Supreme Court rejects warrantless wiretapping case.

The Supreme Court “has rejected a challenge to the Bush administration’s domestic spying program” brought forth by the American Civil Liberties Union. The court offered “no comment explaining why they turned down the appeal,” which seeks to allow a lawsuit over the warrantless wiretapping program. It was dismissed by a lower court “because the plaintiffs cannot prove their communications have been monitored.”

On the contrary. It would have been short-sighted of anyone with a reasonably mature sense of the world and one’s place in it.

For Bush, an infantile, self-absorbed psychopath (I’m guessing here) of demonstrated arrested development, it fits perfectly into his pattern.

I don’t want to sound condesending but the answer is yes. bush appointees have pushed the supreme court so far to the right with unscrupulous appointees that will obviously protect the lawbreakers. It was already close before the election…..otherwise shrub would never have been appointed.

Who was the lower court judge that rejected the case making it easier for the SC to do the same? Want to bet Gonzo put him in there in this is still part of the same politicizing of justice that he hasn’t been made to answer for yet.

  29. Dumb_Fox says:

Well, whilst I wouldn’t like to miss an opportunity to bash the Roberts Supreme Court, I’d be interested to see their comments here.

The issue is whether the plaintiffs have standing, and this is not a trivial matter because frivolous complaints would overwhelm the system if the courts don’t take a firm line on legal standing.

And actually, because the substance of the issue is whether the President broke the law when it came to warrantless wiretapping, this issue ought to be resolved via impeachment proceedings. At least that’s how the Framers intended the system to work. Not everything belongs in the SCOTUS, and in this case Congress might be more deserving of criticism.

  30. dogjudge says:

    #29 Agreed

While we would all like to have the Supreme Court rule on the wiretapping issue they do have to follow the rules of law.

Unfortunately, even if they found someone with standing, the administration would fight the issue because it would require the release of information that would harm the security of the nation.

Something wrong in our system when an obvious threat to the Constitution can be circumvented.

And if the impossible happened, and he did get elected, what makes you think that he’s going to undo much of Bushes policy? ALL politicians are criminal, REGARDLESS of party affiliation.

Did everybody forget that we have Bill Clinton, a Democrat, to thank for NAFTA and media deregualtion?

Not to mention that it sounds like you don’t really understand how “signing statements” actually work anyway.

  34. Democrat Soldier says:

The ACLU should have used the exact same argument that the Bush Administration used to attack Iraq:

the absence of proof does NOT mean proof of absence!

They should have argued that the Bush Administration should have to prove they DID’NT illegally wiretap the people filing the lawsuit! It worked so well to let Pres. Bush invade another country, it shoudl work just as well to force the Bush Administration to be held accountable for their actions!

  35. whatevah says:

Do we have constitutional rights or not? If our SCOTUS will not uphold them, then they deserve to be fired. Position for life can change, as well, and perhaps should change when they fail to uphold the Constitution of this country. Ah, but you’re making an assumption that the American people will believe Obama is Muslim when he isn’t. You can send around all the evil e-mails you want, participate in all the whispering campaigns you want, but Americans know that Obama is a good man and they will make their choice based on the issues. The only people who will believe he’s a Muslim terrorist (or a Muslim of any kind) are in the 28% who would never vote for him anyway.

I predict that as we get closer to November (especially after Obama gets the nomination if he does), we will be seeing a lot more of the “B. Hussein Obama” and “Osama-Obama” references, as well as a lot more recycling of the “madrassa” story, even though that has been thoroughly debunked.

None of that will fly. It will just be preaching to a small, mentally arthritic choir.

I personally hope that the day will come when being an American Muslim is just as acceptable as being an American Jew, an American Catholic, and American Mormon, or an American anything else.

  128. nanlichi says:

Shayne, I bet JPV has a lover. If he is as frustrated as he appears, it’s probably his right hand though.

Wonder if he’s ambidexterous or monogamous?

Does the right hand know what the left does?

  129. Innocent Bystander says:

“I personally hope that the day will come when being an American Muslim is just as acceptable as being an American Jew, an American Catholic, and American Mormon, or an American anything else.”

That day will come, Miss Molly. Just like 40 years ago, the ChiComs were the scary people that the Right feared. I can remember the “we have to fight them there or we’ll be fighting them here” refrain from way back then to justify our continued immoral war in VietNam. Once we left, the world didn’t end and now they are the Right’s favorite business partners.

The biggest fear that these trolls and the 28%er’s have is that this Bush GWOT will be found out to be as morally bankrupt fraud that we know it is. That will happen when a new Democratic President, backed by a clear Democratic majority, starts looking into how Republicans used the fear of brown-skinned people to drain our Treasury of $1 Trillion dollars.

Seriously, does anyone really fear some radical terrorists more than say, a Katrina sized hurricane or earthquake that can kill thousands and destroy billions of dollars in a matter of minutes?

    * phrase courtesy of Naomi Wolf, from her MUST READ by all world citizens, The End of America– Letter of Warning to a Young Patriot

Nearly finished it. The contents of this book should stun EVERY American, no matter what party affiliation, who believes in the tenants of American Democracy as laid out in our Constitution, especially the Bill of Rights.

This rejection to even hear the case is setting the course for a closed society. That is how fascism begins.

  132. bs says:

why should anyone be surprised by this. i have been saying this for ever on here when you want to scream sue em, take em to court, charge em. folks yes in the fair world that would happen and yes that is what the majority of the american folks want but we are not ruling the USA. this is way bigger than bush and all of his criminial counterparts. all of em will go without any punishment. follow the money and it will take you to the zionists……who own it all and have infiltrated their way into american politics for decades to do just this……NWO.

Hmmmm, I am sure there are cases of this, do not THESE individuals have cause to sue?

Brilliant logic – deal with that Catch-22 people!!!!!!!!!

  138. bilbobaggins says:

It was dismissed by a lower court “because the plaintiffs cannot prove their communications have been monitored.”

Talk about a catch 22. Nice punt Supremes. Want to bet the vote was 5-4. To anyone out there even considering voting Republican, think about the Supreme court. We’re stuck with these right wing ideologues for a very long time. We don’t need any more.

  139. bilbobaggins says:

And yeah, I’m aware that Obama is a CONVERT to Christianity. Me calling him a Muslim, is a sarcastic take on the rhetoric that I believe will eventually be lobed at him by the Right Wing.
Sorry if my sarcasm wasn’t clear.
    Comment by JPV

Obama is not a convert to Christianity. It’s all he has ever been. In order for him to be a convert, he needed to be something else before he became a Christian. He was never a Muslim. I don’t know about everyone else, I am not buying that JPV was being sarcastic nor am I buying that he is really a progressive.

  140. tombaker says:

The babylonian captivity of the supreme court has come about by design, a design created by the Republican Party to affect a coup, and it has succeeded. It was obvious they were working on this when Raygun was Pres.. Impeaching Scalia and overturning W’s 2 appointments is the only conceivable remedy, and that’s not likely to happen.

IF a D is elected Pres., no appointments to the scotus will be permitted by the R’s, just like they did when clinton was in office. They will bide their time, while they blame the new D Pres. for everything that’s ever been wrong on earth. The sucker-headed public will buy that line, elect another R in ‘12, and that Pres. will complete the transformation of the scotus into an permanent wing of the R party (which statistically it already is).

R appointees to the bench have no qualms whatever about lying to congress. R’s have internalized “game theory” to the extent they’ve completely lost touch with reality, so “lying” is not really lying to them anymore. Roberts and Alito both lied through their teeth in their confirmation hearings. All of W’s Attorneys General have lied with complete abandon. The public is too stupid to notice, the press is too cynical to care, so we end up with a political party in exclusive control of the Law of the Land.

A legitimate Attorney General, and a legitimate Supreme Court would have the Republican Party indicted and tried under racketeering statutes. Never has more ciminal activity taken place in broad daylight without attention from Law Enforcement.

Some Martin Luther from the Bar Association desperately needs to make him/herself the spokesperson for a radical Reformation of the high court. Then the public needs a hardcore refresher course on the Constitution and how our Government is supposed to work, and then, maybe, we won’t be completely screwed any longer.

Sorry for the longwinded post, but this is one I’ve seen coming for a very long time. We’re just scratching the surface on the kind of damage this court can and will do.

  141. The Shadow says:

The Supreme Court has become a tool of the Republican party rather than a just court where all can go for justice. The so called conservatives don’t seem to understand that they are the final aribitors and not just a wing of the party. They have violated the oath they took to protect and observe the constitution. There is no difference between them and Sadams fake courts or the Nazi judges who put Nazism first and justice second.

I’m sure there are some fools who still believe they are fair, but real justice died the day Scalia, Thomas, Alito, and Roberts became the gang of 4 plus one. I have absolutely no respect for Scalia at all and very very little for Roberts and the rest of the republicans. They follow marching orders from the federalist society and fox news.

  142. cowboys5 says:

It always amazes me when the lunatic left whines when their hypocrisy is proven by the “right wing crazies”. The Supreme court was decidedly left in 2000 when Algore was combed out of Uncle Sam’s beard. The ultra-lunatic 9th Circuit ruled in EXACTLY the same way as the Supreme Court just did…but none of you nuts mention that. The Democrat majority Senate just passed the Telecom immunity bill…but none of you nuts mentioned that. Hillary, Kennedy, Reid, et. al. ALL supported the war and have voted for continued funding ever since. Obama himself has stated that he “would set a goal for removing troops by 2009…but will not be held to that”. Hillary (and slick-Willie, for that matter) have both ranted about “Bush’s War” but have voted to stay and/or surge every time. Google the word ‘hypocrisy’…you will see a mirror! I guess when your ideology is as flawed as the Lib’s is, all you have to fall back on is hypocrisy, whining and, of course, infantile and senseless rage. Rock on Roberts and Co.!!

  143. cowboys5 says:

Oh yeah, before I forget…isn’t it interesting that neither Hillary or Obama has mentioned word one about dismantling this so-called “illegal” wire-tapping program. Why do you nuts think that is? Neither has Kennedy, Reid or any of the rest of the whackos that have ranted about this program all this time! Interesting how hypocrites’ words and actions are diametrically opposed to each other…that being, after all, the definition of hypocrite. Wouldn’t it be cool if Souter kicks off in the next couple of months and W gets one more on the bench before the year is out??!! We can but dream…
