Breaking: Judge dismisses Plame’s civil suit.

The AP reports:

A federal judge on Thursday dismissed former CIA operative Valerie Plame’s lawsuit against members of the Bush administration in the CIA leak scandal.

Plame, the wife of former Ambassador Joseph Wilson, had accused Vice President Dick Cheney and others of conspiring to leak her identity in 2003. Plame said that violated her privacy rights and was illegal retribution for her husband’s criticism of the administration.

UPDATE II: Flashback — Judge John D. Bates, the judge who dismissed today’s suit, also dismissed the lawsuit over Dick Cheney’s energy task force records:

Judge John D. Bates of Federal District Court found that Comptroller General David M. Walker, the head of the General Accounting Office, did not have sufficient standing to sue the vice president.

Mr. Walker had asked the judge to order the White House to reveal the identities of industry executives who helped the administration develop its energy policy last year.

In declining to do so, and in dismissing Mr. Walker’s suit, Judge Bates said that granting the G.A.O. chief’s request “would fly in the face of the restricted role of the federal courts under the Constitution.”

UPDATE III: In a statement, Melanie Sloan, legal counsel for the Wilsons, promised to appeal the dismissal:

“While we are obviously very disappointed by today’s decision, we have always expected that this case would ultimately be decided by a higher court. We disagree with the court’s holding and intend to pursue this case vigorously to protect all Americans from vindictive government officials who abuse their power for their own political ends.”

    After reading the decision it still appears there is a viable case, but that administrative remedies need to go forward first. This judge wrote a good brief and it would appear that he makes a case for the plaintiffs, just not in his court...yet.

Anybody who actually researched a bit on this issue knows this is not the end, and the judge even commented on the behavior of the administration in a negative light. None of us can read his mind but this is less likely a conservative base decision (like SCOTUS did last week) and more a conservative (as in cautious) ruling. This is not the end of this issue.

    Let us demand that this judge is removed for conspiracy to obstruct justice. it is clearly having a problem with recusal in the face of serious obstacles to fair and impartial judicial practice. It is also in a position to refuse to rule based on the matter being one that could result in a constitutional crisis of his own making. This judge appears to be making this decision.
    Any of these are not enough on their own to question the actions of a judge, but the combination of factors weighs heavily on the future of this country and the ability for impartiality. It certainly appears to the people that this jurist is attempting to quash actual justice behind a ruse. If this was but an attempt by Ms. Wilson's attorney to put this before the public, fine. That is their right. But in the face of the overwhelming evidence that this is treason, the judge has crossed the line.

    Since our legal system is run by a criminal now, this one is seen as assisting both the disgraced AG and the VP. Both of which have admitted to felonies, both of which are hiding thousands of examples of felonies, including treason, and giving comfort to the enemy in a war zone, and in time of war internationally, and war profiteering, to mention a very few. Internationally, there will be war crimes to add to this.

    I would ask Judge John D. Bates to resign; You are now a potential cause of anarchy in our society due to a visible violation of the public trust. I would ask for a recall proceedings for this jurist now.

    It is time for us to list the appointees of a criminal enterprise that with such exposure will shake the foundations of the world. Being blind to it is now excuse any longer. That is the argument that the nazi's used to shield themselves for the murder of millions. Every one of the appointed and approved positions granted by this president must be recalled so that we can determine if there has been malfeasance in the appointment and the activity of persons not qualified for the job. It is just a part of the impeachment process.

    Yes, a crime was committed. I thought conservatives were supposed to respect the rule of law.

    You know, I saw this too, and I looked upt he FTCA (Federal Tort Claims Act) to see what it was all about.

    comprehensive legislative scheme by which the United States has waived its sovereign immunity to allow civil suits for actions arising out of negligent acts of agents of the United States. The United States cannot be sued in a tort action unless it is clear that Congress has waived the government's sovereign immunity and authorized suit under the FTCA.

    So, essentially, Congress has to waive immunity and then they can be sued. But if that's the case, the case should have been thrown out long ago and/or Palme's lawyers should have already gotten the waiver? It seems that if Palme DID get the waiver, then Bates statement about lack of jurisdiction is all crap.

    Treason is involved as has been commented by others, though it is not directly mentioned in this particular Valerie Plame case according to at least some legal perspectives. Valerie Plames Attorney is right in further pursuit of this case such as building on the case of Treason guilt by Vice President Cheney recorded in recent previous news at NewsWhiteHouse.com. The fact is, as at the top of this Think Progress page shows, many lower courts wrongly focus on how laws pertain to their jurisdictions rather than on the higher principles, such as checks and balances, the higher reason for the Judicial Branch in the first place: Instead of detracting from the Libby case guilt and similar, it is the duty of the Judicial Branch to pursue: High crimes rather than less significant. The Judicial Branch is to pursue even such as after the Libby pardon, to find the extent of corruption given far more than a good lead from reliable sources.

    I take objection to one comment, that Bush is a "punk." I don't see how anyone could think that he belives in the punk ideology, anti-government control and pacifism in general, and I doubt very much he likes the music.

    I will state something more important here though:
    Lots of comments, but why doesn't any focus on "the law." Political arguments are fine, but a judge has to follow the law and that includes the Constitution. There may in fact be no remedy under the US Constitution - and that the judge so found, doesn't mean that he is biased or mean.
