Judge ’scolds’ Bush administration on spying secrecy.

Today, U.S. District Judge Henry H. Kennedy Jr. “scolded” the Bush administration “for responding with sometimes blanket secrecy to a request for documents on its warrantless wiretapping program.” While the judge agreed that the documents could not be released, he criticized the government’s reasons for holding them back:

“While the court is certainly sensitive to the government’s need to protect classified information and its deliberative processes, essentially declaring ‘because we say so’ is an inadequate” defense, Kennedy wrote. [...]

Kennedy said the Justice Department must release a list of its documents and explain why each cannot be released. Kennedy had particularly strong words for the FBI, whose response he called “wholly inadequate.”

The FBI, Kennedy said, has not explained what type of documents were being withheld, how many records it had and why each document is exempt from public records laws.

“Instead, FBI relies on vague, broad, wholesale claims of exempt status,” Kennedy wrote.

    Uh…yeah…scolding … that’ll do a lot. Why not write a strongly worded letter, or threaten to issue a document that they will ignore? The dems need to wake up and understand that all the repubs understand is teeth, fangs, venom, and bite. If you don’t put anything into your “scolding” that makes them sit up and take notice, they won’t.

    There is only one recourse: Impeachment.

    How many more times do Federal Judges need to point out instances of this administration’s lawlessness before Congress acts?

    You’ve prematurely judicated again, dumbass. Re-read the order, he demands they explain each reason individually and THEN he’ll rule on whether there is a legitimate reason any should remain secret. That’s what a REASONABLE judge does, and why a retard like you is unsuited to ever hold a gavel, whether in a mensroom or courtroom!

    Now that they have to release a specific list of documents that they want to be kept secret and have to give specific reasons why each document deserves that status I can’t wait to see the amount that is rejected for having no basis to be kept hidden. Many documents probably have titles like “Democrat Political Action Group”, “Amish Quilting Bee/Peace Mothers”, “San Francisco Day Care Center/Future Democratic voters”, etc.

    If you actually read the article, and comprhend it, “must” does come up with regards to releasing documents. Just thought you would like to know that…..I mean you seem to be interested in facts and all…

    Kennedy agreed with the Justice Department that many records should not be turned over, either because they were classified or because they were drafts of documents not covered by public records laws.

    In other instances, Kennedy said the Justice Department must release a list of its documents and explain why each cannot be released. Kennedy had particularly strong words for the FBI, whose response he called “wholly inadequate.”

    Actually the judge was clear that the MUST release those they don’t have a LEGITIMATE claim to the secrecy of. Read the order, dolt.
