DoJ refuses to enforce contempt citations.

Today, Attorney General Michael Mukasey “rejected referring the House’s contempt citations against two of President Bush’s top aides to a federal grand jury. Mukasey says they committed no crime.” Mukasey claimed that White House Chief of Staff Josh Bolten and former counsel Harriet Miers “were right” to ignore Congress’s subpoenas in the U.S. attorney scandal.

UPDATE: House Speaker Nancy Pelosi (D-CA) outlines the next steps:

Anticipating this response from the Administration, the House has already provided authority for the Judiciary Committee to file a civil enforcement action in federal district court and the House shall do so promptly.

    Do these idiots have any idea what kind of a precedent they are setting? Do they really want to give a Democratic president that kind of power? Do they really want to see Democratic presidents telling anyone who has anything to do with the White House that they can ignore a subpoena?

    Just think about what the Republicans would have done if Clinton had told his aides to ignore the subpoenas issued to them. They would have screamed bloody murder. Why aren't the Democrats screaming bloody murder?

Once Bush is gone, can't all the crooks in the Bushcista regime ultimately be required to provide testimony and evidence before congress and or in a court of law?

Do some research and some reading (yeah, I know, it's tedious sometimes, but necessary) to find out what they actually have in mind for us and for them.     Precisely the issue. And once again we confront the issue of separation of powers. Justice Dept. equals Executive Branch. Courts are part of the Judicial Branch. This is the "Unitary Executive" b.s. in action, otherwise known as a dictatorship. And Pelosi is going to push a "civil suit?" The same Pelosi that took impeachment "off the table." I call bullshit!!!!!

    #1, Don't go counting on a Democratic administration getting in. The election is more than 8 months away. So much can happen, and Repubs haven't begun what is going to be the fight of their lives. If they don't win outright, there's always stealing or martial law.

    #2, The time for taking this up, for all investigations that should have led to impeachment, was once Dems took control of Congress after the 06 elections.

    Even without 60 votes in the Senate, Dems have had control of the apparatus to hold hearings and investigations. Dems should have been talking about Repub crimes until Bush's low numbers were also Repubs' low numbers. They haven't. It reminds me of 1992. When Bill Clinton first got into the White House, he supposedly made a deal to not pursue Iran-Contra. It was the same "look forward, not back" rhetoric we hear from Pelosi and the Dems today.

    Pelosi announced that impeachment was off the table BEFORE the 06 elections. What kind of leverage is that? When the Dems came back after those elections, in the majority, they've spent their time running for the 08 elections. They've held next to no hearings, spacing them out weeks and months apart. They've gotten nothing done legislatively (you can take Pelosi's ethics bills and flush them - lobbyists and representatives have found new loopholes to do everything they were doing before).

    These are not good people. None of them. Okay, a few are. But just because they have good haircuts and dress well and say the right words, doesn't mean that they're honest, good and well-meaning people. They're not. They're not in politics as public service - This is a career that feeds a drive for power and wealth. Big egos.

    Just think back to high school, and the pompous asses who ran for student body office and joined clubs because it would look good on their college applications. D.C. is a club, and they're loyal to keeping themselves in the club. The way to do it is with big money, from the big corps. We, the people, factor in only as a chore, to be lied to, spun, in order to get enough of our votes every couple or few years. Most politicians hate their constituents' guts. The David Obey YouTube tape says it all.

    Get involved in the Dem Party local to you, get rid of these politicians, put real people in their place. Smart people, who don't see politics as a career, but as their civic duty, a turn they take, like going into the Peace Corps. If it's not too late. Between global warming, the polluted environment, the imminent economic depression, the diminishing resources (oil, timber, food and water) and the coming resource wars, it's probably already too late to save the U.S. and life on the planet as we know it.

    Lets get real folks.

    Here’s how it really went down.

    House Speaker Nancy Pelosi (D-CA) begged Attorney General Michael Mukasey and DC U.S. Attorney Jeff Taylor “for a grand jury investigation into whether White House chief of staff Josh Bolten and former counsel Harriet Miers should be prosecuted for contempt of Congress.”

    Both Mukasey and Taylor replied to Pelosi stating “screw you”.

    Pelosi replied back stating “thank you sirs, which positions do you like most”?

    Pelosi said the House would file a civil suit seeking seeking enforcment of the contempt citations if federal prosecutors declined to seek misdemeanor charges against Bolten and Miers.

    Once again Pelosi doesn't have a clue who actually runs the Justice Department.

    It's not Mukasey, it's the Federal Judges George Dubya has appointed in his six years of terror.

    So, Pelosi and her posse will file a civil lawsuit against Bolten and Meirs.

    The case will be taken by one of George Dubya's lackeys.

    George Dubya's lackey (judge) will determine that "Bolten and former counsel Harriet Miers “were right to ignore Congress’s subpoenas in the U.S. attorney scandal".

    And life through the looking glass goes on.

    Not only should the Sergeant at Arms should arrest these criminals in the early morning hours on Monday. We had spies in those days who were always able to say just the "right things," but also said odd and divisive things. How come I can sit here with virtually no news coverage and still know that Mukasey lied when he said he would be independent. First of all, Miers was not a member of the WH staff when called to testify. Bolten was subpoenaed for documents, millions of which have been "lost" in the Bush fog--but that's another story. Let's cheer on this effort to uphold the law. Oh, and maybe those congressmen who were about to impeach Gonzales and are former US attorneys should take a look at Mukasey. His son is a partner in Giuliani's law firm which is representing Verizon (see warrantless wiretapping cases). Don't believe me? Check it out.

    I'm of your generation, too, protested that war, too, but I'm not sure I understand your point.

    I can give you citations to all of the points I made, if you think I'm a plant, a "spy".

    The Clinton-Bush-Iran-Contra deal has been discussed widely in the leftwing media (Thom Hartmann, Robert Parry).

    Should I go through the hearings that have been held and dropped since January '07? CIA leak investigation, Valerie Plame testified, and then what? The US Attorneys hearing, Karl Rove refused to testify, and then what? The Conyers' hearings (1 per every 6 months) voted on this, what? Two weeks ago? Pelosi got around to it yesterday, and gave Mukasey a week to reply? Mukasey took advantage of "Put out the trash Friday" today to drop it back into her lap and bury it.

    Pelosi took impeachment off the table before the November, 06 election.

    Am I misunderstanding your point?

How sad for our Democracy, but I'm sure Mr. Cheney put an extra glob of vaseline in his palm tonight to enjoy the moment -- oh baby, not too fast. This is really the high point of his administration. In his part-time role in the OVP, he has manipulated the machinery of government to create a branch of government that is beyond any checks. He's created a monarchy.     Just to clear up the record: neither Senators nor Representatives can be "impeached." That is reserved for members of the Executive and Judicial branches.

    Each house shall be the judge of the qualifications of its members. Senators and Reps can be kicked out of office by their peers, but don't hold your breath.

    No, it was supposed to be on, as advertised. But what they ran was a repeat of the Ohio Democratic debate. I sure hope Keith is OK. I would hate to lose his voice.

In the hinterlands everyone recognized that Mukasey was nothing more than a Republican yes man, committed to the Unitary President. Schummer felt otherwise. Now we know who was right. To paraphrase a line from Indiana Jones "Congress didn't choose wisely."

    Its called NHERENT CONTEMPT! They can bypass DoJ and Mukasey. They have a mechanism already in place to force Miers and Bolton to testify. Why won't they use it, instead of wasting time and taxpayers' money filing lawsuits that also will not work (beings Bush has a lock on the judges..).

    Any persons who swear to uphold the Constitution, as these folks under investigation did, and willingly trample all over it under cloak and night are STEALING their salary! They need to testify even if Congress politely asks them without a subpoena, they're paid to be truthful and open (in theory).

    Mukasey as well.

    Good question. Furthermore, can’t the next president also just say there’s no “executive privilege” covering any such materials, and then let Congress force the two to testify? If so, and the "benefits" of such "executive privilege" are so easily destroyed, then what good is the “executive privilege” in the first place? Just a CYOA type means of answering to no one (at least while still in office and answerable to public opinion)? If so, let’s be up front about it, and enact that as a statute, or even a Constitutional amendment. More at the link. No kings. Not any more.
