Lawmakers didn’t object to waterboarding in ‘02?»

The Washington Post reports that in Sept. 2002, a bipartisan group of four congressional members — including Speaker Nancy Pelosi (D-CA) — met to get a “first look” at the the CIA’s harsh interrogation practices:

Among the techniques described, said two officials present, was waterboarding, a practice that years later would be condemned as torture by Democrats and some Republicans on Capitol Hill. But on that day, no objections were raised. […]

Pelosi declined to comment directly on her reaction to the classified briefings. But a congressional source familiar with Pelosi’s position on the matter said the California lawmaker did recall discussions about enhanced interrogation. The source said Pelosi recalls that techniques described by the CIA were still in the planning stage — they had been designed and cleared with agency lawyers but not yet put in practice — and acknowledged that Pelosi did not raise objections at the time.

The Post reports the CIA gave about 30 private briefings between 2002-03 on its interrogation practices. Former Senate Intelligence Committee Chairman Bob Graham (D-FL) said “he has no memory of ever being told about waterboarding or other harsh tactics.” In Feb. 03, Rep. Jane Harman (D-CA) filed “an official protest about the interrogation program.”

UPDATE: John Aravosis suggests the story was leaked by the Bush administration to embarrass Pelosi.

    Well, this might explain the lack of push to punish the Bush administration for its excesses, if Pelosi, Rockefeller and Harman all witnessed the glories. Notice that they never stood up and said, “I saw it and approved it. We were scared.” No wonder impeachment is off the table.

    A threshold has been breached; the Bush administration, the GOP and the neocons should no longer be given the benefit of the doubt. It was evident years ago but now it is inescapable and undeniable; the Bush administration is inept, corrupt and anti American.

    From this point on, every American must question any actions and any information emanating from any member of the Bush administration or any of its fringe support groups. From this point on the administration must be required to produce evidence of its assertions.

    In short, any Amerian who accepts administration posturing without question is complicit in the deterioration of our freedom.

While it names several Democrats in the article as having been briefed, it only names one or two Republicans, despite the fact that all these committees were controlled by the Republican majority in 2002 and 2003. I smell a bit of “reporting by White House transcription” going on here.

    Frankly, I can’t see how he can govern at this point. He has no credibility, the people of this country abhore him, and he now has at least a dozen impeachable offenses against him.

    But, with Pelosi being sidelined by her complicity in some of the wrongdoing, is it any wonder why she immediately announced that “impeachment was not on the table” when she knew beyond a doubt that this was part of the mandate of the midterms. Yes, remember the midterms and what we knew about the Bush Cabal then?? Wow! So much dirt has unraveled since then that one can only wonder what is coming down the pike over the next 12 months!

    It has been almost a year since Democrats won the House.
    Under Pelosi leadership things did not come to statisfaction by voters who put her as a Speaker.
    She talked a lot about…’No blank checks for Bush, voters heard about benchmarks and no more money until withdrawal plan is put’…,all investigations to protect laws and Constitution by the House turned nothing.
    She needs to go..
    She is an empty dress, Bush and Cheney know it.
    She payed every check and then some of what Bush asked for.
    She talks,but showing reluctancy and weaknesses.

    Another Speaker is needed in the midst of this war, its cost..the deficit issues, the Constitutional isses,and American status in the world.

    This is really insidious! It wasn’t just “years later” that the practice of waterboarding was classified as torture. It was torture when the Catholic church used it during the Inquisition and it was torture when we tried and hanged Japanese soldiers for it after WW II.

    It - has - always - been - torture! It - is - still - torture!

    The writers of this article clearly want us to take from this that we suddenly “decided” that, after a long and glorious history, waterboarding is torture. That’s the “liberal media” for you, right? Bollocks!

    The briefing was classified, for Pete’s sake! It would have been a security breach for anyone to come out publicly about this at the time of, or since, the briefing. As for the “congressional source familiar with Pelosi’s position” who claims Ms. Pelosi raised no objections, how much you want to bet that the source is one of the Republicans who was briefed or one of their aides?

    Jane Harman did the right thing. She spoke out. I support her for that. And I believe her.

    Nancy PollLooser is lying, it’s clear from the timeline, and she did NOTHING, unlike Jane Harman who spoke out.

    Here’s my logic. The only individuals familiar with what these individuals actually saw in the briefing would be the participants themselves. The programs are so secret that the complaints regarding them are not even typed up by staffers, they are handwritten. Recall that Rockefeller complained about the FISA violations regarding domestic surveillance and wrote a copy of his own letter so that he could use it later.

    So the fact that the briefing was made by a “virtual tour”, that it included waterboarding, who the Congressional Leaders who were present, the details of discussion means that the “sources” were individuals who were actually present. Roberts, according to the article, was not available for comment. I doubt Rockefeller would be the source (nor his predecessor Graham…who has denied being given any such information about waterboarding in any case). Pelosi wouldn’t be the source. That leaves only one Congressional source.

    PORTER GOSS. And Goss later became CIA Director during the critical period when the recordings were destroyed. He was the one responsible for the appointment of Jose Rodriguez, the “model for Jack Bauer”, who destroyed the tapes. He was the one that forced the resignations or firings of dozens of CIA officers in the operations division because they were “not aggressive enough” in dealing with al Qaida and terrorism.

    He’s gonna be one that most likely authorized the destruction of the tapes, me thinks. So we have a source who would be very intent on suggesting that no one objected to the torture. And note the careful phrasing.

    a congressional source familiar with Pelosi’s position on the matter said the California lawmaker did recall discussions about enhanced interrogation. The source said Pelosi recalls that techniques described by the CIA were still in the planning stage — they had been designed and cleared with agency lawyers but not yet put in practice — and acknowledged that Pelosi did not raise objections at the time.

    Hmm! How could a Congressional Source KNOW what Pelosi did or didn’t do AT THE TIME. How would they KNOW what she was familiar with? Remember that this was strictly classified information. The only “source” who could even have had a chance to know whether she had said anything at the meeting who appears to be talking is PORTER GOSS. Add to this fact that he would be the only one to know if Pelosi wrote a letter of complaint, as CIA Director (if he actually looked at the files and the WH provided him with it).

    This reminds me a little bit of the effort that Scooter Libby tried to use to make himself up as a “Congressional aide”.

    Who is the “second official” then? My suspicion is, since there needs to be a confirming source, is that this represents the CIA official who briefed the Congressional Intelligence Committee representatives. That would be someone who directed the torture interrogation programs. Rodriguez was “unavailable for comment” so perhaps it was one of the interrogators themselves. Amazing that they would be talking to the media when the whole rationale behind this was to protect their identities! The risk was supposedly to come from the carefully proscribed court process? Seems that this doesn’t fall under the “protected source” criteria that Congress just authorized for “reporter-source” protection, BTW.

    So why would a CIA official even risk reporting this unless they themselves were one of those under threat of Prosecution…as all of this would have come out during any sort of trial IF TRUE.

    But here we appear to have two individuals very concerned about covering up their own roles in the destruction of the tapes, appearing as sources asserting that Pelosi and either Rockefeller or Graham were informed about waterboarding and made no objections. That certainly diminishes their reliability, and I’m surprised that the WashPo doesn’t see that.

    Maybe Pelosi will insist that the CIA release the Virtual Tour to Congress, and investigate just who is sourcing all this material.

    BTW Recall that Mukasey is running his own investigation of the CIA’s Inspector General who is looking into just such criminal activities by the CIA. The IG was the one that initially brought the tapes to the attention of the courts.

    I don’t defend Pelosi for this. She should have gotten on record as opposed, under protest, whatever.

    Recall the times, however; she would have been branded as a traitor if she’s leaked the info and/or been thoroughly Dixie-Chicked. Also, the paucity of info given to the Gang of Four is well noted. They may have been read the outline of the torture novel and told that was all of it.

    Indeed. They’re cowards. While the WaPo article about this does not make it look good for Pelosi, at the same time, they’re citing all sorts of anonymous sources. And WaPo’s proven time and again they’re word is not gold. I want proof, with a name attached.

    The whole deal is schizophrenic, though. This is what bu$hler has done to all of us.

    From the WaPo article:

    Congressional officials say the groups’ ability to challenge the practices was hampered by strict rules of secrecy that prohibited them from being able to take notes or consult legal experts or members of their own staffs. And while various officials have described the briefings as detailed and graphic, it is unclear precisely what members were told about waterboarding and how it is conducted. Several officials familiar with the briefings also recalled that the meetings were marked by an atmosphere of deep concern about the possibility of an imminent terrorist attack.

    “In fairness, the environment was different then because we were closer to Sept. 11 and people were still in a panic,” said one U.S. official present during the early briefings. “But there was no objecting, no hand-wringing. The attitude was, ‘We don’t care what you do to those guys as long as you get the information you need to protect the American people.’ ”
