Last week, controversy erupted when the University of California at Irvine fired the inaugural Dean of its new law school, constitutional scholar Erwin Chemerinsky, because his “political views would make him a target for criticism from conservatives.” This morning, Chemerinsky and UC Irvine Chancellor Michael V. Drake announced that they had reached an agreement enabling Chemerinsky to return to his previous position.
So…what are the terms of this “agreement”?
September 17th, 2007 at 2:55 pmPROBABLY….he has to sign the loyalty statement and drinksome sort of koolaide

Chemerinsky won’t sue Drake into the poor house….. ?
September 17th, 2007 at 2:58 pmLOL
Was there any actual conservative complaints? Or was it just the school thinking there might be?
September 17th, 2007 at 2:59 pmThis fealty crap is out of hand. And it goes to show that this 30% of the population who still support the President and the War, are not toothless squirrel hunters, they hold positions of real power and they’re not timid about wielding it “for the cause”.
September 17th, 2007 at 3:02 pmHmmm… no doubt, there will be more to this.
September 17th, 2007 at 3:02 pmAnd they claim that the Liberals are on a witchunt! This was disgraceful and I’d also love to see what kind of agreement was knocked out for his return. Suing his ass off would have garnered some attention and I hope that Chemerinsky made out like a bandit on this one.
September 17th, 2007 at 3:04 pmComrade Chereminsky had to agree not to implement his plan to force his students to wear quilted outfits or publicly sing the praises of Kim Jong-Il.

To be considered, all entries must reference Cheney’s weather machine, New Orleans, secret oil pipelines, Halliburton, Texan gulags or a bionic Rovian puppet-master.

I heard some kind of rumor somewhere (and I am unable to find anything to confirm it or even help back it up, so I am clearly stating that it IS just a rumor) that some big contributor to the university complained — some conservative who had an ax to grind with Chemerinsky.
If that’s the case, I can see the school dismissing Chemerinsky to appease their gravy train, figuring if they did it quietly it would blow over quickly and the waters would settle as before. They may not have foreseen the publicity this generated, and didn’t like the embarrassment associated with firing Chemerinsky for no good reason.

September 17th, 2007 at 3:15 pmI’m sorry to hear this, since it seems that Drake won’t be stepping down as chancellor. It sounds to me like a deal was brokered to cover up what really happened, that Drake caved in to Donald Bren, then lied about it to cover it up. At least some of the Regents might have been complicit as well. Drake’s behavior with regard to the whole affair has been shameful. He clearly lied in his LA Times op-ed about not doing it for political reasons. The Regents must be maneuvering to avoid an investigation that could only go very badly for Drake, and perhaps other UC insiders.

September 17th, 2007 at 3:26 pmApparently UC Irvine didn’t get the memo that the outright repression won’t start until after the coup.
September 17th, 2007 at 3:28 pmHmm, I wonder who made the greater compromise here. Did the professor compromise that he would sign the loyalty pledge of no dissent, ever. Or did the Dean realize that he was abusing rights granted under the Constitution.
BTW, today IS Constitution day. 120 years ago today that document was signed putting into national law that which was in the Declaration of Independence, as well as establishing the justice and processes in place to guarantee our form of government.
September 17th, 2007 at 3:30 pmToo bad, Bush and Cheney don’t know it, don’t care to know it, and in fact disrespect it.
Cheney has even decided to make an end run around history and keep “no notes” on the vice presidency. Shows you what he thinks about history, and the preservation of the Constitution itself.

No thinking allowed in wingnutville, I see. let’s hear you accuse Dems of taking money from a donor again, without the fact that they returned it, unlike the Traitor-In-Chief Bush, who kept all his ChiCom spoils.

Yes, when Erwin criticized AGAG for his ‘American Citizens have no Habeas Corpus’ stance, which was basically against the constitution, Conservatives complained.
Now this is really odd because Erwin is basically taking an old school conservative stance where as AGAG basically isnt.
Sara Taylor said she took the oath to protect the president seriously – but she had to be reminded the oath was to protect the constitution.

I can hear it now, “I swear the constitution is a piece of GD paper, now quit waving it in my face just like George said.”
September 17th, 2007 at 4:59 pmCowards. It’s about time someone stood up to the Rush Limpbaughs on the extreme right and said: “You guys are stupid, and I’m not gonna take it anymore”.
September 17th, 2007 at 6:20 pmThese include heavyweights blogs of the right. Please note that these are full voiced protests of Chemrinsky’s treatment by UC Irvine. Hanson is posted on National Review Online.
Let’s Play Guess Who’s Defending The Liberal
The Chancellor at UC Irvine had offered the deanship of UCI’s brand new law school to Erwin Chemerinsky, then abruptly withdrew the offer. The reason?
Chemerinsky’s political views would make him a target for criticism from conservatives.
But the point here is, well, who’s objecting to this? Here’s a list:
Gay Patriot
Instapundit
Hugh Hewitt
Captain Ed
Victor Davis Hansen
John Leo
Powerline
So what do all of the above have in common? Class? Anybody?
They’re conservatives.
I get the Inside Higher Ed RSS feed every day (I only subject myself to the idiocy printed there if I see something intriguing on the feed), and although there may be some objection there, it hasn’t been in the feeds.
So let me chime in on the issue. This is crap. Drake made the offer, all the way to negotiating the salary and telling Chemerinsky he was hired. Drake had damned well better apologize, and give Chemerinsky the job. I don’t care how nutso-batso left the man is.
