Judge strikes down part of Patriot Act.
Today, U.S. District Judge Victor Marrero struck down part of the revised Patriot Act, ruling that investigators must obtain a court’s approval before the order Internet providers to turn over records without telling customers. Marrero said the “recently rewritten Patriot Act ‘offends the fundamental constitutional principles of checks and balances and separation of powers.’”

Although Bush and his criminal partners are pushing for more and more power - it’s the judicial branch that keeps giving him cover - and some kind of cloak of “legitimacy”
A good ruling here, but overall, the judicial branch is no friend to your liberty.

The White House was not amused Thursday by the antics of an Australian comedy group that breached President Bush’s security in Sydney.
Bush spokeswoman Dana Perino had few details on the incident, but Australian press reported that 11 members of the troupe “The Chaser’s War on Everything†had been charged with entering a restricted area.
Australia is hosting a meeting of the Asia-Pacific Economic Cooperation, which Bush and other regional leaders are attending.
The group staged a faux motorcade, pretending to be the delegation of Canada with one of the comedians dressed as Osama bin Laden, and made it past two police checkpoints before being stopped.
When asked about the event, Perino referred reporters to the Secret Service.
Bush had expressed regret that security measures taken to protect the conference had burdened Australians.
“It’s unfortunate that security climates were as such, but, as soon as we get out of town, then Sydney will return to normal, hopefully,†Perino said.

If appealed (and think it will be appealed), it won’t make it to the SCOTUS - the Appeals Court will overturn it. The Judiciary is stacked “Conservative Republican” way deep. Time for an investigation of the Courts/Bar Association, and a little ovrsight by Congress. Cameras in the courtroom, placed there by statute, would be a good place to start.

You might be right. It would be wantonly unfortunate that the few voices of dissent we have left in the Judiciary are rapidly being silenced . I would however, apportion more credit to the Judge who is taking a stand against what he knows to be wrong than to you who would rather live in a society whereby the laws are what a few people say they are.

i would like to add that not only does the administration’s behavior beg the question asked in this post, i.e. if you don’t have probable cause why are you doing it?, but further if the administration does not obtain a warrant to gather evidence, on what basis will they then bring prosecutions? in short, all the information they gather using any warrantless program would have to be inadmissible in court, so what’s the point?

If you ask them to turn it down _at all_ to a volume-level you can no longer hear, you do NOT tolerate it. It is more a solid end. It is neither a means that can be split into its different quantities nor a traversal through a range of qualities.

Read the 4th amendment carefully.
As long as the search is “reasonable” it’s on. It says that probable cause is required for a warrant, but it does not say that a warrant is required for a search. The only thing that requires it is legal precedent.
