FLASHBACK: In 2003, McCain Blasted Administration’s Indefinite Detention Of Detainees»

Yesterday, the Supreme Court ruled that Guantanamo Bay detainees have the right to challenge their detention in civilian courts. The Bush administration and its allies quickly criticized the decision:

President Bush: “It was a deeply divided court and I strongly agree with those who dissented. The dissent was based upon those serious concerns about U.S. national security.” [Link]

Sen. John McCain (R-AZ): “The United States Supreme Court yesterday rendered a decision which I think is one of the worst decisions in the history of this country. Senator Graham, and Senator Lieberman, and I…made it very clear that these are enemy combatants, these are people who are not citizens. They do not and never have been given the rights that citizens of this country have. [6/13/08]

Sen. Lindsey Graham (R-SC): “I am deeply disappointed in what I think is a tremendously dangerous and irresponsible ruling by the U.S. Supreme Court. … The court has conferred upon civilian judges the right to make military decisions.” [Link]

McCain and Graham’s objections sharply contrast with their positions in 2003, when they wrote a letter to then-Defense Secretary Donald Rumsfeld, urging him to swiftly resolve the status of Guantanamo detainees:

The treatment of the detainees is not an issue. However, a serious concern arises over the disposition of the detainees - a considerable number of whom have been held for two years. […]

Yet, we firmly believe it is now time to make a decision on how the United States will move forward regarding the detainees, and to take that important next step. A serious process must be established in the very near term either to formally treat and process the detainees as war criminals or to return them to their countries for appropriate judicial action.

On Dec. 13, 2003, the New York Times also reported that McCain said, “They may not have any rights under the Geneva Conventions as far as I’m concerned, but they have rights under various human rights declarations. And one of them is the right not to be detained indefinitely.”

Five years after their letter, just “one detainee has received a verdict.” Approximately 270 are still detained there and “about half are considered too dangerous to release, even though the government does not have enough evidence to charge them.”

This Supreme Court ruling will inevitably lead to a “flood of new litigation” challenging the Bush administration’s right to hold these detainees. Detainees will then finally get a decision as to their status — exactly as McCain and Graham requested.

In light of these 2003 remarks, it’s unclear why McCain considers this Supreme Court ruling the “worst decision in history,” except for the fact that it isn’t what the Bush administration wanted.

    Maybe, but the dissent was not based on the Constitution. As for this decision being the “worst decision in history,” I think Homer Plessy might have something to say about that.

    While I won’t speak for everyone, Minatour, I will say that, generally speaking, progressives prefer to attack the argument being made and not the person. Generally speaking, it’s the reverse with conservatives. Conservatives find nothing wrong with attacking the person making the argument and not the argument itself. That’s why they were so pissed off when the Dems had Graeme Frost speak out for SCHIP. That’s why Ann Coulter is upset that the 9/11 widows are criticizing our government. They don’t know how to win an argument on the merits of their views, so they want to attack the person making the argument, and they get mad when they look bad doing it. (Because it is bad to do it.)

    Now, I’ve said it before and I’ll say it again. In addition to my being opposed to many of McCain’s irrational views, I also believe him to be a liar. But he is also flat out wrong on many, many issues. It makes no difference how many people think he’s right (probably because they are blinded by the image of him as a “war hero” - since when did being a POW automatically make one a “war hero”?), he is not right about a lot of things including Iraq, Iran, social security, the economy, women’s reproductive rights, gay marriage…

    That’s been my contention for quite some time now. I think they will pick Romney/Huckabee. And if the Democrats aren’t careful, they will be in trouble. The Republicans will trot out a new fresh candidate with only two months left to go to the election.

    I think that the DNC/Obama need to run against the Republican party and all the harm they have done to this country. If they do that rather than running against McCain, they will be ahead of the game when the Republicans pull a switch on us.

(How about commie China, dudes?). Sounds like their kind of place: ho human rights at all…

    P.S. Big mouth Bush is mouthing off about this Supreme Court, 5-4 decision… Herr Boosh seized power by way of a “deeply divided” 5-4 Supreme Court December 2000 decision that was and is to this day, highly controversial. Some how, the Court decided, that the vote counting in the Florida election had to be stopped as to not negatively affect Bush’s something or other: pride, community standing, some BS…

    First, I doubt McCain and I wear the same size.

    Second, I have not criticized McCain’s military service. But being a former POW doesn’t give one license to change positions more often than a Barbie doll changes clothes without being called on it.

    If one wants to call what they are doing “trials”. More like kangaroo court. They will not be presenting “evidence” against any of the detainees. Their only “evidence” is their confessions which were obtained while the detainees were being tortured. But, the detainees can’t enter proof that they were tortured, that’s inadmissible evidence in this kangaroo court.

    This is very dangerous. To prosecute terrorists in civilian courts, our govt. will now have to reveal the methods and intelligence assets/operatives they use in the war on terrorism. And since court proceedings are public information, the enemy will be able to see all this. Our govt. will be forced to choose whether to prosecute a terrorist or save the lives of its operatives and not compromise current operations. Regardless of political belief, all Americans should be aware of this fact. We cannot allow a repeat of the 9/11 attacks before we realize the threat that is brought to us by Islamic terrorism.

    Third, how many Muslims do you think it would take to invade our country, set up stakes, and reproduce like mad in order to “take over”? And by “take over”, I mean overturn the U.S. Constitution completely in order to impose sharia law?

    You were right — it was most entertaining. Apparently, Minatour (dang, that really IS hard to misspell each time) believes that homosexuality is something inherently attractive and desirable (hmmm…that should tell us something about him), and the only thing keeping us from succumbing to its charms is banning it. Like gambling or alcohol, I guess. Anyway, if we legalize gay marriage, a gazillion people are going to abandon heterosexuality and become homosexuals, because that lifestyle is so attractive.

    Now, in an effort to tie this all back to the topic at hand — if we try the Gitmo detainees instead of torturing them and/or letting them languish in their cells forever, is this part of the plan? Is their next sinister plot (that is, if we are foolish enough to let them out) to convert us all to homosexuality so they can take over? Wow — that’s truly shocking.     It was Clinton’s fault that the country started it’s recession in March ‘01
    Clinton had nothing to do with the boon of the 90’s, as well as the decrease in crime and increase in jobs. It was all Congress.
    All Clinton did was have the audacity to get consensual oral gratification from a young lady, and try to cover it up by misinterpreting the definition of sex, to protect his family.

    Minitart knows nothing about what “turning a cheek” means to an opponent. Contextually in Christ’s time, to turn the “other” cheek infers that you have been struck openhanded. To turn the “other” cheek is to expose yourself to that aggression by standing firm in your position allowing your opponent to have to BACK SLAP you. In Jewish tradition, to back slap a person is the lowest form of physical violence a person can do to another person.

    The Founding Fathers thought that the writ of habeas corpus was so fundamental to liberty that they wrote it into the US Constitution, Article One, Section 9:

    The privilege of the writ of habeas corpus shall not be suspended, unless when in cases of rebellion or invasion, the public safety may require it.

    Think about that for a moment. The Founding Fathers wrote this basic right into our constitution.

    And yet, Smirky the Chimp, John McSame, “Huckleberry” Graham, and four extreme court justices are unhappy that this basic right, this foundation of liberty, has been restored.

    IMHO, these sorry apologists for tyranny and despotism could NOT be MORE out of touch with basic, American values.

    There was a troll who called itself Minotaur when I first visited TP, maybe a year ago. I suspect it’s changed the spelling in order to avoid a troll filter. It’s quite possibly the same individual, based on the vacuity of the comments and the constant troll-y repetition of baseless statements.
