Rohrabacher: Torture At Guantanamo Simply ‘Hazing Pranks From Some Fraternity’

Today, the House Subcommittee on International Organizations, Human Rights, and Oversight held a hearing on detainee treatment at Guantanamo Bay, focusing on a recent FBI inspector general (IG) report documenting abusive practices at the facility. The report describes, among other things, a “war crimes file” created by FBI agents concerned about the interrogation tactics they witnessed at Guantanamo.

Rep. Dana Rohrabacher (R-CA), however, sees nothing wrong with the accounts of abuse. While questioning IG Glenn Fine today, Rohrabacher insisted the report documented nothing more than “fraternity boy pranks and hazing pranks,” and hardly constituted torture:

ROHRABACHER: They seem like more like pranks, hazing pranks from some fraternity than some well-thought-out policy of how do you torture someone and get information from them. [...]

I will have to tell you, when most people hear the word “torture,” which has been bandied around here, I don’t believe that they think of it as holding a growling dog near somebody but not the growling dog — you know, it’s one thing to have the growling dog eating someone’s leg or arm versus — which is absolute torture. It’s another thing to have a growling dog around, or putting panties on someone’s head, or discussing — telling him he had repressed homosexual tendencies in his presence. I mean, I’m sorry, these are acts of humiliation.

Rohrabacher is right to call these “acts of humiliation.” Of course, the Geneva Conventions specifically outlaw “outrages upon personal dignity, in particular, humiliating or degrading treatment.”

Rohrabacher mocked the FBI for taking what he called a “holier than thou” stance against harsh interrogations. Yet Fine repeatedly reminded Rohrabacher that the FBI found the interrogations not only abusive, but also “in their view, ineffective.” Rohrabacher admitted, “I don’t know what’s effective and what’s not,” but continued to insist the documented instances of abuse were “fraternity boy pranks and hazing pranks” that “certainly don’t fit into the category of torture.”

Rohrabacher joins a long list of right-wing torture apologists who refuse to heed the words even of Gen. David Petraeus, who unequivocally rejected torture as producing information of only “questionable value.”

ROHRABACHER: You’re suggesting that the behavior of, what, panties on his head in order to try to, you know, confuse him and to pressure him, that is unacceptable interrogation technique for a man who was involved in a conspiracy to kill tens of thousands of Americans?

FINE: What we are saying is what were reported by the FBI, a number of concerns about that, not simply putting panties on his head, but the course of interrogation was both abusive and, in their view, ineffective.

So when we’re talking about this position that the FBI, this moral stand that the FBI took on this, it was basically to say that a man who might have information that could lead us to prevent an attack that would cost the lives of tens of thousands of Americans, that we should not — we should never think that it was acceptable to put panties on his head or try to humiliate him verbally in order to break his will? That’s not an acceptable interrogation even if it’s going to save the lives of all these other people in the end?

FINE: Congressman Rohrabacher, what the FBI said that they objected to, for a variety of reasons, one, it was not effective in obtaining intelligence. The FBI had a longstanding ability and skills in obtaining intelligence from people who didn’t want to give it to them, whether it was domestic or Al Qaida.

How can the GOP say that the humiliation is harmless, when our law indicates it is a crime to engage in the process of humiliation?

    The laws of this country were not written in crayon or pencil. They are the law of the land until overturned or otherwise changed by legislative process. Why is following the law so tough for the ‘law and order’ party?

But then Rorabacher also agrees that it is alright if we accidentally pick up innocents, rendition them and use aggressive (to include humiliation) as long as we get the bad guys as well. Just collateral damage. He gave no indication as to the number of innocents renditioned and tortured would be acceptable as collateral damage.

    omg, I happened to be deathly afraid of the sound of a dog’s growl. My family had a pit bull puppy when I was ten and we gave the dog away because when he got a little older he started growling at me in a weird scary way and I became extremely afraid and fearful for me life. Ever since then, I cannot hear a dog growl because my first response is fear and that will get them to want to attack. for me, this is torturous.

    I also know of someone who had one since it was a puppy and one day it started growling that way and she ran and hid in her closet but the dog got to her and bit part of her ear off.

    my whole point is that if it is your deepest fear it can be used as torture also. hasn’t anyone seen that show fear factor? If, for example, I was buried to my neck in cockraches, I can assure you, someone would have to call EMS because I would be having a massive heart attack. People have heart attacks from stress and fear all the time!!!

    This was tried on me a few months ago by Mr.Pee and some other trolls. It didn’t work then and it wont work now. If you really want to talk to me and take a certain “tone” with me, you would meet at the Fort Lewis Museum in front of the 1st BDE 25th Ind Div fallen Soldier’s Monument, and then you can see me and the names all who fell in Iraq.

    SGT Sherman WAS and WILL ALWAY’S BE MY SOLDIER. His Mother, Father, and Sister were present when the Monument was revealed and my Wife and I along with my Daughter (Air Force) escorted them and sponsored them during their entire time here, and we became close and now call ourselves FAMILY.

    So the cheap and downright callous attacks by some here are really quite expected, because you see, when you have done nothing in defense of your country and others have you feel “short” and you compensate by attacking those who have.

    So have your fun, claim that I havent done this or that (my DD214 says otherwise, and you might be impressed if you ever had the pleasure to read it), and continue to mock my Soldier, knowing full well that we will never meet and you will never pay for your words, at least you hope you dont.

    Its something to have to listen to those who have not lost or sacrificed anything in this war. Those who blindly follow those who talk their talk. Well come walk mine and my former Soldier’s (all 117 of them) walk and see if you could make it, and if one of them should fall how would you take it.

    You would take it like me and honor him/her just like I do by NEVER FORGETTING, no matter what some idiot had to say.

    We get attacked in Oklahoma City–we play by the rules, we find the perpetrator, give him every legal protection, find him guilty, and execute him.
    Justice is served. WE win.

    We are attacked on Sept. 11, 2001. We (led by Republicans this time) decide we can’t afford to play by the rules. We have to violate the Bill of Rights and the Geneva Conventions, lock people away in Chekist brigs, invade other countries preemptively in the grand tradition of the Divine Emperor of Japan and the Reichskanzler of Germany, spy illegally on our own citizens, torture our prisoners, and bring the full force of the largest war machine in the world on a small country.
    And our army is broken and at the edge of collapse, we lose the wars we initiated, and the person responsible for the attack is still at large and issuing mocking public statements.
    We throw away all our principles, arguing we’ll lose if we play by the rules, and what happens?
    We lose.
    Over and over and over in the Bible the point is made: abandon the Law and you lose. Your riches will vanish, your armies crumble if you act without law, honor and justice.
    It’s times like these that make me think there’s something to that book after all.

    Wow! Our pet troll certainly has lowered the bar. I sure think that trolls, much like Rep. Rohrabacher, would benefit from a stay in the custody of “enemy combatants”. Perhaps they would learn why ALL prisoners MUST be humanely treated at ALL times.

    We didn’t sign the Geneva, and other, Accords to protect our enemies. International treaties exist to protect our citizens who are held by a foreign power whether legit or not. No one can even guess how many thousands of American citizens have been spared torture, humiliation, starvation and death, because of our once sterling reputation earned by a standing tradition of treating prisoners with honor and respect.

    That’s gone. The whole world knows, beyond the need of a show trial, that the Government of The United States of America ordered the systematic coercion, including by means of torture, of prisoners. And the blood of the next American tortured to death, and countless more for generations to come, will be on the hands of the criminals who pissed away the good will of the entire planet. If you believe in God, pray that our great grandchildren are forgiven the crimes of Bushco though it may prove more than we deserve.

    There’s a certain right-leaning radio host who is contending that Rep. Rohrabacher is “defending the integrity of the U.S. Armed Services”. What a pile of crud.

    The way to defend the integrity of the U.S. Armed Services is to charge, try, and convict the guilty parties, all the way to the top. If prisoner abuse were pursued Rummy, if not the Dick or the Chimp, would end up in prison.

    Any reputable shrink will tell you that such behaviour says far more about the “repressed … tendencies” of the captors than it does of the detainees subjected to such (and how could it be otherwise?; the only ones that are exhibiting voluntary behaviour here are the captors). And about the “repressed … tendencies” of those that applaud such behaviour….
