DNI McConnell: ‘Americans Are Going To Die’ If We Keep Talking About Wiretapping

mcconnell1222.jpgEarlier this month, Congress caved to President Bush and passed legislation updating the Foreign Intelligence Surveillance Act, vastly expanding Bush’s powers to wiretap American citizens without court oversight. In an extensive interview with the El Paso Times, National Intelligence Director Mike McConnell decried continued public discussion of the wiretapping program, claiming Americans, particularly in Iraq, would “die” because of the debate.

Q: So you’re saying that the reporting and the debate in Congress means that some Americans are going to die?

McCONNELL: That’s what I mean. Because we have made it so public. We used to do these things very differently

Despite forewarning of the death of Americans, McConnell freely “pulled the curtain back” on previously declassified information about surveillance in the interview. Explaining details ranging from secret court rulings to information on obtaining wiretapping warrants, McConnell “raised eyebrows” for his “frank discussion of previously classified eavesdropping work” conducted under FISA.

Some highlights of McConnell’s revelations:

Court ruling declared Bush’s program illegal on May 31: “After the 31st of May we were in extremis because now we have significantly less capability” when a federal court ruled part of the wiretapping program illegal, McConnell said.

Private sector actively involved in wiretapping program: “Under the president’s program, the terrorist surveillance program, the private sector had assisted us,” said McConnell. “Now if you play out the suits at the value they’re claimed, it would bankrupt these companies,” McConnell said, arguing for legal immunity for the companies when Congress returns from recess.

McConnell denies White House involvement: “The president’s guidance to me early in the process, was, ‘You’ve got the experience. I trust your judgement. You make the right call. There’s no pressure from anybody here,” McConnell claimed.

Thousands overseas are being monitored via warrants. “Offering never-disclosed figures, McConnell also revealed that fewer than 100 people inside the United States are monitored under FISA warrants. However, he said, thousands of people overseas are monitored,” states the AP.

Takes 200 hours to assemble a wiretapping warrant:
McConnell alleged that “the issue is volume and time” as to why he was so adamant about pursuing warrantless wiretapping. “My argument was that the intelligence community should not be restricted. … It takes about 200 man hours to do one telephone number.”

Rep. Pete Hoekstra (R-MI) said he believes McConnell declassified the information in this interview because he “wanted to push back on accusations that the legislation gave the attorney general unprecedented new powers.” “I think they felt they had to become more public,” said Hoekstra.

The Bush administration seems to believe it is permissible to talk about illegal wiretapping to save face, but not okay for Americans to question them about it.

    For the life of me I can’t understand how our government can’t figure out who the terrorists are when they had three days to wiretap without a warrant before the law was changed. If they can’t find them in the three days, or go to a court and convince the court that they have actionable data, then they are never going to be able to find terrorists.

    The only reason why they wanted the law changed is because they don’t want anyone to know who they are wiretapping. Why is that?

If the progtarded terror-abetters here don’t take the word of McConnell (who knows a hell of a lot more about threats to the US than the libs), then the progs are on record for believing that they think the US government is a bigger threat to their safety than terrorists.

    I don’t understand the logic. All the Bush administration has ever needed to do was to obey the law. The law said they could tap for 72 hours before getting a FISA court order. In over 5 years the FISA court has turned down exactly 1 request (the last count I saw). I have never heard a logical reason why this arrangement is cumbersome and unworkable. It is clear cut, logical and forgiving. What more do they need.

    Two points:

    1. McConnell’s claim that the program is “surgical” — which really deserves to be a highlight — focuses only on voice and not on data (ie, mail, web site traffic, blogs, public records). This deliberate conflation has been a central feature of trad press coverage on this issue, and we shouldn’t fall for it. Taken as a whole, the program is anything but surgical, for which I supply a mountain of evidence.

    2. McConnell’s “kill Americans” line is the first use of der dolchstosslegende (”stab in the back” theory) by a major American political figure. We knew it’s coming, now it’s here.

    Interesting comment somewhere above about how the wingnuts will feel about their laws abridging the Constitution and Bill of Rights after the Democrats, possibly the big bad Hillary are in charge. Even the dedicated right wing editorials predict a republican wipe out. No doubt.

    I once called the oversight committee early on in this fiasco, to thank them for all their hard work in constructing the Sword of Damocles in their implementation of the De-Federalization of the Constitutional Government or as commonly know, Competitive Outsourcing of the Federal Government. Somewhat startled they asked why I would thank them… Hehehe

    I asked where in this government after the political pendulum swings the other way, would they ever hope to find a republican? The republicans, or more precisely the right wing radicals who have hijacked the republican party to guide it to its demise, have carefully constructed the very sword which will come crashing down on their unwitting heads after they no longer retain any power in government beyond that of a pityfull and yelping minority. The spyall bill, like so many other un-Constitutional attacks on liberty and freedom installed by their own hands, will come back to not only haunt them, but it may well be the wingnuts themselves who wake up in the camps carefully constructed by they so righteous leaders.

    The Sword of Damocles is very sharp and cuts both ways.

    The much heralded and sought-after victory has already eluded us. The same Constitution that every public official raises a right hand to swear to protect and defend, not to plunder and ignore.

    Have the terrorists already won? What do you think? A new campaign is about to be launched to convince the people why they should pressure their congress men and women to support the continuation of the Iraq war —you..mean Afghanistan, don’t you?

    I believe a victory is still possible in AFGHANISTAN if we let ourselves regroup and remind ourselves why we started this squirmish into the wilds.

    Is it time to invoke the spirit of the Founding and ask if this is what they had in mind, and if this is what has given the country the awesome reputation it has enjoyed before 2000?

    Is another American life/limb worth involvement in a conflict that has roots in a civilization of 5000 years ago?

    I find it fascinating that every time the Republicans find they’re losing ground, their weapon of choice is to claim that we will die if we dissent in any way.

    One memorable example is when Karl Rove told us all in 2006 that we would die if we didn’t vote Republican. We haven’t died. And I doubt we will die when we elect even more Dems in 2008 (despite predictable dire warnings from the right again).

    What a load of BS… 200 hours to get a warrant? #1 under FISA you are allowed to spy first report to FISA afterwards… #2 ever hear of something called computer automation? It speeds things like paperwork up a whole lot…

    As far as the private sector goes all they had to do was act like good Americans like SOME did… help out all the government wants AFTER they hand over a warrant… real simple… then we know the government is being checked on by the courts…real simple… it happens all the time.

    The fact is Bush has never proven that warrant less wiretapping has actually succeeded in preventing terrorism. Neither is he likely to. This bill gives expansive powers to Bush without proper Congressional oversight. Talking about wiretapping doesn’t kill Americans. McConnell’s argument weakens when he himself divulges classified information. He is only trying to stifle free speech and the people right to know the truth.

    But as I pointed out earlier (and which you obviously ignored), Bush has no problem going to the FISA court for a domestic-domestic call. So your “point” is bullshit.
