BREAKING: White House To Block Testimony Of Former Rove Aide

sara_taylor.jpgEarly last month, the Senate Judiciary Committee issued a subpoena to former Karl Rove aide and former Director of the White House Office of Political Affairs, Sara Taylor, for her involvement in the “unprecedented firings of several prosecutors and politicization within the Department of Justice.” Taylor — despite White House refusals to surrender documents related to her subpoena — agreed to testify before the Judiciary Committee as required on July 11, 2007.

Today, however, Taylor’s attorney W. Neil Eggleston, delivered a letter to Senate Judiciary Chairman Pat Leahy (D-VT) explaining that Taylor expects that the White House will attempt to block her testimony, citing executive privilege:

Ms. Taylor expects to receive a letter from [White House Counsel Fred] Fielding on behalf of the President directing her not to comply with the Senate’s subpoena. These contrary directions undoubtedly create a monumental clash between the executive and legislative branches of government. This clash may ultimately be resolved by the judicial branch.

[Taylor] is unquestionably loyal to and committed to the President and his agenda. …

Absent the direction from the White House, Ms. Taylor would testify without hesitation before the Senate Judiciary Committee. She has participated in no wrongdoing. She will assert no personal privileges.

[Taylor] faces two untenable choices. She can follow the President’s direction and face the possibility of a contempt sanction by the Senate, with enforcement through the criminal courts, an action that regardless of the outcome, will follow her for life. Or, she can attempt to work out an accommodation with the Senate, which will put her at odds with the President, a person whom she admires and for whom she has worked tirelessly for years.

In response, Leahy issued a statement:

The White House continues to try to have it both ways — to block Congress from talking with witnesses and accessing documents and other evidence while saying nothing improper occurred. I hope the White House stops this stonewalling and accepts my offer to negotiate a workable solution to the Committee’s oversight requests, as so many previous White Houses have.

    This whole thing stinks to high heaven. This is why people recently have been suggesting that perhaps the Supremem Court Justices are the ones that need to be impeached first. I am not sure the justification, but I understand the necessesity. The fix is in and they have seriously covered their backs and opened the door to doing WHATEVER THEY DAMN WELL PLEASE with absolutely NO consequence or accountability and they honestly believe at this point they are UNTOUCHABLE.
    This is a sad time for America. It is downhill from here if something doesn’t change quick.

    It seems to me that if she no longer works for the president, she is not obligated to follow his instructions in this, which would not be legally binding any way. The Senate subpoena, on the other hand, is VERY legally binding.

    IF she is smart, and IF she truly did nothing illegal, then she should testify, under oath, as scheduled. The president does not run the Legislative Branch. Not even Dick Cheney does that.

    Out of curiosity, I was just wondering if Cheney will try to exert his “role” as “President of the Senate” and order Leahy to stop the hearings? I doubt the Senate rules would allow him to do that.

    The Bush administration is going to claim executive privilege for every one who has ever worked in their White House, down to the janitor. I wouldn’t be surprised if they claimed executive privilege for anyone who ever worked in the White House, regardless of administration.

    Congress has to take this to court for any credibility at all, and they have to end this charade of “executive privilege” once and for all. The Supremes worry me, but I have to believe that Justice Kennedy would side with democracy over autocracy when it inevitably reached them. The four paleolithic judges are sure to support Bush/Cheney, of course, but I think Kennedy is a true “conservative” at least in regard to the separation of powers.

    I know a lot of people are not caring enough to read about current events or get involved in any way because they think these guys will eventually be replaced and then things will go back to “normal” again.     A point to consider: The adherence to law is neither qualitative nor qualitative; there is no continuum, there is either “you do or you do not.” The bushco has chosen not to adhere to the law hence they have broken the law. According to the Constitution the commission of a criminal act is grounds for impeachment. Why are the politicos fooling with these crooked bastards? There are sufficient grounds for impeachment because at this point it is “damned if they do or damned if they don’t.” Either they surrender the documents and be impeached for what they have done or they refuse to turn over the documents and be impeached for what they have not done.

    We need an impeachment to get this country on the correct track again. Whether the votes to convict are available in the Senate is beside the point. The thing to do is impeach starting with abu gonzo. There is enough evidence to impeach him, given his own words and those of the former aides. He doesn’t have to be charged with murder or theft in order to be impeached. I would agree to start with cheney instead.

    The only way to compel anyone in the White House to testify before the U.S. Senate will be to conduct impeachment hearings, which are justifiable because the warrantless wiretapping “program” is, by definition, illegal. I know that impeachment will fail because all the Republicans, plus Lieberman, will vote “not guilty,” no matter what information is uncovered. But the hearings can and should be held because it’s the only way to get the information the public deserves–not only on wiretapping, but also the firing of the U.S. attorneys, Plamegate, and Republican election fraud.

    I am still disappointed that you continue to block all attempts at impeaching anyone in this administration. All of us understand that when you said it was “off the table” (regret those words yet?), not enough evidence for impeachment had come forth. Now that the Congress is finally fulfilling its constitutional obligation for oversight of the Executive Branch (including the Vice President), there has been plenty of evidence that President Bush, Vice President Cheney, and Attorney General Alberto Gonzales have committed High Crimes and Misdemeanors. Your constitutional duty has never been more clear. These three men MUST be impeached.

    Start with Attorney General Gonzales. Then move on to Vice President Cheney. Then, finally, even if he’s the last one left in the Executive Branch, President Bush.

    Thank you. Among the many books I keep handy in our new computer room is one called “The Living U.S. Constitution”, Third Revised Edition, by Jacob W. Landynski and the late Saul K. Padover. I remembered there being something about the Nixon White House tapes case being in there. It was an 8-0 decision, with Rehnquist recusing himself because he worked in the White House before becoming a Supreme.

    Under the Constitution, the only role open to Cheney as “President of the Senate” is to break tie votes. He cannot order hearings to begin or stop. That doesn’t, of course, mean that he doesn’t use his influence with his supporters in the Senate in order to push or pull legislation, hearings, etc. Of course, he does that.

    Also, the President doesn’t have any legal “executive privilege” argument over someone who has left employment, unless there is classified information involved (national security). Taylor could testify, and should. If she doesn’t, she faces contempt of congress and criminal charges. She’s very young, and if she’s foolish enough to value her loyalty to Bush more than her own life, than frankly, she deserves whatever charges she runs into. I hope she has parents or someone older and wiser that can advise her that she listens to, for her own sake.

    What happens when you can’t pretend it isn’t happening any more, and these guys have changed everything for the very worse?

    I think this new development will be the impeachment straw which will break the camel’s back!

    How many times does it take to flagrantly obstruct justice before a formal “obstruction of justice” is the rationale for impeachment? Our constitution places the responsibility clearly in the hands of The People to remove from office any government which no longer represents them.

    If we’d impeached these two when we should have (when the new congress came into power), we wouldn’t be having this conversation right now.

    And neither would all of the recent damage have occurred. Two wrongs never made a right, Nancy Pelosi! Taking impeachment off the table in January HAD BETTER HAVE MEANT that impeachment was not on the table “at that time”…..but since then, of course, new developments and additional “articles of impeachment” are now obvious.

    The people will no longer tolerate this flagrant disrespect for the rule of law and the use of executive privilege to exonerate those further up the food chain who, clearly, are the ones responsible for the crimes.

    Like many Americans, I am disappointed with the direction that the Bush Administration has taken our country. The Administration has repeatedly misled Congress and the American public on issues critical to the safety and prosperity of our nation, such as using false intelligence to lead us into war in Iraq. At the same time, Congress over the last 6 years has failed to uphold its Constitutional duty to provide proper oversight of the Executive Branch.

    Yes, this administration has made some serious mistakes and has lost credibility with the American people, but impeachment should be used in only the rarest of cases. Only twice in the history of our nation has Congress carried out impeachment proceedings in attempts to move a President from office, and in both cases the President was acquitted. This country was founded on the principle that the democratic process is the best means of choosing leadership – and that is done through the American people and their right to vote. American voters recently expressed their desire for a change in leadership by voting a Democratic majority into Congress. We now have much important work that must be done for America and impeachment proceedings would consume most of the time, resources, and energy of Congress with little likelihood of success.

    As your Senator, I will continue to work with my colleagues to provide stronger oversight of this Administration. Since the 110th Congress began in January under Democratic leadership, already dozens of oversight hearings have been held on everything from the war in Iraq to the botched Federal response to the victims of Hurricane Katrina.

    I will keep your thoughts in mind as Congress continues its important oversight role. Please do not hesitate to contact me if I can be of any further assistance.

    Actually, all Nancy has to do is to say that she is putting Impeachment on the table for possible use in the future. As long as she declares it is off the table, Bush & Company are going to continue to thumb their noses at congress and “we the people”.

    I know the reason why the Democrats don’t want to impeach Bush. If they impeach Bush, then Chaney is our President. If they impeach Chaney then Bush is still our president and he will try to appoint a new VP. If they impeach both Bush and Chaney, some people (meaning the right wing talking heads) will say that the Democratic party is trying to make Nancy Pelosi president by impeaching the president and vice president.

    The problem is that people are now saying that the Democrats are once again acting like spineless wusses. So, which would be worse. Personally I would rather stand up for what is right (impeachment) and let the chips fall where they may.

    If the president is impeached he still has to be convicted in the Senate. So the House could impeach him but if not convicted in the Senate (it’s likely as the democrats don’t have the votes with a 51 majority), he would still serve out his term. If Cheney is impeached he would still face a trial in the Senate where again the democrats don’t have the votes to convict. He too would serve out his term. Impeachment would send a strong message. I wish the democrats would file articles of impeachment against Bush. They can start by investigating the Downing Street memo.

    I am totally disenchanted with your response, quoted below. I simply do not understand why you seem to be completely immobilized to take action to protect the Constitution of the United States, the ideological document and philosophy of governance that you swore to uphold!

    How can you sit by and say you’ll watch these felons more closely and not prosecute them for the treason and high crimes they’ve already committed? It’s not enough, Senator. They are trying to destroy this country. A discipline more befitting the crimes is demanded. It’s demanded by the Constitution. It’s demanded by the populace. It’s demanded by common sense.

    As a former prosecutor of persons committing felonies, especially those against women, I would have thought that you’d have actually responded with shock and horror at the manner in which these men have disgraced this country.     Senator McCaskill, you were once a respected attorney and prosecutor: if these violations do not constitute justifiable cause to raise the issue of impeachment, what do you think it would take???

    These two men are bound and determined to remove all the rights you and I have as guaranteed by the Constitution. The provisions of Patriot Act II have stripped you AND me of the right to habeas corpus, the lynchpin to all our remaining rights in the justice system. I doubt that Bush and Cheney and Rove will allow the mechanism of impeachment to survive IN THIS TERM! You will be sacrificing it sometime in the next 15 months for the sake of freedom and protection of same from terrorism.

    This Administration doesn’t need “stronger oversight”, they need to be removed from a position where they can further destroy this country and Congress needs to regroup in a non-partisan unity and have a backbone to protect this country from those who would abuse power for their own gain.

    I have been appalled for the last 7 years by what I perceived from the very eve of the election, that George Bush and Company were determined to ride roughshod over this Republic, without conscience or regard for rule of law and in defiance of the Constitution. I have tried, without much positive result, to point out to my representatives and my fellow citizens the gross flaunting of power and misuse of the Office of the Presidency by all who have his ear and his hand in their pockets. All the while, we have been fed a diet of lies, and lies about lies, and spin on spin, with spin on lies for dessert. What seems to have been unrecognized is that these short-order cooks have been spitting cyanide onto our food.

    My hope after the first four years of this unpalatable, poisonous menu, was that at least SOME of the minority who voted for Bush would see beyond the deep-fried breading and caramel coating to the lies and spin. That they would realize their savior, who seemed to have God on his IM buddy list, was not really interested in what the people of this country want and deemed most important to them, but that the Bush-Cheney covenants were but platitudes and false hopes in the form of promises foisted upon the gullible, the trusting, and the ignorant. I hoped that the GOP-framed issues would finally be revealed as nothing more than poison… but, George Lakoff was right: they couldn’t see past the elephant that they’d been told wasn’t there!

    I was shocked to see that a man whom I felt had betrayed this country’s founding fathers, its legislators, and its citizens, so defiantly in the first four years in office, forgetting and betraying the memory of the victims of September 11, would actually be offered another opportunity to rape and globally embarrass this Nation rather than be rendered impotent by impeachment and humiliated by imprisonment! I had been embarrassed by the herd behavior of the masses of individuals who would rather someone else make decisions about their futures and leap off the cliff the first time when they cast a vote for G W Bush. The second time I was on the verge of losing hope for the collective intellect in this country. Again, Professor Lakoff was right: the Anti-Christ Karl Rove trotted out another of his dirty tricks, stooping nearly to Hell itself to besmirch the honor of a thrice-decorated Purple Heart Vietnam veteran in order to install an AWOL, duty-skirting, privileged, silver-spoon, blue-blood bratty rich boy into the position of Commander-in-Chief and Leader of the Free World at a critical point in our history, deeply entrenched in (although not enough in his vengeful mind), an unjust war.

    One in which we were losing… soldiers, money, strategic resources, allies, respect, and honor.

    One in which Mr. Bush was losing support while an unrelenting Mr. Cheney perpetuated lies and spin about WMD.

    From the despairing, crushing moment that Bush was confirmed to have been re-elected in 2004, I have seen the arrogant flaunting of power was to be not just continued but expanded to further erode the Constitution and the Bill of Rights. Indeed, the loss alone of the right of habeas corpus is so appalling a development as to be ludicrous and FRIGHTENING, especially when one realizes that the excuse for the imperative basis to revoke this right was founded upon a hot, steaming pile of lies! George Lakoff was RIGHT!

    Ms. Pelosi, I believe we Americans have lost so many rights, that as I compose this message, I find myself worrying about speaking out against George W. Bush, his good-ole-boy cronies, and their policies. There are PATRIOTIC AMERICANS who have been prosecuted under The Patriot Act (there’s that framing again!) for simply exercising their right of freedom of expression. I don’t doubt that the volume of the outcry against the acts of these misguided miscreants has been muted by the fear of disproportionate McCarthy era-like police-state backlash. But my sincere desire to make my voice heard as guaranteed by the Constitution, as much as I want The Other George to be wrong, is going to be framed as treasonous treachery against the President, and whose policies and (lack of) ethics, I voted against… both times. I simply hope to be able to express my heartfelt, lucid concerns about how our great country is being herded toward The Great Abyss of Fascism (http://www.ellensplace.net/fascism.html) like so many rats by the Pied Piper.

    Yesterday, I was heartened, however, by one impassioned voice that eloquently, albeit despairingly, called for the last remaining avenue of rescue. Anchor Keith Olbermann of MSNBC, yesterday in an eloquent, emotion-laden Special Report, called publicly for George W. Bush and Dick Cheney to step down from office, pleading that they had some respect remaining for this country and its principles as they have promised in their oaths of office, as did Richard Nixon in 1974 in the aftermath of Watergate. I am heartened by Mr. Olbermann’s use of his personal, professional podium to place responsibility and accountability squarely on the shoulders of the President and Vice President whose promises to all of us have been so sadly discarded in their perilous pursuit of power. What we didn’t learn from Watergate, perhaps will be indelibly etched into the collective memory of every American in perpetuity, assuming that America as we know it lasts to get us to November 2008. Will we have to remember this in secrecy, without hope of another election?

    Should Mssrs. Bush and Cheney refuse to responsibly resign, I am depending upon you, Speaker Pelosi, to demand that Congress force accountability on those responsible for every disgraceful and illegal and treasonous action, every exposed CIA operative, every lie, every dead US service person, every dead ally mislead to support an unjustified war, every dead Afghani and Iraqi non-combatant, every tear of grief unjustifiably shed by the families of the dead, every unmasked snicker of Presidential disdain, every day of undeserved detention served by a habeas corpus-denied “terror suspect” and every act of torture applied “in the Name of The Father”. Let not Justice be again obstructed by a petulant President.

    Please don’t fail to consider that the 2006 Elections that gave you and your esteemed colleagues a more significant majority than that claimed by Mr. Bush, also defines a more powerful, more durable mandate to follow the Will of We, The People, to impeach Bush and Cheney.     The Chief Wiggum thing was a Simpsons reference and it pretty much happened the way I wrote it. Very funny at the time. Location joke. You had to be there.

    And as far as baseball goes, all you need to know is that the Infield Fly Rule is meant to protect the baserunners, not the fielders.

    You know, frankly I would love to know what these guys represent. They don’t represent me or my values or beliefs. They don’t represent my country. They don’t represent the good of the country, any of it’s citizens (except for a few handfuls), or the good of the world. They don’t represent democracy or freedom for all. They don’t represent the good of the planet. They spout Christian values, but do ntohing real to reflect what that really means. I mean, really, what DO they represent other than corruption, greed, secrecy, lies and manipulation, and their corporate friends? Words don’t mean much unless you back it up with actions. All their actions to date are a contradiction and they have demonstrated nothing but hypocrisy and lies.

    Just kidding, I know what you meant. What in particular is it that they don’t want found out? I do believe that they fear that any investigation by Congress will stumble across something that could lead to “the big secret(s)”. So they try to block anything from being investigated not because of some ideological stance on the separation of powers, but because they don’t want their illegal activites exposed. At least, they are certainly behaving as if that were exactly the reson for it.

I have friends who were so exited to be moving to San Fransisco, and to have you as their representative, but now, even they aren’t sure where you are coming from. A majority of the country wants impeachment BACK on the table, at least for (Vice) President Cheney. Do you need me to forward the absolutely RIDICULOUS amount of evidence that supports this call to action? I just don’t understand how you can claim to be for Democracy asnd Freedom, yet you are HURTING AMERICA by allowing this regime to run this country! A wise man once said(paraphrasing) that through INaction, you are just as guilty as those who perpetrated the crime. America will not forget that YOU let these thieves continue to ruin this once great country. YOU are the one who sat idly by and let them destroy America. YOU are the one who will not be back as Speaker of the House if you don’t actually take some action against the incredible amount of damage done to our Democracy and our country each and every day this cabal is still in power.
    They are NOT going to “play nice”.
    They are NOT going to turn over documents.
    They are NOT going to let anyone who is employed by or has EVER worked at the White House EVER testify(which I thought wasn’t legal in and of itself. I thought Executive Priveledge only applied to current employees. Not the janitor who worked at the White House in 2004.
    Please. PLEASE. Listen to America. DO NOT fail us, or YOU will become labeled as weak. We(Americans) want to support you, but you make it so hard, so very hard, for us to back what you say when you don’t listen to what America says it wants. You claim to be working for America, so prove it. PUT IMPEACHMENT BACK ON THE TABLE, or you may find yourself filling a new(and lesser) role in the House of Representatives. This is NOT to be construed as a threat in any way, this is just the truth. America is sick, you hold the cure in your hands, and you wont use the medicine.

    This whole thing stinks to high heaven. This is why people recently have been suggesting that perhaps the Supremem Court Justices are the ones that need to be impeached first. I am not sure the justification, but I understand the necessesity. The fix is in and they have seriously covered their backs and opened the door to doing WHATEVER THEY DAMN WELL PLEASE with absolutely NO consequence or accountability and they honestly believe at this point they are UNTOUCHABLE.
    This is a sad time for America. It is downhill from here if something doesn’t change quick.
