you do know that the power the Constitution gives to congress to ratify foreign treaties implies that congress can in essence validate foreign laws and incorporate them into our own legal system if they agree with them, right? or is that drawing more of an inference than THomas did in the case you cited above.

If Just Us Thomas really was the great person who cares about people, then he wouldn’t do everything he possibly can to hurt African Americans. But I guess when you are questioning the greatest “Uncle Tom” or all, you can get away with it. Look at the clip again and watch how Thomas smiles broadly in an attempt to please Hannity. This reminds me of one of those old movies with the ignorant black man saying. “Yesss Surrr Bossss”. I mean come on, Thomas grew up at a time when blacks were protrayed as ignorant slow speaking idiots who could only say, “Yessss Surrrrr Bosssss”. So of course Hannity is going to play Thomas for all he’s worth to show that even he (Thomas) is an ignorant fool although he’s a Supreme Court Justice. And Thomas played the “Step and fetch” role to a “T”.

Lets get real if Thomas was a so called liberal, Hannity would be attacking him. It’s only because this man is such a fool that conservatives use him to do their bidding. He’s the perfect tool to get their racist message out. He says and does the things they wish they could do in public.

On C-SPAN a couple years back, he appeared with a bunch of school kids, and one asked him what the rationale was for one of the landmark cases of the prior term (to which he’d signed on), B.S.A. v. Dale. The distinguished jurist replied that that was last term, and he didn’t remember … maybe like he didn’t remember any discussion about Roe v. Wade….

If you are not racists (meaning liberals), then why is the only justice that is routinely criticized as being intellectually inferior is also the only black justice?

We can and will disagree on the mental capacity of Clarence Thomas, but just on the fine point of whether that disagreement means we are racist is logically faulty. We disagree with Thomas because of his ideology, and would have the same position whether he was white, brown, red or Labrador. The color of his skin is totally irrelevant. And I think you know that.

There is one black person in my group, and he is head and shoulders above the rest of us. He works for me but I can’t hold a candle to him. Does that mean I think blacks are superior to my German/English ancestors? No.

And before someone rants about the fact that he works for me, it’s because I am an old fart and he isn’t. I may very well work for him before I retire. That’s ok too.

When you suggest that all criticism of Clarence Thomas must be a response to his skin color — that’s playing the race card.

Moreover, in his opinions, Clarence Thomas is not only out of step with the vast majority of the judicial establishment, he is out of step with the vast majority of Americans. He is out of his depth.

Here’s one (in defense of carrying guns in school zones) in which he endorses undoing 60 years of legal rulings concerning the Commerce Clause. The case is United States v. Lopez.

His opinion suggesting that the States may endorse religion occurs in this opinion for Elk Grove Unified School District v. Newdow.

See #87: According to Thomas, states are not prohibited from establishing a religion (Elk Grove Unified School District v. Newdow). Our forefathers would be aghast. Additionally, Thomas doesn’t believe in stare decisis (i.e., legal precedent). Every justice who has ever sat on the Supreme Court would be aghast.

If your criticism of Thomas is his lack of regard for Stare decisis, then you must be terribly upset that Plessy V. Fergessun was overturned.

Why? The Court has often overruled its earlier decisions — 130 times between 1946 and 1992. But according to Scalia, Clarence Thomas “doesn’t believe in stare decisis, period.”
