Last Friday, police in Des Moines, Iowa arrested four people who attempted to make a citizens’ arrest of former top White House aide Karl Rove, who was in town to speak at a GOP fundraiser. A retired minister and three members of the Des Moines Catholic Workers community were cited for trespassing. However, according to a press release, the judge presiding over the case praised their efforts:
[Mona] Shaw was the first called before Polk County Fifth Judicial District Associate Judge William Price.
After entering her plea, the judge asked Shaw, “Mamn, what were you doing at the Wakonda Country Club?”
“I was attempting to make a citizen’s arrest of Karl Rove, your honor,” Shaw answered.
“Well,” the judge looked up and said, “it’s about time.”
“Well,” the judge looked up and said, “it’s about time.”

August 1st, 2008 at 2:12 pmI know Judge Price, I worked with him in High School when I volunteered with a program called Peer Court where juvenile offenders went before a jury of their peers, with peer attorneys, and Price was the presiding judge for these hearings. We’d sentence them in more creative/useful ways than juvenile detention/probation, and then it would get cleared from their record. He’s a great guy, and I’m so happy this case came before him.

2. He is not required to, as the evidence in the case would be given by the arresting officers in question.
3. The judge at no time requested his presence, or asked for his testimony.
If Mr Rove really wanted to press charges, I suggest you check up on the law in that state. They were charged with a misdemeanour..had Mr Rove pressed charges, it would be assault, battery, conspiracy and attempted kidnapping.

Nobody has suggested forcibly removing Karl Rove anywhere. To make a citizen’s arrest, one simple goes up to the person in question and say, “Mr. Rove (in this case), you are under a citizen’s arrest for this or that crime. Please do not attempt to leave the scene. The authorities have been called to take you into custody. If you attempt to leave, I will be forced to restrain you until the proper authorities arrive.”
See? No kidnapping involved. And before you say it, no, detaining a person until the authorities arrive is not kidnapping.

Whatever one thinks of Rove, et. al (I am not a fan), I hope if I ever do have to appear before a judge, he will make his decision based on the evidence and applicable law(s) alone, & leave his personal views out of it. I’m too risk averse to gamble that the jurist has a perspective that reflects my own.
While people on all points of the political spectrum agree that our legal system isn’t perfect, indeed sometimes highly political (esp. when not reflecting YOUR personal opinions), aren’t we ALL supposed to encourage impartiality? (or at least the appearance thereof?) The judge’s comment just didn’t clear that hurdle.
