The court would then decide whether the information or conversation sought was privileged. The privilege is not absolute and must give way to certain types of inquiry. Investigation of alleged criminal activity or obstruction of justice would easily pierce the privilege. These issues were already litigated in court during the Watergate investigation.

Just wait. Bush will block the investigation. Recall that he did just that when the OPR tried to investigate and find out what the DOJ lawyers’ positions were on the warrantless wiretapping program. (This, after Bush said that the lawyers were on board with him re: wiretapping).

No, Rove can do whatever he wants because he is a Republican as long as he uses the appropriate and mystical process of going to Congress, dropping his pants, exposing his arse while chanting: Drop dead, Drop dead, Drop dead; King George has set me free.

No. No individual can exert executive privilege other than the president. Kind of a cheat. The president will send the message to congress that he is asserting the privilege over Rove’s testimony – kinda like spousal privilege or attorney-client privilege. But it is not enough just to assert the privilege. The proper way of doing this is to put Rove before the committee and ask specific questions. Counsel from the White House would then object to certain questions on the grounds that the president is exerting the privilege.

Theoretically, the president could call for an in camera inspection of the documents and review of the testimony to determine whether the privilege applied. This would be done out of the public view. Documents and testimony that was not considered privileged would then go to the committee in open session. Normally a judge would make the decision. It would be interesting to see how this would be done in a Congressional hearing.
