Biden: Does preservation order cover Cheney?

Days after the destruction of the CIA interrogation tapes was publicly revealed, White House Counsel Fred Fielding sent out a notice to “all employees” ordering them to preserve documents and evidence on the matter. Today, Sen. Joe Biden (D-DE) wrote to Fielding asking how far the order reaches:

On December 10, 2007, White House Press Secretary Dana Perino stated that you issued a written directive to White House employees to preserve documents related to the destruction of the CIA interrogation tapes. Ms. Perino did not provide a copy of the directive, however, and she was unable to answer questions as to its breadth and scope.

Please confirm that the directive to preserve documents applied to the Executive Office of the President, including the National Security Council, in addition to immediate White House staff. In light of the Office of the Vice President’s record of fatuous arguments that it is not subject to the authority of the President, please also confirm that the directive included the Office of the Vice President and that the Office of the Vice President intends to comply.

    It’s not likely that this order covers the President or Vice President. Just as the President can declassify or classify something (and delegate that power to the VP) he can destroy any document he wants.

    Not true.

    Presidential Records Act (PRA) of 1978, 44 U.S.C. ß2201-2207, governs the official records of Presidents and Vice Presidents created or received after January 20, 1981 and mandates the preservation of all presidential records. The PRA changed the legal ownership of the official records of the President from private to public, and established a new statutory structure under which Presidents must manage their records.

    Two unnamed sources (read Administration flacks) putting out stories about what went on in a classified briefing. Really, really slimy. Pelosi can’t comment in detail about what she learned at the briefing and so can’t respond in the specific about the innuendos directed her way by the Bushies.

    Isn’t our congress part of the national leadership?

    Apparently not, if you listen to Bush. Congress is supposed to do whatever he tells them to do. He’s the Decider. The Commander Guy.

    Frank M’s arguments are like my5 year old’s jokes. She has the form of the joke down, she asks a question then thows out a random response for the punch line. It’s funny, not becuase there is actual humor there but becase she’s 5 and it’s cute (and my daughter).

    Frank on the other hand, makes a statement that is connected to the topic at hand in some random fashion on the surface, but doesn’t respond to anything real and he thinks he’s arguing. The difference frank is that my 5 year old will figure out what makes something funny, she’ll grow intellectually, you on the other hand, will never get any smarter than you are right now….

    You can’t prove your contention either way, dum dum. Just because you say this, it doesn’t mean it true, either the specifics or the generalization. Try again, and start w/ some verifiable facts.

    BTW, what the comment, “now that they control both Houses” have to do w/ anything? Pure, unadulterated SILLY!!!

    They don’t idiot. That is one of the differences between republicans and democrats. the rank and file democrats will hold our leaders responsible for their agregious actions. Remember President Johnson? He did a lot of good things for this country, but he escalated the Vietnam war and he was chased out of the whitehouse by the rank and file. it was messy, and there was not complete agreement by all democrats, but enough wanted him gone, and gone he went.

    Republicans on the other hand, don’t care about what’s right. you care only about “winning” in the basest, most childish sense of the word.

    Look, we don’t know how much information the briefer actually provided. All that has been alleged is that there was information about “enhanced interrogation techniques” but not what that information was.

    If the Congressional representatives weren’t given specific and detailed information about those techniques they very well might have asked if they were “tough enough”. Hell, the very fact that they asked that question is a strong argument for their not receiving detailed information about those techniques. Can you even imagine anyone seeing a tape of someone being waterboarded or even reading a complete description of the procedure and still having questions about its being tough enough?

For those at all interested, the article appeared in the WaPo on the 9th. Here is a link. And here is some of the article the Captain conveniently forgot to include:

    Congressional officials say the groups’ ability to challenge the practices was hampered by strict rules of secrecy that prohibited them from being able to take notes or consult legal experts or members of their own staffs. And while various officials have described the briefings as detailed and graphic, it is unclear precisely what members were told about waterboarding and how it is conducted. Several officials familiar with the briefings also recalled that the meetings were marked by an atmosphere of deep concern about the possibility of an imminent terrorist attack.

    “In fairness, the environment was different then because we were closer to Sept. 11 and people were still in a panic,” said one U.S. official present during the early briefings. “But there was no objecting, no hand-wringing. The attitude was, ‘We don’t care what you do to those guys as long as you get the information you need to protect the American people.’ ”

    Only after information about the practice began to leak in news accounts in 2005 — by which time the CIA had already abandoned waterboarding — did doubts about its legality among individual lawmakers evolve into more widespread dissent. The opposition reached a boiling point this past October, when Democratic lawmakers condemned the practice during Michael B. Mukasey’s confirmation hearings for attorney general.

    If you are talking about an elected government official who swore an oath to the Constitution then yes, Fielding’s opinions and decisions have merit and import. If you are talking about Richard B. Cheney, well, all bets are off.

    As opposed to the people who made those decisions in a panic and have now reconsidered them. Like, oh, Bush. Except he hasn’t. And he won’t.

    “Progressives” have never been in favor of torture, rendition, or panicked responses to an attack. Your problem, well one of your problems, is an utter and complete inability to distinguish between “democrats” and “progressives”. Or even “some Democrats” and “progressives.”

    And you never absorb this information because you have absolutely no intention, in spite of your claims, of actually listening and learning.

    Do you realize that upon being told that our country was under attach, Bush did not even raise an eyebrow, roll his eyes, or otherwise look surprised, concerned, or even remotely interested??

    All of his recent lies have shown this man to not have a single cell of credibility in his body so one would have to presume from all of this evidence that nothing, and I mean absolutely nothing (even a false flag on 911) would be beyond him – or beneath him.

    At one point, people had to dig to connect the dots and then imagine someone so uncaring, so diabolical, so unpresidential to even think that this could be possible. The past years of continuous lies and covering up, destruction of evidence, obstruction of justice, constitution shredding, illegal spying, and the genocide of our patriotic innocents in Iraq all lead to the now-obvious conclusion.

    BUSH KNEW! Just like he knew and condoned every other criminal activity that’s occurred, it all goes straight to the top where the buck finally and ultimately will stop.

    At the time the media and the American people found out about it, Biden viewed the Abu Ghaib videos in a closed session with several other Congresspersons who looked sick, pale and shaken afterwards. Biden said the tapes were of atrocities that you would expect from Pol Pot or the Nazis. Bushco said publicly that Biden was out of line for comparing US troops to Nazis. Biden cried as he apologized publicly. DU posters were upset and said what is he crying for.

    Biden and/or his family was threatened by the bush thugs, as was Congressman Pete Stark 2 months ago who said bush did not care about the soldiers and played with our troops like toy soldiers. A few days later, Stark cried when he apologized in a news conference. OUR CONGRESSPERSONS NEED SECRET SERVICE AGENTS TO KEEP THEM SAFE FROM CHENEY’S MOSSAD THUGS.
