Perino To Reporters: ‘From Where I Stand And The Questions I Get,’ You Are Clueless About FISA»

During today’s White House press briefing, spokeswoman Dana Perino announced that the Bush administration will be holding a “background briefing” on wiretapping this afternoon. Resisting their calls to have the briefing on the record, Perino claimed that it was for reporters to “understand the complexities of the issue and where we stand.”

The briefing, however, seems intended to brainwash reporters with White House talking points, rather than clear up any so-called “confusion.” Reporters quickly said that they are “quite clear” on the White House’s positions and the facts. Perino then snidely replied, “I don’t think so.” From today’s exchange:

QUESTION: I mean, the president’s made quite clear his position on retroactive liability and so on and so forth. I mean, what specifically is the point of confusion that you might be trying to address?

PERINO: I could go back to yesterday’s transcript. … There’s confusion as to what — what are the implications and the consequences of not having the Protect America Act. […]

PERINO: From where I stand and the questions that I get, no. I don’t think so.

Perino pointed to the transcript of yesterday’s briefing as evidence of the reporters’ ignorance. The only one who appeared confused by the facts, however, was Perino.

Yesterday, Perino repeatedly claimed that because Congress refused to pass the administration’s version of the Protect America Act, U.S. intelligence collection was impaired. One reporter pointed out, “You’re still collecting intelligence.” Another charged that the government’s wiretap orders will last until at least August. Someone else stated that new targets can be pursued “as long as you come back within three days and get a warrant under FISA.”

Perino eventually gave up and responded with equivocations such as, “I’m not a lawyer” and “It’s a little bit more complex than that.” Seems like she’s the one who needs the “background briefing.”

QUESTION: Finally, on FISA, could you just talk about what’s behind this afternoon’s background briefing?

Is there something specific that prompted that?

Because the president’s made quite clear his position on retroactive…

PERINO: Here’s what’s prompted it, actually. In my experience, having been following this issue for a long time and quite intensely, I think it is a very complex issue.

PERINO: And I believe that people here think that they would like to learn more about this issue so that they can have more background and understand the complexities of the issue and where we stand and the positions that the Department of Justice and the — I’m sorry — the director of national intelligence have taken. We thought it would be something that we should provide to you.

QUESTION: I mean, the president’s made quite clear his position on retroactive liability and so on and so forth. I mean, what specifically is the point of confusion that you might be trying to address?

PERINO: I could go back to yesterday’s transcript. There’s a lot of issues in terms of — this law has been in place since 1978. There’s a lot of history here with this law. There’s a lot that’s happened between April of 2007 and August of 2007 when the Protect America Act first passed. There’s confusion as to what — what are the implications and the consequences of not having the Protect America Act.

Now, I am not a lawyer. And this is a highly legal issue. You also have people at Department of Justice and the director of national intelligence who are directly working with the general counsel of the telecommunications companies that we need to have working with us. And they’re the ones that are in communication with them and understand their concerns and their needs.

And so this is an opportunity if people want to attend to get more information about that.

QUESTION: (OFF-MIKE) on the record?

PERINO: These are lawyers who — I’m on the record all the time. The attorney general and the director of national intelligence, who is testifying tomorrow, will be on the record.

This is background for your information and for your education. And if you want to attend, that would be great.

It’s clear that she, Dana Perino, doesn’t have a clue about the FISA wiretapping laws, their history, and why what Bush has done is illegal - for which HE is seeking retroactive immunity. That’s the true nut of it all. It’s not about protecting our telecoms; it’s about protecting Bush from prison in the future. The damage control has always been about keeping Herr Bush out of jail and from losing his empire to lawsuits which are sure to be filed against him personally.

    Quite the contrary, Mark C. Many of us do know precisely what the FISA act is all about, where the boundaries are, and what constitutes a violation called “warrantless” and therefore “illegal” wiretapping.

    The spin about not being able to gather intel is pure bush bull$hit. Everyone knows that he can begin wiretapping for 3 days without a warrant but then MUST go to FISA to plead his case. So that argument is nonsense- pure nonsense.

You don’t have to be a lawyer to understand that FISA in its current form permits 72-hour retroactive warrants! You don’t have to be a lawyer to understand that FIVE out of 16,000 requests for warrants have been refused since 1978!

    And you DAMNED sure don’t have to be a lawyer to recognize that, if what the telecoms are doing is legal (which it is under current FISA law if a warrant has been obtained–immunity is automatic), then they don’t need immunity. They will be able to defend themselves successfully in a court of law. If they do need immunity, however, what they are doing is, ipso facto, ILLEGAL!

    Don’t cast this as a complex issue that’s beyond the grasp of so-called “ordinary” Americans. If YOU can understand it, Perino, it must indeed be simple.

Warrantless wiretapping is a violation of the law unless, within 72 hours of the onset of the tap, a warrant is applied for in the FISA court. What’s so complex about that?

Professional investigators know that constant sipping at your water glass usually is symbolic of problems with the throat chakra - our communication chakra. So each time she lies or covers up or spouts off half truths while knowing that she’s being dishonest, chaos takes place on a cellular level.     the reopening of the 911 commission will occur and sooner than later. There’s just far too much contradiction, mounting scientific evidence, and now we find that there was intelligence gathering prior to 911 and it still occurred. Why would that be so if our intelligence is so great and necessary? Because we capitalized on that intelligence instead of doing something about it. We used those 52 warnings which were received to feather the nest of the fascist architects - PNAC. In Bush’s own words, in order to get the Patriot Act enacted, we would have to have “A New Pearl Harbor”….David Ray Griffin’s book “A New Pearl Harbor” is a good starting point.

    I had read the fact sheet Dana. The fact is this Protect America Act Modernizes The Foreign Intelligence Surveillance Act (FISA) and does not replace it or cause it to stop working. It Modernizes it. The modernisation give the government the ability not to have to get warrants for on foreign targets in foreign lands. If the act is not passed by Bush it still gives him 3 days to get a warrant, this is apparent by the WH sites fact sheet.

    Enough of the fear factor bullying. Its unAmerican.

    If as I believe the immunity thing is more about protecting the Administration then the Telcos, how about a nice compromise. The Telco’s don’t get immunity, but the damages are capped at say $10 million.

    This would allow the cases to go ahead with no ‘risk” to the viability of the Telco’s.

    If Bush turns this down, then we know the real agenda.

    Oh, Dana. You think you are so smart and witty.

    You have had 2 years to explain why you can’t go to the FISA court for a warrant when it involves a domestic-to-international call, yet you have no problem going to the court for a domestic-domestic call.

    It has been said that it takes 200 man hours to assemble a warrant in the first scenario. So how long does it take to assemble a warrant in the second? 2 hours? Why the difference?

    Frankly, darling, I think that the answers are very simple. It’s just that you want to take something simple and make it difficult so that you don’t have to answer. I guarantee there are more than a handful of administration hacks burning the midnight oil in order to do just that.

    Congress offered to amend FISA after 9/11 so that it would make it easier (and legal) for you to wiretap terrorists, but you turned them down, and directly proceeded to break the law anyway.
