Federal prosecutors no longer seeking stiffer prison sentence for Siegelman.

AP reports:

Federal prosecutors are no longer seeking stiffer prison sentences for former Alabama governor Don Siegelman and former HealthSouth CEO Richard Scrushy.

Prosecutors filed a motion this week with the 11th U.S. Circuit Court of Appeals asking that their appeals of the sentences be dropped. Their appeal had called for a longer prison term than Siegelman’s more than seven-year sentence and Scrushy’s almost seven-year sentence.

The latest filing does not say why prosecutors want to drop their appeal.

Last week a bipartisan group of 54 former state attorneys general filed a brief with the federal appeals court in support of Siegelman, writing that the government’s bribery prosecution “raised serious First Amendment concerns.”

Lessee, could it be that when the Rove emails come out, these folks are in trouble up to their armpits?

Time to come clean, prosecutors, maybe somebody'll cut you a deal for say, only a ten year sentence for obstruction of justice.

  2. raynman Says:

Methinks this is a case of "Maybe if we throw him a bone, this will all go away".

  3. MCMetal Says:

How about seeking why Federal Prosecutors were originally looking to prosecute an innocent man to begin with ?

    Because he's a Dem ?

I didn't realize that was against the law.............

  4. liberal traitor Says:

little bits of good news just keep trickling out of this case. Keep fighting Don.

  5. Zooey Says:

MCMetal, it's against the law as far as Rove is concerned. I'm looking forward to Karl going down.

  6. SP Biloxi Says:

Well, another shoe drops in the Siegelman case. And why prosecutors want to drop their appeal? I suspect the answer is two words: Karl Rove. Thanks to Scotty McFelon's bombshell dropping book, *h*t Happened, all roads leads back to McTreason Rove.

  7. raynman Says:

Now do people see why the politicizing of the courts was a bad idea?

    Especially to Jeff Gannon ...........

What was Siegelman's crime again... Besides being a Democrat?

Anyone else here seen the the video of the BBC reporter (Greg Palast, who besides being a REAL journalist is also HILARIOUS) that Karly boy accidentally sent about 500 incriminating emails to (due to mistaken domain names)? It's pretty damning. What this reporter will do with those emails coupled with the Don Siegelman case...there just might be a very real possibility of seeing Karl Rove go to prison.

    Perpetuating the Al-Queda-Iraq myth:

    http://news.yahoo.com/s/time/20080603/wl_time/perpetuatingthealqaedairaqmyth

" the teeth of the facts, they ignore that the enemy we're fighting in Iraq is a half a dozen homegrown insurgencies, an incipient civil war, and criminal gangs. They ignore the fact that although a handful of Osama bin Laden's followers showed up in Iraq after the invasion, in a futile attempt to hijack the Sunni resistance, al-Qaeda is not the main enemy in that country.
It should be clear by now, but apparently it isn't: al-Qaeda is an idea, a way of thinking. Al-Qaeda thinks the world is divided between believers and nonbelievers, and the believers are divinely obliged to destroy the nonbelievers. It is a simple idea that has attracted tens of thousands of Muslims, but it is neither a political prescription nor the makings of an army. The Sunni Arabs who drifted into Iraq after the invasion and the Iraqis who embraced al-Qaeda were never an organization. They were never an army. They were never the main enemy. They numbered, what, a couple of thousand? They nearly triggered a civil war, but even that they failed to accomplish. "

  17. Wilco Says:

I'm not at all familiar with the case, but wasn't Siegelman found guilty by a jury?
If the prosecution's case was so flimsy, then why wasn't the defense able to convince the jury to find not guilty?
Maybe it is all the result of a right-wing conspiracy, but it just seems so fantastical.
Someone please explain this to me.

Governor Siegelman's young assistant, Nick Bailey , falsely testified against him , that's why.........

Bailey testified falsely that Siegelman came out of a meeting with Richard Scrushy , a wealthy businessman , and showed Bailey a $250,000 check he had accepted in exchange for appointing Scrushy to the Certificate of Need board.

Prosecutors knew that Bailey's testimony was false, not only because they had Bailey rewrite his testimony many times and rehearsed him until he had it down pat, but also because they had the check. The records show that the check, written to a charitable organization, was cut days after the meeting from which Siegelman allegedly emerged with check in hand.

    Wilco,

    http://rawstory.com/news/2007/The_Permanent_Republican_Majority_1125.html

Raw Story has a multiple part story explaining the entire thing. It is rather long and complicated, hence why I don't type it all out here.

  27. Zooey Says:

Wow! Wilco's got a lot to read! :-)

  28. Wilco Says:

lib traitor, I appreciate the help, but I have to be an ingrate! I have no access to the videos, as my employer blocks most sites.
But I understand reluctance to indulge my ignorance. I'm sure it's a detailed argument.

  29. liberal traitor Says:

All you really need to know, besides the Bailey bit, is the number of connections between the people who would investigate and ultimately prosecute Siegelman, and Karl Rove and the man who would take Siegelman's place as governor when suddenly and magically "votes were found" by a group of Republicans only, in the middle of the night, when the election had already been called for Siegelman.

  30. liberal traitor Says:

No reluctance whatsoever, Wilco, you have an inquisitive mind when you don't know something. That is a trait to be admired and encouraged, not attacked or regretted.

  31. liberal traitor Says:

The raw story links are not vids however, they are written articles. As for the vids, save the links for later if you can and watch them at home (sorry if I'm assuming you have internet access and you don't, not everyone does).

See how the bullies on the right side run away when the light shines on them? See how they operate? In the dark, they are tough and resolute. As soon as the light of day approaches, they scurry for cover like the cockroaches they are.

He won an election for governor in a red state. That is a very serious crime according to the Law of Karl.

    BULLCRAP!!

  36. Wilco Says:

lib traitor, I have an inquisitive mind, but a lazy one, as I should do the searching myself.
I read part one of the Raw Story article. I need to search Raw Story further for part 2.

    Thanks, everyone.

  41. Jackie Says:

Keep in mine the trial is over and this is just an appeal. Looks like somebody is scared as the Appeals Court reads a transcript of the hold trial. The Prosecutors were trying to get Karl Rove out of trouble but it wont work it's to late.

  42. JMOHR Says:

They still do not have a transcript of the trial. That is one reason that the appeal has been held up so long.

  43. Troubled Texan Says:

    Hmmm,

Seems to me the right wing nutjobs have been found out. They're not going to risk a battle in the Courts. They have nothing to stand on.

They're tucking tail and going to hole.

That's exactly where the Courts will find these pieces of human feces when the Courts overturn the Siegelman verdict.
