Huckabee would criminalize abortion and punish doctors.

Also during his Meet The Press appearance today, former Arkansas Governor Mike Huckabee said that as President he would seek to “find some way to sanction” doctors “who took money to provide abortions to women if he succeeded in outlawing the procedure.” “I don’t know that you’d put him in prison,” added Huckabee. He said that he would “not support penalizing women who sought abortions even if they were outlawed” because he considers a woman who seeks an abortion to be “a victim, not a criminal.”

UPDATE: A recent study by the Guttmacher Institute and the World Health Organization found that criminalization is ineffective in lowering abortions, and that the procedure is most “dangerous in countries where it was outlawed and performed clandestinely.”

    As in the previous thread, I'm still curious if 'ol Huck thinks that the doctors who oversaw the torure of prisoners also meets his criterion for doctors who've abrogated their hippocratic oaths, and so should be prosecuted.

    I think he considers women to be so helpless that they have no real control over the situation. Obviously, the woman didn't really want to have sex but was unable to prevent the big mean man from having his wicked way with her.

    Ok, I'm not sure I understand his logic. A woman who seeks out a doctor to perform an abortion is a "victim" and the doctor is a "criminal"? If abortion were to be outlawed, it seems to me that they would both be committing a criminal act.

    Huckabee's thought processes are pretty scary. I fear for this country if this person were to be elected as our President.

    Besides, the Republiscums would never tolerate outlawing abortions. That would take away their primary wedge issue that they use to keep the uninformed on their side of the fence. Without the abortion boogyman, many in the heartland would finally realize that voting Republican IS NOT in their own best interest.

    Acceptance of gays is becoming more and more mainstream so making the brown people into boogymen will become more and more important for the Republiscums if they were able to outlaw abortion.     As usual, JMH is lying. There is nothing in that article about Democratic poll numbers, it's all in his imagination. The article is about a possible independent bid by Bloomberg. I'm all for that. A Bloomberg/Hagel ticket would pull a lot more voters from the Republiscum side than the Democratic side.

    As far as the public feeling Hawkish...dream on troll. Do you have a crystal ball that can see what the public is thinking? Since it has only been a few days since Bhutto was assassinated, it is not apparent yet if it will affect our politics in any way.

    James Carville, in a book released a couple years ago, cited that >88% of the American public want to restrict abortion to situations of health of the mother, rape and incest. I would add viability of the fetus to that list.

    If abortions were restricted to the list above, and a doctor / patient violate that restriction then:

    1) doctor should lose his / her license
    2) doctor should be prosecuted and sentenced in accordance with existing euthanasia laws
    3) patient should be prosecuted and sentenced in accordance with conspiracy / aiding in euthanasia laws

    You're numbers are misleading. The Democrats had like a 100 seat advantage in the House and like a 30+ seat advantage in the Senate.

    Most of the congressman and women who voted for the legislation were Democrats. Most of the people who voted against the legislation were from the South and party affiliation didn't matter.

    Thanks for being on topic! How do we know if the woman is raped? If she accuses a man of rape, and he is found not guilty in a court of law, do we then punish the doctor who performed the abortion? Who decides the viability of the fetus? If the doctor claims the fetus is not viable, but then another doctor reviews it later and says the fetus was viable, what then? How long should a woman spend in prison for having an abortion? Also, Roe v Wade was based on the right to privacy, so we would have to re-evaluate that law. Then there is the issue of state's rights, as most states had abortion laws on the books prior to Roe v Wade. Are you starting to see what a quagmire this would be?

    Most of the people who voted for the legislation were Democrats. The republicans had a higher percentage because of their abysmal numbers in the Congress and they had virtually no congressmen in the South. Most congressmen in the North whether they were Democrat or republican voted for the legislation. And virtually all of the Congressmen in South whether they were Democrat or republican voted against the legislation.

    As technology advances, viability will decrease. It won't change my opinion about abortion though. A fetus shouldn't take precedence over the women who's carrying it.

    I don't know. I guess it would depend on whether the women was planning on carrying the fetus to term.

    They love the fetus and hate the child. They want to force women to bear children they can't afford and then when the woman can't afford to feed and clothe the child they say "too bad so sad". And you are correct, I suspect the reason why most neocons are anti choice is because they don't want to see all that cannon fodder flushed down the drain. Since a very large part of our all volunteer army are children from poor families who join the military in a desperate attempt to find a way out of their poverty, they don't want to see women abort the potential cannon fodder.

    My mom, now deceased, was dating a guy back in the '60s, after my father died. She became pregnant by this fellow and subsequently learned that he was married (after he had asked her to marry him). I was 4 y.o. at the time.

    After admitting that he was married, the fellow told my mom to meet 2 fellows on a street corner in ton, and that they would "take care of the problem".

    She was driven to a house in the country, where these two goons gave her a coat hanger abortion. She told me that she wished she would have died, but that she had my sister and I to think about. at that time, we lived in government housing projects in Washington DC.

    My mother related this information to me when I was 40 years old.

    I have only this to say in relation to your comments: May your wishes regarding legalized abortion come to pass, and may your sister or daughter undergo the dangerous and horrific procedure my mother did. It would be just and fitting.

    I actually remember the period of my life when this series of events transpired, largely due to the fact than my mom told us she wouldn't be getting married.

    When she told me about the experience, she was in her 70s, and I could clearly see the stress in her face (the story was more extensive than I care, or have time, to go into).

    Hendler, the little Nazi, is completely wrong, for many reasons. The real reason abortion should be legal is that it is none of the government's freekin' business what's inside a woman's body that she wants removed (all other arguments are secondary).     many things went wrong and had a few emergencies thrown in:

    2 of the dogs got very sick and required extended vet care,
    my basement floor "flooded" because the outside spigot was left on...
    i spent too much time and energy trying to catching up the lost time...

    but it all turned out fine in the end...
    all space invaders have left, and i'm recovering...

    Good morning, good golly. I don't think it would be necessary to stack the SCOTUS any more to the right than it already is in order to get Roe v. Wade overturned -- if the right case came to them, they'd vote 5-4 to overturn it.

    So why isn't it getting overturned? I think it's because the SCOTUS regards that issue as plutonium. Right now, the pro-choice forces are relatively quiet. Abortion is legal, and there are other issues more pressing. And as long as abortion is legal, this galvanizes critical parts of the GOP base into action necessary to win elections. The LAST thing the SCOTUS wants to do (and the last thing the GOP leadership wants to do) is to overturn Roe v. Wade. This would activate the now-complacent pro-choice forces to a degree that would give all the neocons nightmares. Nah -- they much prefer keeping things the way they are and keeping their wedge issue.

    Another thought -- SCOTUS isn't the only avenue for change (although it's probably the most practical one). If abortion is truly wrong, all Congress has to do is pass a constitutional amendment banning it, and get it ratified by 38 states. If the American people really want it banned, this should be no problem -- right?

    Personally, I predict that if Huckabee is elected POTUS (and I agree that's a long shot), he will ultimately have about as much effect on abortion in this country as Bush has had. There may be a few laws passed here and there banning certain types of abortions (like the "partial-birth" ban under Bush), but Roe v. Wade will stay put.

    I agree there are a lot of people who are "uncomfortable" with abortion. It's not a pleasant thing to think about.     I don't speak for Zooey, and I'm not going to claim I know for sure what she meant by that remark, but I'll tell you how I interpreted it.

    I didn't take her obscenity toward Jesus as a personal attack on Jesus Himself. I saw it as a condemnation with the perverted way that the name of Jesus has been used to defend and justify a lot of things most un-Jesuslike. Like war, greed, bigotry, violence, etc. etc. While I probably would find a less offensive way to express the same sentiment, I can understand the use of an extremely provocative comment like that to get attention.

    The name of Mohammed has also been used to justify some rather unsavory things as well, as 9/11 has shown. If someone here said "F Mohammed", I would probably interpret it the same way, unless it came from someone who had known hatred against all things Islam.

    Don’t believe you can support this statement from the Bible. As we Conservative Christians say: “You’ll need a book, chapter, and verse on this one.”

    If you can support this statement from the Bible I’d appreciate it. Otherwise, I’ll simply read it as, “My opinion is that Jesus agrees with my opinion.”

    Please remember Jesus says in Matthew 22 that the greatest commandment is to love God and that the second greatest command is to love you neighbor as you love yourself. In these he suggests that you can’t do the second one without doing the first one.

    Then Christ says that all the law and prophets hang on these commands. All the law would include the Leviticus prohibition of illicit sexual relationships including adultery and homosexuality.

    This strikes me as rather conservative.

    I think we may be onto something here. Not only would I like a refund of any tax money of mine that has gone to fighting stupid wars, but I'd like a refund of my portion of both Bush's and Cheney's salaries and government paid perks, as I don't think either one of them has met my expectations in their current offices. Oh, and I'd like a refund of all government money that has gone to corporate welfare, as I find that to be immoral. I'd just as soon have my tax money fund birth control and family planning so hopefully there will be fewer abortions while keeping them safe and legal.

    Perhaps we could institute a "cafeteria" style of tax payments in this country. Everybody would pay the same amount in taxes as they do now, but they get to decide where their money goes. And if not enough people want to fund attacking another country, we don't do it.

    I understand why this would trouble people, but you do realize that he couldn't do this, right? The Supreme Court has said that women have a right to have an abortion to the extent that the fetus isn't viable outside the womb. The only way that a president could do this is to put more conservative people on the supreme court that could change the basis of roe v wade. Moreover, Congress is the body of our government that makes laws so Huckabee, or any other president for that matter, couldn't do this. Sure, presidents can make executive orders, but they couldn't make one that passes a new law. You people should learn more about government before you get so upset.

    I am not saying that the guy is a good candidate. I don't know if he is or isn't. I am simply saying that he couldn't do this if he was elected. He would need at least one of the other branches of government.

    I'm not sure how all this posting about Jesus got started, but as much of it I read by the poster Bartelbee made perfect sense to me. Low-browed folks like Huckabee tend to wrap themselves in the cross and the flag to gain political advantage, and forget what the centerpiece of their religion actually stood for. I mean, what was the point of starting a new religion under Jesus when his followers want to just follow the old testament?

    This thread was about abortion, so getting back to that, I found the recent post by bneals to be extremely naive to the matter. First of all, there already IS enough conservatives on the Supreme Court to overture Roe V Wade. Roberts won't do it though, because that would galvanize the opposition. He considers it settled law. However, that doesn't prevent the states from flouting the law and making abortion illegal, which has been going on. It doesn't prevent laws to make it difficult for an under 18 pregnant female to get a legal abortion by traveling to a city which provides the service, if she crosses state lines. If she travels with her aunt, the aunt goes to jail. There are laws which intrude on the privacy of the decision as well, such as required a woman to tell her husband, or a girl to tell her parents. (This is designed to set up obsticles and opposition to the woman, to make it difficult or impossible to go through with the decision). There are waiting periods too, and requirements to show women ultrasounds of their fetus and have nurses look at them judgeingly and shame them into having the baby. Presidents can make things very, very difficult for women and doctors and it all started with Reagan.

    As a woman who lived through the enlightened 70's, it is difficult to witness these spanish-inquisition-type practices and political stances. It is difficult and shocking to see a day dawn where states are making it illegal or difficult to obtain abortions, or even obtain the pill. The question in the 70's was when will insurance companies start paying for the pill for us. Now the question seems to be will we even have the RIGHT to access to the pill or to accurate information. It's all falling away, and it's a damn shame that politicians like Huckabee can openly discuss putting doctors in jail and putting women back in the victim mode without a large, public backlash that would drive him back into the corners of ignorance from whence he came.

    I agree with gummitch who said:

    "I’m not sure which is worse, this belief (that women are children who are incapable of making sexual decisions) or the belief that women are the source of all Sin."

    These kinds of beliefs, made openly by folks like Huckabee, have a profound affect on the culture and directly impact the social choices that women have. It's about more than the law and the conservatives know that. They know if you twist the culture, the laws become almost irrelevant.
