Britain ‘Concerned’ Over U.S. Use Of Torture Evidence In 9/11 Trials

miliband.gif Yesterday, military prosecutors announced that they have filed death penalty charges against six detainees for their roles in the 9/11 attacks. One of these men, Khalid Sheikh Mohammad, has been confirmed to have been waterboarded.

Attorney General Mike Mukasey has also refused to rule out using this evidence in court, saying, “What evidence gets presented at this trial is up to the prosecutors.”

But today on BBC Radio, UK Foreign Secretary David Miliband broke with the country’s American ally, citing “some concerns” over the use of torture evidence:

Speaking on a BBC programme in response to a question from a listener, Miliband confirmed that the UK defined water-boarding as torture, adding: “We don’t … we would never use water-boarding.” [...]

“And I think it’s very, very important that we always assert that our system of values is different from those who attacked the US and killed British citizens on September 11, and that’s something we’d always want to stand up for.”

Asked whether the trial of Mohammed would respect his legal rights, Miliband replied: “We have some concerns about that.”

With the departure of former prime minister Tony Blair, Britain has become increasingly willing to speak out against U.S. policies. British newspapers have appeared “eager” and enthusiastic for the end of Bush’s presidency. Prince Andrew, who is fourth in line to the British throne, recently “launched a sharp attack” against Bush for “failing to listen to Britain during the conflict in Iraq.” Britain has also pushed for the closure of Guantanamo Bay.

On CNN last night, Charles Swift, who represented Salim Hamdan in the case Hamdan v. Rumsfeld, said that the last time waterboarding evidence was used in trial was during the Spanish Inquisition.

    The world is waking up to our governments criminal activities and will start to call Bushco out on it.

    It is truly the mark of insane people who would use torture derived evidence against the victim of torture. We are governed by insane people. They have no humanity. Period!

    I believe the world already knows! And it will be very hard for them to call BushCo on it. We have to do that, and make International prosecution possible.

    It is only the leaders of “BushCo believing” countries who believe. The general populations of those countries do not, in my opinion. The change from Bush’s poodle is a good case in point.

    Yes, Merlin, alot of my friends overseas are just amazed that Bush can some how remain in office. But it is good that now some of their leaders are starting to publicly call Bush what he is. Just recently Canada had us on their war crimes watch list, but caved into pressure from Bushco, that was sad, they should have stood up to them.

    Considering the US treatment of the four released UK citizen detainees at Guantanomo – one held for five years, none of them ever charged with anything (and no UK charges levelled at them after release) – I would be inclined to think that some ‘concern’ raised over the obtaining of evidence from 9/11 defendants will be duly dismissed by the US administration.

    Are we in a similar situation here of tidying up loose ends, a la the execution of Saddam Hussein? Perhaps these men will be executed before Bush leaves office – dead men tell no tales after all.

    And, no, no one wants to coddle terrorists, but I sure can’t wait for some Freeper or their family member, inevitably caught up in Fascist U.S. and listen to em squeal. Has already happened a few times. Poor babies. Be careful what you wish for.

    I am all for the death penalty for those linked to the 9/11 attacks. Of course, these are not the guys that were involved. These guys are the patsies. I think we know who is linked to the 9/11 attacks.
