House Judiciary Committee subpoenas Rove.»

The House Judiciary Committee issued a subpoena today to Karl Rove, to compel him to testify about the politicization of the Justice Department, including his involvement in the firing of nine U.S. attorneys last year and the prosecution of former Alabama Gov. Don Siegelman. The subpoena comes after Rove’s lawyer, Robert Luskin, wrote the Committee yesterday to say Rove would not testify voluntarily, contrary to what Luskin had indicated last month.

    The real test will be in enforcing the subpoena. The Congress can not wait to see whether the AG would act because we already know that he will not. A date needs to be given and Rove taken into custody as quickly and publicly as possible when he refuses to testify. The inherent contempt power needs to be used.

    And of course, I expect Rove to resist the subpoena. This will be tug of war bewteen HJC and Rove. Rove is justusing the stall tactic. But, the House committee has the upper hand. I suspect the HJC is trying to have Rove tried by Congress for criminal offense according to contempt of Congress rules.

    Just be sure to have the trial after january 20, 2009. Then, Bush could not pardon him.
    In the meantime, throw his ass in the basement jail, after he does not honor the subpeona for inherent contempt.

    I’d be thrilled if I thought this would go anywhere. I’d be overjoyed if I thought that Congress would actually Do Anything about it. However, after almost 8 years of growling as it rolls over, I’m not holding my breath. If anyone in this pathetic excuse for an Administration should go to jail first, its Karl. If Congress actually develops a spine and actually does something you’ll know I appreciate it, ’cause I’ll be singing their praises from the highest mountain! That being said, I’m not dusting off my mountain climbing equipment just yet.

    last sunday on LEFT JAB radio (on XM), the guys were talking about this… one suggested that any D.C. cab driver listening should be on the lookout for kkkarl and if he gets in the cab, lock the doors and drive right to congress, with a heads-up to have the sergeant at arms ready with the cuffs…

    No, Rove can do whatever he wants because he is a Republican as long as he uses the appropriate and mystical process of going to Congress, dropping his pants, exposing his arse while chanting: Drop dead, Drop dead, Drop dead; King George has set me free.

    No. No individual can exert executive privilege other than the president. Kind of a cheat. The president will send the message to congress that he is asserting the privilege over Rove’s testimony - kinda like spousal privilege or attorney-client privilege. But it is not enough just to assert the privilege. The proper way of doing this is to put Rove before the committee and ask specific questions. Counsel from the White House would then object to certain questions on the grounds that the president is exerting the privilege.

    Theoretically, the president could call for an in camera inspection of the documents and review of the testimony to determine whether the privilege applied. This would be done out of the public view. Documents and testimony that was not considered privileged would then go to the committee in open session. Normally a judge would make the decision. It would be interesting to see how this would be done in a Congressional hearing.

    The Congress then has two options to enforce its will. First, it can refer contempt charges to the AG who would then take the matter to court. The court would then decide whether the information or conversation sought was privileged. The privilege is not absolute and must give way to certain types of inquiry. Investigation of alleged criminal activity or obstruction of justice would easily pierce the privilege. These issues were already litigated in court during the Watergate investigation.

    IN NO CASE CAN ROVE JUST REFUSE TO SHOW UP1

    Separately, Chairman Conyers recently received a letter from DOJ’s Office of Professional Responsibility (OPR) indicating that the office has opened an investigation into allegations of selective prosecution of Siegelman and others.

    Just wait. Bush will block the investigation. Recall that he did just that when the OPR tried to investigate and find out what the DOJ lawyers’ positions were on the warrantless wiretapping program. (This, after Bush said that the lawyers were on board with him re: wiretapping).

    Hell no, I would have the whole place wiped clean down to the studs, because there is NO TELLING what kind of evesdropping devices they left. And I would also clean house TOTALLY at the unconstitutional office of the Secret Sevice. WHat a jok of an organization. It does not even take an oath to defend the Constitution. They are the strong arm of the monied interests of the country having a perpetual hand around the throat of the President to make sure they do not do something “stupid” like Kennedy did, you know like Announcing he was going to go back on the Gold standard, a little while before he was kill-ed, by the lone gunman at a great distance and with the magic bullet.
