White House seeks legal cover from Gonzales.»

The New York Times reports that the White House is confidently asserting that any attempts by Congress to hold White House staffers in contempt will be stymied by Alberto Gonzales’ Justice Department:

“The Justice Department would be likely to block any efforts by Congressional Democrats to seek contempt charges against present and former White House officials for refusing to give information to Congress, a White House spokesman said Friday. […]

A White House spokesman, Tony Fratto, said Congressional threats to have presidential aides charged with criminal contempt would probably end in failure. “It has been the Justice Department’s long-held view that the law does not permit Congress to require a U.S. attorney to convene a grand jury or otherwise pursue a prosecution” when someone refuses on the basis of executive privilege to testify or turn over documents, Mr. Fratto said.”

    There is another course of action available to Congress. Every US Attorney that was confirmed by the Senate (or appointed via bypassing Senate confirmation) CAN BE IMPEACHED.

    It would seem to me that a US Attorney who refuses to press charges for contempt of Congress could be found to have committed a high crime or misdemeanor.

    In other words, Congress can “fire” US Attorneys until someone steps forward and chooses to uphold the rule of law.

    16 - not banned, just busy. Did my first settlement negotiations last Friday. Got nearly $60k for a part-time employee whose termination was “questionable” to say the least. I’m going to like private practice.

    But I am posting less frequently for other reasons:

    1. the trolls are boring and tedious. Although their names change, their style and message stays the same. And ThinkProgress has done precious little to address the problem.

    2. ThinkProgress deletes posts that hit too close to some truths. Including posts of mine. And that’s a shame. It’s as if they’re trying to force “progress” into their preconceived notion of where it should flow.

    I scan the threads when I am able. Mainly for posts like Ace’s which include links I would not otherwise find.

    Yes, but the Bush administration doesn’t get the last word on this. Congress can go to court to force the Justice Department to act. This is a rather radical reading of the Constitution by the Bush administration and it’s not at all clear that the Supreme Court would let this stand.

    Obviously, we need to go with inherent contempt here.

    It’s certainly an option and Congress has already threatened it in a letter to Fielding, the President’s attorney.

    Granted, Bush can still issue pardons to his convicted staffers, even as they are hauled off to jail.

    Actually, it’s not at all clear that he can. In “inherent contempt,” Congress is itself the court and it would be responsible for imprisoning those it holds in contempt. Given the separation of powers, I don’t think that Bush has the authority to release staffers that Congress has imprisoned in its execution of its oversight duties. As far as I know, this has never been adjudicated.

    One point of interest: since this is specifically a Congressional action, Congress probably does not have the power to hold such a prisoner beyond the term of the Congress, particularly if the House holds these proceedings. That means whomever they hold would be freed when the current Congress shuts down in December of next year.

    A bit.

    Are we hijacking this thread?

    Our first musical, a melodrama, had a song in the second act that wove in and out for over 7 minutes, and the audience loved it. (It took me 2 months to write the lyrics, and it took the Mrs. 2 weeks to set them to music. go figure.) That’s when I decided to have a go at a Gilbert and Sullivan style operetta.

    The lyrics above really flowed quickly, but I got bogged down with a scene where the ship’s captain gives orders and it turns into a fugue, with the orders mutating into a drinking song as they are passed from one sailor to another. I’ve got the 1st draft knocked out at 47 pages, which is an hour and a half show. I’m half-way through the re-write. I figured out the fugue (think Bach), and the next big challenge is the sextet in the second act (think Mozart); 3 couples all singing about love, but in the San Francisco fog, they’re not singing to whom they think they are singing to.

    Dear Old America, Thanks for all those interesting years, it sure was a fun ride. It’s too bad you have to go.

    Remember back in 1776 when you declared yourself “independent” from the UK? That was classic! You guys even set up a constitution to protect the rights that your fathers, sons, and brothers died for! That sure took some balls. Freedom of speech? A free press? Are you nuts?! Letting citizens carry guns? To protect themselves from the government?! Radical! I won’t even go into the ones regarding how laws are passed and enforced. Absolutely hilarious!

    Old America, you were the most popular kid on the playground and everybody wanted to be like you, act like you and live like you. Ahh, those were the days.

    You guys were really something, Old America, it’s a shame it had to end like this. Some of the men who created that old system of government might not agree, but I think things might turn out okay for us here in New America. I mean sure, there won’t be any more elections, but who ever voted anyway? The crackpots? And did you really want to “peaceably assemble”? Sounds like some hippy shit to me!

    Listen, just forget about the Constitution. Life goes on. The corporations will make sure that we’re happy. Congress will still be around to make sure that the peoples business gets taken care of, a “Ronald Reagan” highway, Post Office and elementary school in every town!

    There are a lot of nay-sayers around the world that whine about militarism and globalism and other “isms”. The only ism I’m worried about is terror-ism! That’s why the government needs to be consolidated into an executive branch, get it? Wouldn’t you rather have security than freedom?

    New Americans have it all figured out and luckily we have President Bush to guide us.. He knows what to do to those god-damned terrorists! Keep bombing! We’re bound to kill them all eventually. He knows how to deal with activist judges, override their sentences! Soon we’ll see the New America emerging, the new and improved America that isn’t afraid to take away freedom if it means increased profits or security. The New America that stands up to its enemies by torturing them until they confess or until they die. Either way, New America wins! Our private armies will do whatever we want (as long as we pay them) and we get to keep our hands nice and clean. It’s all wrapped up in a neat little bow, all you have to do is accept it.

    Alan, we’re already very afraid, and a lot of us cannot wait until January ‘09. Bush, Cheney and Gonzales must be impeached. The rest of the world fears and despises this administration; if we American citizens just wait for the elections, we will be despised, too.

    Here are a few things Congress has been doing lately. If you didn’t know about, it’s probably because the media doesn’t much report it (makes the Democrats look good):

    House passes the College Cost Reduction Act, which “would boost college financial aid by about $18 billion over the next five years and cut federal subsidies to lenders,” the “single largest increase in college aid since the GI bill in 1944.”

    Today House Oversight Committee Chairman Henry Waxman (D-CA) wrote to Health and Human Services Secretary Mike Leavitt requesting documents related to political interference with the work of the Office of the Surgeon General.

    Sens. Leahy and Specter introduce amendment restoring the habeas corpus protections stripped as a result of last year’s Military Commissions Act. The legislation would restore basic civil liberties to roughly 12 million legal permanent residents of the United States.

    House Judiciary Committee Chairman John Conyers is “expected to move swiftly to conduct hearings on the commutation.”

    Democrats Consider Plan to Cut Funding for Guantanamo Bay Prison, Forcing Its Closure
    SENATE SUBPOENAS WHITE HOUSE, VP’S OFFICE
    House Judiciary Committee To Hold Hearings On Bush Clemency Powers
    Reacting to the Office of the Vice President’s assertion that it is not an “entity within the executive branch,” Rep. Rahm Emanuel (D-IL) announced that he will introduce an amendment to cut off funding to Cheney’s office.

    Senate Judiciary Committee announced it was preparing to approve legislation to restore habeas corpus on Thursday.
    House oversight committee is expanding its investigation “into ties between jailed GOP lobbyist Jack Abramoff and the White House.

    Since there is a longstanding precedent of Congress physically arresting those who are in Contempt of Congress, I think Reid and Pelosi should send a couple shockwaves over to the White House by hiring a few well trained Policeman and deputizing them as “Sargeant at Arms” for the purpose of arresting the contemptuous Bush officials who are breaking the law.

    Get real and get your priorities straight. Both parties are avoiding legal confrontation with the thugs in our White House.

    Just utterly ridiculous. Democracy may not be dead in America, but it’s definitely on life-support. Americans don’t understand what democracy is all about, and thus they balk at seizing power back from their corrupt government. The apathy will be our downfall.
