring ourselves to oust this band of fools (as is our Constitutional right) and take our government and our country back. This is America and I am an American. The majority of us do not agree with what’s going on and yet we find neither voice nor courage to act and make them do what’s right for us. We have even become slaves to other countries and their resources, (as we import almost everything we live on because OUR farmers were put out of business) and we have the nerve to try and dictate to them on how they should be living and governing.

    What will happen when we wake up and have nothing (although the members of the-1%ers -upper echelon will have all they need and won’t share…bet me) and no means of support from our powers-that-be? I just hope they remember sidestepping the laws; there are a rack of political prisoners and purported terrorists that are going to trial…now they have their defense…they were doing what they were told.

These questions included whether President Bill Clinton lied in his testimony during her Whitewater trial, particularly when he denied any knowledge of an illegal $300,000 loan. During that trial, the government’s star witness, Arkansas banker and former municipal judge David Hale, claimed that then-Governor Bill Clinton had discussed an illegal $300,000 loan with himself and McDougal.

    McDougal received a full Presidential pardon from outgoing President Bill Clinton in the final hours of his presidency in 2001.

    Actually it isn’t relevant to actions taken as president, and McDougall has said that the Clintons weren’t guilty. She actually spent time in jail, and refused to lie for her release.     She didn’t have to lie – all she had to do was testify under oath. She refused to testify and therefore never rebutted anything. She was glad to say Clinton was innocent when she wasn’t under oath and got a pardon. Why was she afraid to say Clinton was innocent while under oath – maybe because it would have been perjury?

    Had Bush called for an independent counsel to investigate Libby? Fitz limited the scope of his investigation into Plamegate, while Starr expanded his to encompass twenty-year-old land deals, cabinet members’ mistresses, and sexual harrassment claims.

    You’re not really making a very strong case that the two are analgous.

    Vice President Gore is right Libby did have knowledge that could have posed a problem for this White House. There is a direct conflict of interest here for the president and the vice president. Bush commuted the sentence of someone who could have shed more light on the outing of covert CIA agent Valerie Plame. What President Clinton did was completely different. He never pardoned or commuted the sentence of anyone who was a former White House official. Because the Justice department was not consulted there are some legal questions here that must be addressed when the House Judiciary Committee Chairman Conyers takes up this critical issue. The president may have committed a crime if he tried to protect his own interests in commuting Libby’s sentence.

    You’re reading it wrong.

    Gore said activities that INVOLVE knowledge of what his superiors in the White House did.

    And that is 100 percent correct.

    Whether a crime was committed or not, Libby was charged, and convicted by a federal grand jury of blocking the federal prosecutors ability to DETERMINE if a crime had been committed.

    That is Libby’s crime.

    And whether or not a crime was committed, (which it was), Libby was sentenced to jail for obstructing justice by lying to a federal grand jury, which regardless of the RNC worms in here, was proven by a United States Federal Prosecutor to a Federal Grand Jury, and thats all there is too it.
