Last week, Congress caved to White House pressure, passing an expansion of the Foreign Intelligence Surveillance Act (FISA) that moved the administration’s warrantless wiretapping program “out from under any real legal restrictions. Before the vote, House Minority Leader John Boehner revealed a secret opinion by the FISA court that declared part of the administration’s program illegal was central to rush to reform the law. The Washington Post adds more details today about the fight over the law, including the revelation that there were actually two court rulings against the program:
But in a secret ruling in March, a judge on a special court empowered to review the government’s electronic snooping challenged for the first time the government’s ability to collect data from such wires even when they came from foreign terrorist targets. In May, a judge on the same court went further, telling the administration flatly that the law’s wording required the government to get a warrant whenever a fixed wire is involved. [...]
The rulings — which were not disclosed publicly until the congressional debate this month — represented an unusual rift between the court and the U.S. intelligence community. They led top intelligence officials to conclude, a senior official said, that “you can’t tell what this court is going to do” and helped provoke the White House to insist that Congress essentially strip the court of any jurisdiction over U.S. surveillance of communications between foreigners.
Those darned "activist judges"! What the heck are they trying to do? Apply the Constitution to the actions of the Executive Branch or something?
August 12th, 2007 at 2:39 pmIndeed, what is the US coming to when a Court full of lawyers trained in the law, and one that rarely if ever says no to any government request, says no not once but twice over something that is well clearly illegal? The nerve.
I must say, I thank the Democrats for coming to W's resuce and keeping us safe. As I'm sure they remember, W always thought being a dictator would be easier than being president, especially if he's the dictator. With just a little more help from our fearless Democratic leadership, he'll get his wish. Seems all we'll be left with is the 'unitary executive.'
Welcome to the new land of the not so free, home of the not so brave.
August 12th, 2007 at 2:43 pmNo. 2, so when you're phone is tapped by the next administration (or the one after that) and your life turned upside down, don't cry about it. That's so what. You reap what you sow and right now what y'all are planting ain't going to go down smooth. Get to sucking.
August 12th, 2007 at 2:47 pmGood post, po. I think the Democrats want to make sure that GDumbya has enough rope to hang himself. I would expect that the excesses of his administration will quickly be remedied after he is back in Crawford (or Paraguay) for good.
Now that this little squabble is behind them, I hope that Congress will return to the issue of GDumbya's dirty little war in Iraq next month. It is time to bring our troops home.
After they're done with that, Congress can take up the matter of impeaching Darth Cheney and GDumbya. After all, somebody has to do the people's business -- we sure can't expect it to be this presi-dunce or his VP.

"People who have never read the Act keep spreading the rumor that it allows Alberto Gonzales to listen in on all electronic communications without a warrant. That is simply not true. Virtually everyone, left or right, who has read the law will confirm this point."

August 12th, 2007 at 3:16 pmWith their shocking surrender over President Bush's draconian new FISA law, Congressional Democrats snatched defeat from the jaws of victory. They not only had the votes to safeguard American civil liberties and prevent the legalization of past Bush White House criminality. On FISA as we knew it before August 5, 2007, Democrats had the law - and public opinion - on their side.

And the fearful men constructed a wall, high and thick, reinforced with steel above and below ground, Safe they said! Then they put cameras on every corner and in every room to be safe they said. And then they said we must be less free in our safe area and created free speech zones. Safe they cried Safe! But still they had fear of a few men, even though they had nuclear weapons and the finest equipment, so they tapped the phones and rifled thru the mail.
Still we are not safe enough they cried in panic! The built a dome, high and strong with radar guided missiles and lasers. We are nearly safe! They got rid of cars for they crashed and were unsafe, they got rid of planes for they existed in a bubble. They outlawed unsafe cigarettes. They outlawed liquor, for it was unsafe. They outlawed birds, cats and dogs for they could possibly carry unsafe disease.
And when they finished their safe world and finally felt safe from all that might possibly harm them. They looked around and they cried.

That would be liberals - without "liberal" unions, there would be no middle class, and without "liberal" health and safety laws, employers would treat workers as no more than extensions of the tools they use, and just as disposable - ignoring the fact that it is the workers who keep their profit margins so high by their labors, and their ingenuity.

Liberalism is about freedom, the freedom to question, the freedom to think, and the freedom to tell your government what you want of it.
Neocons on the other hand are about repression, depression and all around opression. They are about repressing dissenting views, depressing the economy and opressing the intellegent.

The vast majority of people are unaligned. They just don't think about politics in a real, concrete way.
This is in part because of a successful movement to make politics a taboo subject of discussion, much like Religion is a taboo subject (If to a lesser extent.)
For 20 years, Americans have been fed the line that all sources of communication have a liberal bias.
Another, tactic has been the "Missing white girl" or "Rich white girl in trouble" tactic of trivialising the news with stuff nobody cares about.
Both tactics are designed to turn people away from ready sources of information. No question as to why academics who study history, sociology or any other subject which has an impact on human behaviour vote along liberal lines, because ultimately, the answers are not attractive for the conservative movement.
The fact is that even Conservatisms heroes, were bad presidents. While the worst president the Democrats elected was Jimmy Carter, about the best the rightwing elected was Ronald Reagan.
Jimmy Carter's major positive move was averting a disaster on 3-Mile Island. Ronald Reagan's major success, was happening to be the guy in power when Communism ultimately collapsed. The former was an indication of administrative ability, the latter was a quirk of historic timing.

They aren't actually neoliberal under the classical sense either. Neoliberalism is basically true libertarianism, it holds that government should interfere with the free market, and should minimise its interference in society in general.
The neoliberal movement, could best be described as the economists' version of the anarchist movement. They work out to being about the same pipe dream.
The Neocon movement on the other hand, while publically voicing support of a free market, also call for massive government intervention in people's private lives, the elimination of free speech, the weakening of social freedoms and the promotion of a state religion (Namely whatever brand of Christianity they themselves follow.)
They are much closer to the classical fascist movement then the neoliberal movement.

Suppose everyone had just followed his lead? Then people wouldn't have been panicking so much. The towers could have just fallen and burned up and people could have went on with their normal daily routines unencumbered by all the commotion. Later that night street sweepers could have went in and cleanred up the mess and we could have went on with our lives without everyone worrying about the people in the towers or the pentagon. August 12th, 2007 at 5:12 pm"The Constitution is not a suicide pact"
- Lincoln
Baloney:
"The Constitution is not a suicide pact" is a rhetorical phrase in American political and legal discourse. The phrase expresses the belief that constitutional restrictions on governmental power must give way to urgent practical needs. It is most often attributed to Abraham Lincoln, as a response to charges that he was violating the United States Constitution by suspending habeas corpus during the American Civil War. Although the phrase echoes statements made by Lincoln, and although the sentiment has been enunciated several other times in American history, the precise phrase "suicide pact" was first used by Justice Robert H. Jackson in his dissenting opinion in Terminiello v. Chicago, a 1949 free speech case decided by the U.S. Supreme Court.
August 12th, 2007 at 5:15 pmBarfly, in your comment ( Comment by barfly — August 12, 2007 ) you postted some interesting information.
However, you're missing the point -- which I'm not agreeing with or disagreeing with: Your response doesn't refute that the Constitution is or isn't a suicide pact. All you've done is quoted where it was first used; and hoped some conclude something. I'll ask directly: What is the basis for your sayign that the Constitution is "not a suicide pact"?
It doesn't matter whether the phrase started; what matters is whether your argument today -- about what is being said to day -- does or doesn't add up. Right now, you haven't argued anything. I welcome an argument, not an assertion. Thank you.
August 12th, 2007 at 5:19 pmThe Bill of Rights is sacred and any attempt to change or violate it are against the law. That is what our founding fathers would want.

August 12th, 2007 at 5:26 pmI've been posting on TP almost since its inception and the amount of trolling has become enormous. Suggestions of "don't feed the trolls" or "counter their posts with facts" no longer work because they are not here to engage in meaningful discourse. The only purpose they serve is to spew their hatred and draw the conversation off topic. We can cite all the "facts" we want but it means nothing to a troll like CTv2 or LTK since they don't come here to present an opposite point of view. By reading their posts, you only come away with the impression that they are here only to flood the thread with comments which are meant to draw a reaction from legitimate posters. Otherwise, the content of their posts add little to the conversation.

TP has now degenerated into a troll cesspool and all of the intelligent bloggers have gone to C& L, Smirking Chimp, etc. They have registration there and oversight by real thread monitors. This blog has become a bastardized version of itself and I would agree that it appears to be more like a hate blog by demented psychopaths and sociopaths than sane, intelligent people. Anyone perusing the threads and witnessing the likes of the twisted, sick conversation ongoing here at TP would be immediately repulsed. The regulars are spending their time on other blog sites. All that's left is the angry, hate-filled, bullshit spewing, psychologically deranged morons spewing their drivel.
Most of it doesn't even make sense; that is, unless you also share a psychiatric illness. Sick - very sick individuals.
Adios, MF Trolls. Anyone can see that you're talking either to yourself (one posting as many) or that you're working in tandem. You could be on the RNC payroll because you're not intelligent enough for KKKarl.

Liberals are trying to protect the rights of innocent Americans from being spied on by their conservative government. Americans are being spied on without warrants or Congressional oversight.
August 12th, 2007 at 6:27 pmRepublicans don't believe in government that is why they are always working to destroy, corrupt, or underfund institutions then sit back and say "see look I told you so." What did Reagan say the most frightening words are "I'm from the government on I'm here to help." Republicans have held the presidency for 28 of the last 40 years if you do not like the current state of things blame the Republican party they have been the ones at the helm the only two democratic presidents in that time were Carter and Clinton.
August 12th, 2007 at 6:35 pmBush wants to spread "liberty" in the Middle East and Iraq. Liberty comes from the word liberal. Ironically Bush wants to spread "democracy" is it because he admires the "democratic" party? There is much to admire in liberalism and the democratic party.
August 12th, 2007 at 7:07 pmIsn't secrecy great?!?!?!
And all because BushCo didn't want to follow the law and get a FISA court-approved warrant...because the "decider" doesn't want anyone telling him what he can or can't do.
This Protect America Act now enters into the annals of American history alongside other BushCo-demanded legilation with pretty names, that really gut the protections of American citizens.
And the minority mad-dog Blue Dog Democrats, in siding with the "culture of corruption" rubber-stamp Republicans, allowed this blindsiding of our democracy to occur.
BushCo has politicized everything. So what makes anyone think that this Protect America Act will be any different?
Unchecked and unlimited spying authority, given to Gonzales (DOJ) and McConnell (DNI), while circumventing the FISA court.....why, we're watching the return of Richard Nixon and his administration's using all of our intelligence agencies to spy on all American citizens on Nixon's "enemies list."
Hopefully, these mad-dog Blue Dog Democrats will wake-up in the next six months. Otherwise, they'll not be welcome for much longer in the resurgent progressive liberal Democratic Party. Oh, right, they'll just pull a Lieberman, and become "independent," or switch completely to the "culture of corruption" Republican Party. I wonder what the odds in Las Vegas are on this?
August 12th, 2007 at 7:55 pmBush is trying to supposedly protect Americans by spying on them. He is violating our constitutional rights. This fight is not over. This bill will be overruled in the courts.
August 12th, 2007 at 8:17 pmi don't know what to do. everyone gets so mad if you want to vote for a third party, but the democrats constantly fail to stop the president. i don't think i'm going to vote anymore and i may move to europe.

For a bunch of chest puffing he-men they sure are scared of some religious extremists who don't even have a country to call their own. They want an authority figure to be submissive too like good little lemmings.
Limbaugh and Coulter are not crazy, but they are smart enough to fill the nuts with rhetoric and take their money
August 12th, 2007 at 9:34 pmThe religious extremists or Fundamentalists we need fear the most are not in the Middle-East, they are right here in the good ole USA. It was two (or more), down home apple pie eating, flag waving, ex-military, right-wing Christian red blooded American boys who blew up the Federal building in Oklahoma. Not Muslims, not the commies.
Add to that the number of family couseling clinics, doctors, nurses, and other innocent victims of bombings, shootings, and other assorted violent assults again, from right-wing religious extremists wrapped in the Stars and Stripes.
