A military defense lawyer today said that U.S. interrogators at Guantanamo Bay were instructed by the Pentagon “to destroy handwritten notes that might have exposed harsh or even illegal questioning methods.” According to Navy Lt. Commander Bill Kuebler, who is representing Canadian Omar Khadr, interrogators may have “routinely destroyed evidence” that could have been used to defend Khadr and other detainees.

When you destroy evidence of a crime, isn’t that a crime in and of itself?

June 8th, 2008 at 9:28 pmYes it is! so is to destroy a crime scene, as they did with the WTC complex. It was cleared away before any serious investigation.

Absolutely.
June 8th, 2008 at 9:29 pmShow trials. Torture. America. Who would’ve thunk?
June 8th, 2008 at 9:33 pmWhy the Hell does Bush need a library if every document produced during his administration will be shredded to keep his ass out of prison? Maybe he plans on spending his golden years pasting them back together to spell dirty words?
June 8th, 2008 at 9:34 pmViolation of the Federal Records Act–high crimes and misdemeanors???
June 8th, 2008 at 9:37 pmThere are criminal penalties for the unlawful removal or destruction of Federal records (18 U.S.C. 2071):
18 U.S.C. 2071 Concealment, removal, or mutilation generally.
(a) Whoever willfully and unlawfully conceals, removes, mutilates, obliterates, or destroys, or attempts to do so, or, with intent to do so takes and carries away any record, proceeding, map, book, paper, document, or other thing, filed or deposited with any clerk or officer of any court of the United States, or in any public office, or with any judicial or public officer of the United States, shall be fined under this title or imprisoned not more than three years, or both.
(b) Whoever, having the custody of any such record, proceeding, map, book, document, paper, or other thing, willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies, or destroys the same, shall be fined under this title or imprisoned not more than three years, or both; and shall forfeit his office and be disqualified from holding any office under the United States. As used in this subsection, the term “office” does not include the office held by any person as a retired officer of the Armed Forces of the United States.
(Amended Nov. 5, 1990, Public Law 101-510, sec. 552(a), 104 Stat. 1566; Sept. 13, 1994, Public Law 103-322, sec. 330016(1)(I), 108 Stat. 2147.)
June 8th, 2008 at 9:42 pmWell, in order to rewrite history, the first step is destroying anything which might run contrary to that history….
June 8th, 2008 at 9:47 pmThat IS good news. Thanks for sharing.
June 8th, 2008 at 9:52 pmWell, they’ll always need a place to display all of the placemats that George colored in with crayons when he went out to restaurants.
June 8th, 2008 at 9:53 pmWhen is this candy-assed congress going to get off its collective ass and impeach?
June 8th, 2008 at 9:55 pmTwo words – “I wonder”.

June 8th, 2008 at 10:00 pmHow to boil a frog?
June 8th, 2008 at 10:05 pmIf you throw it into boiling water, it will object immediately and jump out.
If you put it in cooler water, but gradually add heat, the frog won’t notice until it is too late.
.
This news should rankle and upset everyone. If not, then maybe the gradual eroding of our Constitution and laws have finally been too much.
Is it too late for the rule of law, the Constitution and America as it should be? Or have the terrorists really succeeded in tearing us down?

By “terrorists”, I mean the Bush administration.
June 8th, 2008 at 10:08 pm.
So,
Those that have nothing to hide and operate lawfully, routinely destroy notes, e-mails, and guest records…
… But I thought only criminals cover their tracks?
.
June 8th, 2008 at 10:17 pm“… But I thought only criminals cover their tracks?”
They try, anyways..
June 8th, 2008 at 10:21 pmCovering up their treason to our bill of Rights, covering up their treason to our Constitution and covering up their treason to America: that’s what the Bush crime family does best…

June 8th, 2008 at 10:38 pmHey Zooey, I didn’t know you were a singer. She and Him.
June 8th, 2008 at 11:14 pmThere couldn’t be more than one Zooey in this world, could there?
Maybe “TheRight” started to figure out we can’t ALL be nuts? My guess is he had to return to porn and “white power” to get his thinking “Right” again.
June 8th, 2008 at 11:18 pmyeah, because to TheRight, this is only more of a vast left-wing conspiracy to discredit the administration…yeah left-wing moles in Gitmo uniform tore up those handwritten notes because those interrogators really wanted to keep them…left-wing moles committed torture to discredit the administration in Abu Ghirab and Gitmo, left-wing moles are responsible for the shortages in armor and equipment for our troops…what a fantasy world…

Um, yeah that’s me.
In my dreams!!! ;)
June 8th, 2008 at 11:30 pmWe allowed this to happen. As some want to place the blame on Congress or the Media it’s Americans who are just as responsible. The World now sees America allows torture, rape, cover up of crimes and lies. To move forward we have to face what we have done and allowed to be done by our Government. To start we need to look at who we have to Lead and each one of the State representatives we put in office. America is We the People and it’s time to take our country back. We will have alot of work ahead after this 7 year crime wave.
June 8th, 2008 at 11:34 pmVery true Jackie. We do share the blame and responsibility. Though, speaking only for myself, I never would have believed a U.S. administration would plummet to these depths. I think America is waking up, but, the question remains; will our votes be enough? There are many strengths to our system but it’s never faced the challenge of such an infestation.
On good days I think we’re up to the challenge. But, it’s gonna take a long time and it’s gonna hurt in ways we can’t anticipate. As much as it pains me, I can foresee a possible future where a mob has to drag “President for Life” Cheney out of his “undisclosed location”. 7 years ago I would have given up on a movie with such a ridiculous premise.
June 8th, 2008 at 11:53 pmRemember all those tales growing up about Soviet gulags, political prisoners, show trials, censorship, thuggery and all that?
Now it is the US doing that shit and the GOP and rightwingpuds now pooh-pooh the same tactics that they said they were outraged about.
What goes around.

Good riddance , retard
Get to work on trying to get your beloved GOP losers (re)elected in November ; talk about a losing proposition ……
June 9th, 2008 at 1:48 amHas anyone noticed how hysterical right talk radio is becoming?
Tonight I heard on a live right show:
Then other times they express fear of losing their money to the liberals…. They can’t have my money
Well too bad… Newt’s contract for America failed, righties will soon have to pay their fair share in taxes and we will not be going back to the hooverville days.
Obama is a strong Constitutional candidate and with him we will return to We the People as it is supposed to be.
June 9th, 2008 at 2:01 amAttorneys who knowingly destroy evidence of a crime may be disbarred.
Those who followed orders may see their careers destroyed.
But, hey, with impeachment off the table, there’s no real consequence for those at the top.
Maybe we should all contribute to Cindy Sheehan’s campaign to unseat Pelosi…..

June 9th, 2008 at 8:45 amThe entire Bush – Cheney – Rumsfeld – Gonzales – Yoo administration has shown, repeatedly, that they do not trust the system of laws [or Constitution] that we have, to provide the results that they want.
The joke is that they expect us to trust them.
There would be less damage to our country, if all the show trials aided by torture were thrown out. We can survive as a nation without punishing these people further (repugnant though that thought may be, in regard to those who have committed actual crimes). But we cannot survive as a nation without the rule of law.
There was a time when I thought that all we could hope for, after January 2009, would be full-really full–disclosure of all that went on. Simply appoint someone in charge of FOIA requests who would suppress NOTHING, simply because it would shine a light on the Bush Administration reign of crime. I thought that would be the best, because we as a nation weren’t ready to see our President and his men on trial. Not on trial for war crimes. We weren’t ready for that.
I no longer think that. Bring everything into the open, and then let the rule of Law take its course–all the way to the Hague. It hurts to say it. But it must be done.
[By the way–this was buried as a tiny page two article in the Washington Post. Will it get the attention it deserves?
June 9th, 2008 at 8:51 amU.S. interrogators at Guantanamo Bay were instructed by the Pentagon “to destroy handwritten notes that might have exposed harsh or even illegal questioning methods.”
In other words, an illegal order was given from the very top and interrogators broke the law instead of honorably refusing to follow illegal orders.
In 7 1/2 years Bush has managed to corrupt the military, Justice Dept, fack, the whole f-ing government.
