Judge rules Bush can’t block presidential records.

Today, a federal judge “invalided part of a 2001 order by President Bush allowing former presidents to review executive documents before they can be released under open records laws.” The AP reports:

bushreading3.jpg U.S. District Judge Colleen Kollar-Kotelly ruled that the presidential order eliminated the discretion of the National Archives to control the release historical records. She said the executive order allowed former presidents to delay the release of those records “presumably indefinitely.”

The ruling was made in a lawsuit filed by the American Historical Association and other organizations, which argued that Bush’s Executive Order 13,233 was an “impermissible exercise of the executive power.”

A bill that would overturn the order is pending in the Senate.

    I remember not so long ago, the Supreme Court no less decreed that keeping prisoners indefinitely in Gitmo without charge, trial or access to a lawyer was unconstitutional and they must begin to try prisoners or release them.

    Gitmo is still there. No mass trying of the accused or mass release has since taken place.

    Judges order the Bush Administration to do something, and they promptly ignore it.

    I'll believe it when I see:

    a) the records actually see the light of day,
    b) some sort of action taken as a result (i.e.: impeachment)
    c) said action actually followed through to its conclusion (i.e.: conviction)
    and
    d) consequences as a result of said conclusion (i.e.: imprisonment, execution, etc.). (NO pardons or commuted sentences.)

    Until I see all those things, I won't hold my breath.

    Yeah, that's the first I'd ever head of her, too, and I was none too pleased with it. She's also the presiding judge on the FISA court and she's ruled against Bush at least a couple of times on wiretap issues.

    As I have often pointed out on these threads, Reagan is dead. How can he object to the release of his presidential records?

    Besides that, Bush is going to have to worry about this part of his EO being struck down, because he hid his records as Texas Governor in his daddy's library. His father may not be allowed to deny access to them. Oh, the crimes we could learn about in those records. And before anybody defends him, if he did nothing wrong, he's got nothing to hide. Right?

    I have been saying for sometime that we have to start undoing every illegal thing that Bush has done from the beginning of his Administration and finally someone is doing it. This was one of the first executives oders W issued when he gained office, overturning a law passed by the Senate setting a 12 (?)year buffer between a president leaving office and his papers becoming open historical records.

    I agree totally. I live in Florida and voted in one of the precincts that had 27,000 of its ballots thrown out. The "powers that be" did all they could to make sure this idiot was installed into the position of president.

    RE: above: Keith, you sure said a mouthful there! You managed to take me back down Memory Lane with your post. Bob Hope"s "Thanks For the Memories" song comes to mind Thank you for your post. We all need to revisit things of this nature as reminders of the dark periods of deceit and corruption perpetrated upon the citizens of this country by a few people elected or installed into political offices. This has been the LONGEST 8 years of any presidency, and it still isn't over. I marvel at the fact that we still have about FIFTEEN MORE MONTHS left on that man's term before he leaves. It's a term for him, but it feels like a sentence to me, doing time until 2009

    Rastamon, I totally agree. It’s more of a nut house than the white house. Such poor examples these idiots are displaying for our future leaders, our children and youth, who are listening and watching. This idiot and his cohorts are running this country into the ground. This is the worst, most selfish, and the greediest administration ever! The entire lot of them! We need to have another Tea Party, only this time we toss the crooked politicians into the waters and keep the tea. Some of these politicians have been in office so long until they think they are entitled to
    the positions they've held for so long. There should be a term limit. When the outgoing president leaves, whether it's after four years or eight years, when he or she leaves, the rest of them should be required to vacate as well.
