Jose Padilla, a U.S. citizen who had been arrested in 2002 as an enemy combatant, has been found guilty in a Miami court on all charges of supporting terrorism. The Washington Post wrote that the administration’s detention of him had been “bruising to liberty.” The Bush administration had claimed that Padilla, who was held in a military brig for more than 3 years, could be detained indefinitely and without access to a lawyer. Ultimately, the federal courts forced the administration to provide Padilla access to the courts. The verdict today affirms the merits of a judicial system that provides both due process and due punishment. Padilla’s attorneys are expected to appeal.

The question of Padilla’s innocence or guilt on a much lesser charge is therefore less salient than the way in which he was treated by the government. That remains a travesty; and the government should be relieved its clumsy handling of the case did not lead to his acquittal.
It is also important to recall that Jose Padilla was interrogated in a fashion to render his mental capacity to stand trial a question. He claimed torture, and was sequestered without being charged for three years in solitary confinement. The result was a broken man, according to Time magazine.

Does anyone remember the Rosenbergs or even care about that case was the Trial of the Century. Wrong. Just because I cherish the rights guaranteed American citizens does not mean I support terrorists running around free. I just support their right to a fair trial, and I support the preservation of the constitution. That said, Padilla was convicted of supporting terrorism. And for that, he deserves to be put away.

Instead, its non-Arabic speaking “experts” talked about hundreds of thousands of Arabic language communications, a few dozen of which might have included Padilla’s name in an attempt to make Padilla guilty by association. The govt changed its claims against Padilla whenever a federal court seemed likely to find its claims laughable and/or extra-constitutional.
Mr. Padilla may not be likable, he may have committed crimes and may have deserved jail time. He didn’t deserve to lose his mind, or his civil rights, or to be tossed into a law- and stimulus-free solitary confinement in order to break them. Not to get information, which would be unreliable, but to break them.
Cheney seems caught in a junior high schoolish game of “mine’s bigger”. Like a fake conscientious objector (or one with multiple deferments) years after his war, he needs to demonstrate that despite he’s a manly warrior. To show that his Washington monument is bigger than any mosque’s tower. What’s been lost is not just Padilla’s civil rights, but ours too, because doing it a second time is always easier.
