No.  No individual can exert executive privilege other than the president. Kind of a cheat.  The president will send the message to congress that he is asserting the privilege over Rove&#039;s testimony - kinda like spousal privilege or attorney-client privilege. But it is not enough just to assert the privilege.  The proper way of doing this is to put Rove before the committee and ask specific questions.  Counsel from the White House would then object to certain questions on the grounds that the president is exerting the privilege. 

Theoretically, the president could call for an in camera inspection of the documents and review of the testimony to determine whether the privilege applied.  This would be done out of the public view.  Documents and testimony that was not considered privileged would then go to the committee in open session.  Normally a judge would make the decision.  It would be interesting to see how this would be done in a Congressional hearing.
