The AP reports that yesterday in federal court, the White House disclosed that older “computer hard drives have been destroyed,” the latest revelation in the controversy surrounding missing White House e-mails from 2003-2005. The White House said that a court proposed e-mail recovery plan stemming from lawsuits brought on by the National Security Archive and CREW would be worthless because “[w]hen workstations are at the end of their lifecycle and retired … the hard drives are generally sent offsite to another government entity for physical destruction.”
(HT: TPM)
Really!
March 22nd, 2008 at 12:02 pmWho is surprised about this?
Oh comeon! They weren’t destroyed until all the bullshit about what this administration is really up to came out.
March 22nd, 2008 at 12:07 pmIn other words, they knowingly and willfully broke the law. Can someone be brought up on charges now?
March 22nd, 2008 at 12:13 pmAh. I didn’t realize that the directive was “you are required to preserve all e-mails and other records as property of the people of the United States — unless, of course, the workstation is at the end of its lifecycle, in which case records may be destroyed.”
Failure to preserve hard drives with records belonging to the people before these records are archived is flagrant flouting of the law. What kind of accountability is going on here? And what is the penalty for this?
March 22nd, 2008 at 12:15 pmAnd exactly who ordered this policy’s implementation? I can hear the excuses now:
“There is no record of who actually ordered the destruction policy”
“The person or persons responsible for ordering this were merely exercising powers granted them as members of the executive branch – but for national security reasons, these officials must remain anonymous.”
“It was the decision of those in charge of this “other government entity” (which shall remain off-the-record for national security reasons) whether or not to actually destroy these hard drives. Ask them about the disposition of these items.”
March 22nd, 2008 at 12:20 pmThis is good
Obama can imprison all republican congress members and nationalize the oil companies and raid FOX news on the first day in office and
they wouldnt be able to stop it…
thanks to the precedents set by chimp.
national security reasons…
so just imagine what else dems can get away with.
now you see how stupid clinton was for actually submitting to a special prosecutor.
clinton should have had ken starr disappeared, and then pardoned the person who did it.
this is the new republican way…
i just hope the rednecks are ready for a democratic monarch.
March 22nd, 2008 at 12:24 pmHey . . when you can get away with murdering 3000 of your own people and subsequently invading a country that posed no threat knowingly based on lies . . what’s a few hard drives ?
March 22nd, 2008 at 12:24 pmMy guess is that they will get away with this completely. The sherriff is their boy and they own the courts. We can only hope that they move along peacefully I fear.
Oliver North after all is still walking free after being convicted in a time of much more accountability…..what hope do you see for justice in these times?
March 22nd, 2008 at 12:26 pmI’m in no mood for Frank M’s petty ankle biting….I flagged him.

Good. Maybe now we can finally get over this non-issue.
Lordy, I hope Frank doesn’t mind, when President Clinton or Obama decides that as long as Bush got away with it, it’s OK for them, too. He wouldn’t want to be exposed as a hypocrite, and that just might do it.
March 22nd, 2008 at 12:29 pmLet’s just wiretap them.
March 22nd, 2008 at 12:29 pmAfter Cheney let the American people know they have no say in the United States now the Bush Administration is letting the Courts know they can destroy documents and evidence and there is nothing anyone can do about. Americans were told the US had to remove Saddam a Dictator only to have put a Dictator to head the United States. This Administration has committed TREASON but with no Constitution and no will of the people we’re doomed. It’s so strange how Americans allowed Republicans to try and impeach President Clinton for having a affair yet nothing is done to a President who is destroying the United States of America.
I guess Americans will blame the Democrats or Bill Clinton for destroying the hard drives because the Republicans haven’t yet been blamed for anything over the pass 7 years in control of this country. Only the people overseas have spoken up while Americans put their heads in the sand as if to say, I see nothing, I say nothing and I do nothing.
March 22nd, 2008 at 12:30 pmWhen in actuality they were destroyed before they ever left the whitehouse. Who’s BSing who?
March 22nd, 2008 at 12:31 pmTroll-turd at post 5 from Frank. I flagged — maybe we’ll get a cleanup.
March 22nd, 2008 at 12:31 pmignore frank please?
March 22nd, 2008 at 12:31 pmDestroying the hard drives, IMO isn’t that unusual. You can pull information from a hard drive no matter how many times you erase and rewrite. The failure, is that the emails in question weren’t archived as they legally are supposed to be. Then again, given that some of the whitehouse staff used email non-government email accounts to cover their tracks is indicative of the overall contempt, and casual disregard for the Law, the people of this country, and for accountability in general.
March 22nd, 2008 at 12:34 pmWhen in actuality they were destroyed before they ever left the whitehouse. Who’s BSing who?
If they were lying, they were too clever in saying the destruction took place at another site. Congress had better get off it’s shiny ass and subpeona the bosses of this “other government entity,” pronto.
March 22nd, 2008 at 12:35 pmFrank’s post is gone……that was fast…
They now lie with a straigt face…..no one will cross them.
March 22nd, 2008 at 12:35 pmBottom line here is that even lowly computer folks like us know that those emails are not gone…..they still exist in several locations…..
March 22nd, 2008 at 12:37 pmI believe that we have reached a point in time where this administration needs to be taken down – no ifs, ands or but(t)s about it. Why are they working on a back up system for data that has already been illegally destroyed?

March 22nd, 2008 at 1:01 pmSadly, this is a legitmate fear. What will Americans do? I have seen threads here where the speculation is that the American people will rise up against such an action. I personally have my doubts that the American people still have the honor and integrity to stand up against such an assult. I for one will be in the first wave even if it means certain death.

Government agencies always track their fixed assets with asset tags and serial numbers. I teach and whenever we get donated equipment from a government agency I have to sign all kinds of paperwork that lists asset tag numbers, serial numbers, and donating agency information. #17 is correct – much might still be accessible if you just track down the equipment. But, as stated all along, the underlying crime still exists – information was not preserved intentionally by these sneaky b@st@rds so they can attempt to hide the truth.

well, I’ve got to get going – I’m teaching a group of kids from the community how laws are for losers suckers, and how to properly burglarize the homes of republicans. It relly helps to have so many examples in high places – the president and his staff have become role models for my little class of junior criminals.

Their opening act of installing themselves in power regardless of the vote was a treasonous act – having already committed that, why would they worry about breaking other laws?
The emails provide evidence of their lawlessness so of course they can’t find those.
And what of a democratic congress that no matter how many laws are broken – won’t enforce even one? This is why this coverup continues with all the time in the world to continue to destroy evidence.
Criminals and prosecutors who lok the other way – a perfect marriage.
March 22nd, 2008 at 1:39 pmLooks like our bedwetter troll, a self-avowed fascist, got the boot.
March 22nd, 2008 at 1:39 pmDestroying hard drives is standard practice in both the private and public domain.
At the end of a lease cycle, or if the hard drive crashed, the data is backed to either tape or server to be preserved, then the hard drive data is either erased permanently using a degausser or destroyed, then they are sent to a recycling center. And yes, the tax payers pay to replace these assets, usually when the lease expires every 3 years for government PC’s and laptops. That’s how it works.
This is what I find outrageous.
“Recycling — taping over existing data — raises the possibility that any missing e-mails may not be recoverable.”
That is not standard practice; tapes are not reused or recycled for the explicit purpose of retaining data. Please don’t attack me, I am not a troll. I have worked in the IT industry for 10 years, and know how it works.

Therein lies the rub. They apparently didn’t back up the data before they destroyed the hard drives, otherwise they would be able to meet the court order.

March 22nd, 2008 at 2:17 pmThis White House can no longer claim “ignorance” of the law. It has been well established that all electronic files are to be preserved. This is willful and deliberate flouting of the law. Their mission is accomplished — they feel that Congress will excuse them from criminal prosecution — the end justifies the means.
March 22nd, 2008 at 2:29 pmI expect Obama to run an ethical White House next year – but were his administration to take the liberties of this one, flout the law, and ignore the Constitution, I expect that the American public will storm the White House in protest — but for now, for the Bush administration — not so much.
Congress has allowed them to escape prosecution for their misdeeds and crimes.
Hard drives are destroyed — where are the back up copies?
March 22nd, 2008 at 2:32 pmMy organization’s mgt. company backs up all electronic material (off site) in the event of a catastrophe.

Let me spell it out for ya genius.
1. In my personal opinion, the approx. 3000 people that were killed in NYC were murdered.
2. I believe this admin., and their destruction of potential damning evidence against them (the subject of this thread), were very much a part of the coordination of those 3000 deaths.
Now, add number 1 with number 2 and see if you get something other than the number 3.
March 22nd, 2008 at 2:39 pmHonest people would WANT their electronic material preserved for historical purposes.
March 22nd, 2008 at 2:44 pmThe Bush Crime Cabal operates in the shadows or behind closed doors and wants only THEIR version of history recorded for posterity.

March 22nd, 2008 at 3:20 pmRight CreamGusher…
The assumption that this is an IT ‘glitch’ is absurd. These are official documents. The White House employs a shitload of lawyers who know what the requirements of the official records act require. Too much smoke, CreamGusher, where there’s smoke, there’s fire.
March 22nd, 2008 at 3:33 pmShould anyone really be surprised? This is the modern equivalent of Nixon burning the secret White House tape recordings. March 22nd, 2008 at 7:48 pmDreamCickle is so typical of the lunatic fringe that support this criminal administration. In their eyes nothing they do can ever be wrong because that would mean that they too must be wrong for supporting the criminals in the whitehouse.
Oddly they can’t seem to grasp how after this administration fired the atty’s for what looked like entirely political reasons on the surface (so beneath the surface there was some really ugly stuff going on) they were then Ordered to preserve all communications…but …OOPS… they “lost everything” and they explain it away as a computer glitch. Those darn internets tubes are just way to confusing!
Yet this administration has at it’s fingertips the NSA, CIA, FBI and the worlds best computer forensics experts that money can buy, yet they can’t find anything.
This is exactly like the watergate tapes and they know it. But because their team is doing it, they pretend it’s OK. I wonder how fast they would find their sense of outrage were Hillary or Obama to pull a stunt like this? (that’s a rhetorical question, I know, They would explode in a mass of impeachment hearings!) Well it’s now long past time that we explode in a rage of impeachment proceedings. appoint a special prosecutor and expose this criminal administration for ALL of the crimes and TAKE BACK OUR COUNTRY!

March 22nd, 2008 at 9:19 pm• Destroyed the hard drives.
• “So?”
• Approaching 4,000 dead.
• 23,000 wounded. Many horribly wounded.
• Vetoed the anti-torture bill.
• Berated Congress for endangering the nation by not passing Protect America Act, whenHouse voted for extending Protect America Act, but w/o telecom protection.
• Solemnly warned about “overcorrecting” the economy, while praising Fed’s 30 billion line of credit to Chase so they can buy out Bear Stearns.
• “It must be exciting for you … in some ways romantic, in some ways, you know, confronting danger…” to troops in Afghanistan.
• “I’m just a simple President.” Gak!
• The waiting-for-McCain tap dance.
• DOD study confirms no link between Saddam and Al Qaeda.
• “To allow this to happen [pulling out of Iraq] would be to ignore the lessons of September the 11th and make it more likely that America would suffer another attack like the one we experienced that day,” Bush said.
• Cheney sport fishing off Dubai.
• “… they’ve [the Iranians] declared they want to have a nuclear weapon to destroy people, some in the Middle East. And that is unacceptable to the United States and it’s unacceptable to the world.”
• Scooter’s disbarred! =)
• Ecuador’s President to Bush: “Shut up!”
• Venezuela’s President to Bush “Shove it!”
• Pressures EPA to ease its smog standards.
• Cheney renews call for missile defense system. Does not seem to mention price tag.
• What happened to Admiral Fallon?
LOL…gee, could I have imagined another scenario? Well how ’bout this? Let’s see the logs for work station closing, transport, and destruction. How stupid is it to shut down a work station and destroy hardrives. Wherever I’ve worked they’ve been cleaned-up and used again. So, if they were destroyed, cough up the documents. Secondly, I’d like to know how much this cost taxpayers to have all these hard drives destroyed and replaced. This whole thing is baloney. The sad fact is that they are going to get away with this and all the other crap they’ve pulled because CONGRESS IS FILLED WITH COWARDS AND THIEVES ON BOTH SIDES OF THE AILES.
March 22nd, 2008 at 10:29 pmMay I commend Bogtrotters on a great summary. It used to be hard to believe. Now, the tap dancing simple president who lives and dies by trickledown has ponied-up for his big buddies on wall street. Hey good news though we are gonna get a 3,6, or 1200 dollar check. The BS factor is higher than ever in the Spite House.
March 22nd, 2008 at 10:36 pmExcellent list, Bogtrotters.
Gee, I’m so sorry that I missed Mr P and Frank M – NOT!
March 22nd, 2008 at 10:49 pmYes, because you’ve never ever lost any of the documents you’ve had on your computer. Never. No company has ever lost any data on their computer systems. Ever.
Nope. The White House is the global epicenter of data storage and protection technology and research, so obviously an IT glitch could never, ever, happen there.
I do believe Occam’s Razor and Hanlon’s Razor will do just fine.
================================================================
Ah, the troll is spewing its lieing bull$#!+ for all to see. Let’s address this.
E-Mails are stored within a Lotus or Microsoft server, on an array that is at least RAID-5 redundant, if not RAID-6. To lose data from these drives, 2 drives out of 3 must fail. This is before Server clustering, which backs up the contents of one server on multiple other servers. But wait! It gets even better. ANY backup plan in existance requires data to be backed up at least twice onsite and once off-site.
‘IT mixup’? No, an IT mixup is realizing that your off-site backup disappeared in transit, with important information contained on it in encrypted form. This requires a series of events that boggles any trained IT professional’s mind.
1) The simultaneous failure of multiple hard drives, from 2 for a small business firm to literally hundreds in a SAN array for something the size of government.
2) The also simultaneous failure of additional drives from any and all mirroring servers.
3) The failure of all workstations that contained the e-mail downloaded from the server.
4) The disappearance of all the tapes.
Dreamcrusher, you lie like a rug, in a transparent attempt to convince people who are not as familiar with computer technology believe that it’s as easy for a governmental agency to lose data as it is for a home user.
I am here to state for the record that a typical governmental agency, such as the USGS Energy Team, maintains a setup that would survive the destruction of the Federal Center. Your words that this is as simple to have happen as losing data from a home computer, DreamCrusher, are lies.
March 22nd, 2008 at 11:26 pmDreamCrusher
This guy is a professional bush apologist. He will rationalize anything that bush does.
this is his excuse for everything:
Judging by how many things they have messeed up and gotten wrong, dreamcrusher must think they are really stupid, really incompetent, or really unlucky. Probably the most stupid, incompetent and unlucky people to ever be in charge of anything in the history of mankind, and he still supports them. Wonder why he would think we care what he thinks.

Gee, Cream Cruiser, you didn’t try to refute what I said…
March 23rd, 2008 at 1:41 amHe cherry picks what he responds to….and then he uses the bush formula.
render everyone elses statements as irrelivant by making arrogant unsubstantiated statements….just a troll and I wil start flagging this bush apologist every time I see him/her.
March 23rd, 2008 at 11:39 amYou want me to show you the error of your ways for you? I am tired of defending myself agianst self-rightous apologists for this administration and your complicit behavior. You prove something for a change.
here’s the thing:

This boggles the mind. Retention legal requirements state how long data is to be stored. Why have no heads rolled for wanton disregard of the law. E-mail was not destroyed during the Clinton administration. Nothing in the law changed. Only the politics changed and that must be punished.
March 24th, 2008 at 12:21 amKilo 113 & 114
March 24th, 2008 at 12:34 amI read your posts twice before I finally decided that you must be drunk….that is the only thing that makes any sense.
The Bush WAR CRIMINALS are TRAITORS to the USA.
PLUS Bush and Cheney have committed GENOCIDE.
When their time comes, and they get sent to hell, what do you think Bush’s new MASTER Satan will do?
March 24th, 2008 at 4:13 amNo one destroys hard drives without removing ALL the files first. No one. This is just more disregard of any laws or rules by this Administration. The fact that they publish this as their excuse proves they think we are all idiots. Since none of our representatives DO anything about these scams against this Country and it’s citizens, the lies and corruption just continue on without check. Bush & Co are the actors in this farce but our Senators are allowing it…..
