The state department immunity issue relates only to the statements they made. The main impediment to them being charged in america is that, ironically, america has no jurisdiction over them for crimes they commit in iraq. i believe this was intentional, so they could do things like murder and torture with impunity.

strangely enough, if an american goes overseas and ends up having sex with a 17 year old girl from that country, the american government can charge him with a crime.
if he kills a 17 year old girl from that country, the american government can take no action against him… f@cked up world we live in, huh?

I am truly amazed that any dissent from this pinhead’s view of the world is tantamount to thought crime. But then other posters start bringing out that Blackwater has hired foreigners with unsavory reputations. Hits begins to wiggle:

Note that we have gone from national heroes who are beyond question to just plain old working Joe’s who are trying to do a job. But what about the fact that these people may have wrongfully used deadly force and killed innocent people? Should we not be concerned? Of course not, because there has to be legal proof.

You call them “murderers”. Not everyone agrees with you. If they are designated as such under US law, in a US court, I will change my opinion. Until then, tough luck – that’s the way the law works.

Well, I am sorry Hits but I do have a juris doctor, I have been a prosecutor at the state and federal levels as well as a judge advocate. YOU ARE A STUPID IDIOT. The presumption of innocence applies only to the burden of proof in a CRIMINAL case. Remember OJ – he got off on criminal charges but was found liable for murder in a civil case. Different venue and a different standard of proof.

Here we have extremely important policy considerations. These private contractors can create serious problems for the military. Contrary to Hits, there are serious questions as to whether a US court would even have jurisdiction to try them. This would really please the Iraqi’s since our own FBI believes that much of the violence was not justified. Great for relations with Iraq and dampening tensions that lead to attacks on our military and civilian personnel. A lot of military commanders have been dismayed by the tactics of these paramilitary organizations that lack the same training, discipline and accountability as the active military but are doing assignments traditionally given to the military. The use and constraints placed upon these organizations does constitute a policy decision.

However, Hits would not have any accountability for these individuals. Again showing his ignorance:

Gosh, thats better than US soldiers receive over seas where there are Status of Forces Agreements that determine jurisdiction over military personnel accused of a crime. Guess what, in many countries the foreign government can try our military personnel or reserve the right to try our military personnel if the US either does not or cannot take action.

But Hits just shifts his position to keep the argument going. He is not really defending them. He just wants Blackwater to have a fair shake:
