The ACLU filed a petition with a federal judge today “charging that the [CIA] flouted a court order when it destroyed at least two videotapes documenting the harsh interrogation of prisoners in its custody.” In October 2003 and May 2004, the United States District Court for the Southern District of New York had ordered the CIA to preserve “all records pertaining to the treatment of detainees in its custody.”
Seems pretty clear-cut to me…
Here’s a question for the Trolls-of-the-Day: How could the CIA/Bushco argue that those tapes were not “records pertaining to the treatment of detainees in its custodyâ€?
December 12th, 2007 at 12:01 pmThings like this don’t work out so well when the Bushies have managed to corrupt the justice system as well as every other part of government.
I’m not going to hold my breath.
December 12th, 2007 at 12:02 pmACLU is a terrorst group. They all live with their parents and hold GEDs and degrees public schools. They are not the 21st centry.
December 12th, 2007 at 12:02 pmThe trolls are getting started early today. A lot of bad news for the Bush criminal gang is coming out, so I am not surprised that a troll frenzy is starting up. They have been dispatched to disrupt and derail discussion of the many crimes and human rights violations committed by the Bush administration. But obviously the trolls have nothing at all to go on, judging from their bizarre and ludicrous comments. The troll factory had to release them early today before they could be trained in the new talking points, which wouldn’t amount to much, anyway.
December 12th, 2007 at 12:07 pmYeah, whatever he said.

So is the ACLU a terrorist group because they live with their families. Seems like thay would be exhibiting “family values” or are people who are you suggesting people who live with their families are some how terrorists?
Also, how is it possible for a practicing attorney to only have a GED?
December 12th, 2007 at 12:09 pmAwesome!! – Can’t wait to see Righties trashing the ACLU all day long.
Don’t worry, Righties, they will still supply you with a good lawyer when the time comes. Fact is, ACLU is the only power on Earth that could or would defend you from most of us, who would happily see you jailed for sedition.

Don’t all lawsuits/trials ask the court to rule upon something?
December 12th, 2007 at 12:23 pmI’m surprised JD could spell ACLU. Maybe he learned at the YMCA where he lives. It’s no wonder he supports W as president.

December 12th, 2007 at 12:24 pmThe “Odd” thing about the ACLU is they support The Constitution of the US. I fail to see how they can be criticized for something so basic as to applying the law equally to all.

WOW!!!!! YOU MUST HAVE SUCH A LITTLE DICK!
December 12th, 2007 at 12:38 pmThe new and improved DOJ ???
MuKasey..”I think the Justice Department is capable of doing whatever it appears needs to be done,” Mukasey said. “The question of a special prosecutor is the most hypothetical of hypotheticals, and that isn’t going to be faced until it happens. And if it has to be, it will be.”
Mukasey may have a conflict of interest problem already, and may have to call upon a Special Prosecutor.
Jose Padilla’s lawyers argued before the Florida Federal Court that Abu Zubaydah was tortured into saying Padilla was an al Qaeda associate. The DOJ dismissed Padilla’s allegations as “meritless,†asserting Padilla’s legal team could not prove that Abu Zubaydah had been tortured. Well, it’s clear now that they certainly COULD have, if the tapes of the interrogations of Abu Zubaydah had been made available!
Now here is where Mukasey’s role comes into question. U.S. District Judge Mukasey, now attorney general, was the one who signed the warrant used by the FBI to arrest Padilla in May 2002. Court records show the warrant relied in part on information obtained from Abu Zubaydah’s interrogation. So we have a problem Houston.
The Attorney General can only issue a warrant based upon legally obtained evidence, and confessions under torture are certainly not “legally obtainedâ€. So either Mukasey was misrepresented the evidence, and would be liable to be potentially a party in those who were presented with “perjured evidenceâ€; or he knew that torture was used in obtaining the confession and ignored it.
In either case he is unsuitable to run an investigation, as it will, inevitably, involved himself. Thus a Special Prosecutor is necessary.

Comment by JD Murphy — December 12, 2007 @ 12:02 pm
Normally I ignore this type of post as just a faint buzzing sound from a troll attempting to say something inflammatory to derail the thread. But this blather is so over the top (and it’s been a slow morning), so I’ll respond.
“ACLU is a terrorst (sic) group.”
– And you are basing this accusation on…what? Who or what have they bombed recently — no, make that EVER? Has the term “terrorist” joined “Communist” and “liberal” on the list of words-that-used-to-have-meaning-but-are-now-just-randomly-hurled-as-insults?
“They all live with their parents…”
– It’s possible that some of the younger ones do. Many teens put aside their video games to get involved in causes they deem important to the world and to their future. The ACLU, like many non-profit organizations, benefit from young volunteers to help on telephones, mass mailings, etc. As far as the adults in the organization go, I’m not aware of any statistical information regarding their living status.
“…and hold GEDs and degrees public schools.”
– This clause makes no sense. I assume you are slamming people who have GEDs and/or have received a public school education. In the first place, many people in the ACLU (and ALL of their lawyers) are professionals with advanced degrees. In the second place, a public school education isn’t necessarily a bad thing. I received a public school education (and no college), yet I can construct a clause with proper grammar and spelling, which is more than you can do.
“They are not the 21st centry (sic).”
December 12th, 2007 at 12:46 pm– Au contraire. They are every bit as relevant in the 21st century as they were in the 20th. Protecting the civil rights of all Americans and defending the U.S. Constitution never goes out of style.
