Cheney’s argument for not releasing innocent detainees: ‘They’ll all get lawyers.’

In his New York Times review of Jane Mayer’s new book, The Dark Side, Alan Brinkley describes how by the end of 2005, torture advocates within the Bush administration were fighting to continue their extreme detainee program “because they feared being prosecuted should the program be halted and exposed.” In one White House meeting described by Mayer, Vice President Dick Cheney argued against releasing innocent detainees because “they’ll all get lawyers“:

By the end of 2005, those defending the regime of torture were no longer seeking primarily to protect the search for valuable intelligence. They were fighting for its survival, in the face of considerable evidence of the failure of SERE and other programs, because they feared being prosecuted should the program be halted and exposed. Even releasing detainees whom they knew to be entirely innocent was dangerous, since once released they could talk. “People will ask where they’ve been and ‘What have you been doing with them?’” Cheney said in a White House meeting. “They’ll all get lawyers.”

I watched the Congressional hearing in which the DoD had to admit that it really did not keep any records or had any system for tracking those detainees that had been released. Indeed, those who have studied the claim of released prisoners returning to the field refer to a Pentagon report that was based upon newspaper reports for the vast majority of such alleged individuals. However, I would not be shocked to see some individuals turn into terrorists because of their mistreatment. Nor would it be unusual for some to escape our nets since over 2/3rds of those sent to GITMO never should have been there in the first place. Overwhelm the few really trained and experienced Arabic interrogators and miss some really dangerous people. Yes, to be expected.

    Yes, please provide a link, TK MMIX. What search terms did you use in your search? And how old is the report on which you base this claim? And how did they arrve at this "ten percent" figure, when they don't even want to acknowledge how many people they have detained right now? It sounds like more of the same propaganda lies they've been telling all along to justify the unjustifiable.

    I googled it. Here's what I found:

    "It is also wildly inaccurate to claim, as some have done, that at least 30 former Guantanamo detainees have been "killed or captured" on the battlefield, fighting against U.S. forces. Earlier this week, for example, Fox News commentator Dick Morris said that 50 former GITMO detainees had been "killed or captured by our forces" after being released. The Pentagon report lists one former detainee killed while fighting U.S. forces in Afghanistan and one killed by Afghan forces.     Well, you know that's what happens when you open Pandora's box. It's really not possible to shut it again. I think many people in our government are going to be walking around under a cloud for many years to come, not knowing if or when they will be prosecuted.

    Good! That's way better than not bothering to prosecute at all. Once they learn they are no longer being looked at, they'll relax and feel better. But if the ones who know they did illegal things have to walk around worrying about being prosecuted for their actions, never knowing when the shoe is going to fall (on their heads), that's even better. Let them sweat and worry about it. Maybe some of them will develop consciences (or have children) and decide to come forward and make a deal to reveal what they know to avoid prison.

    I showed you where some 10k detainees were released this year, thats more than even holds, and almost as many were released in 2007. Re-read my post, the military found that LASS THAN 1%, NOT 10%, made it back to the battlefield out of more than 10,ooo released.

    Good point. But why stop there? Why, we could use the same kind of "logic" they use and specualte about all sorts of things.

    For example, this troll is obviously an authoritarian conservative, so he probably doesn't do much of his own research or thinking. He probably takes the e-mail with talking points that he gets from either the RNC or som right-wing publication, comes on to lefty websites and starts spewing the nonsense. Since he doesn't understand what he's talking about, he can't defend what he says. And that's his problem - he relies on talking points and not sound arguments. If they had a sound argument to support their view ("sound" meaning it conforms to reality, not just that it sounds good), one would think they would post it and tell us to suck on it. But they don't. They just spew talking points that have never been caught in public with facts. He would make things a lot easier if, after he spews the talking points, whenever he gets challenged on them, he would just say, "I don't know why I posted that. I was told to, and I do what I'm told."

    The report is based entirely on data supplied by the Defense Department, and is intended to provide "a more detailed picture of who the Guantanamo detainees are, how they ended up there, and the purported bases for their enemy combatant designation."

    The report, available here (pdf), finds that fewer than half of the 517 detainees whose histories were reviewed have been accused of hostile acts. These are the findings:

    1. Fifty-five percent (55%) of the detainees are not determined to have committed any hostile acts against the United States or its coalition allies.

    2. Only 8% of the detainees were characterized as al Qaeda fighters. Of the remaining detainees, 40% have no definitive connection with al Qaeda at all and 18% are have no definitive affiliation with either al Qaeda or the Taliban

    The more I reead about Cheney, the more he reminds me of a terrorist. Or perhaps, a better comparison is Saddam Hussein.

    * Both used their government positions to create wars and fatten their back accounts.

    * Both had no problem killing hundreds of thousands of innocent Iraqi's.

    * Both had no problems torturing people.

    The only differences I notice is one had a beard, the other wears flag pins in his business suits.

    If there was a just God, Dick Cheney would be thrown in jail, stripped naked, and waterboarded for his crimes. Then keep him incommunicado and without legal representation for 7 years. Then, we'll just hold him indefinitely because he might hire lawyers to, you know, sue on behalf of loss of his civil rights.

    The only difference between Dick and 95% of the detainees in Gitmo is that he is a terrorist that should be charged with war crimes. He is the antithesis of the ideals of this country.

    Which was true. Lawyers were hired and lawsuits pressed against the complicit telecom companies who'd caved to pressure from the criminal Republicans in the Bush administration (or were just seeking lucrative government contracts so didn't want to refuse a blatantly illegal Bush administration demand to spy on U.S. citizens without warrants).

    So, of course, Bush, Cheney and their fellow criminal Republicans got a lapdog Congress (and leaders like Reid and Pelosi) to give retroactive immunity to all the telecom companies, letting them get away with their illegal, anti-American acts, and shutting down all the civil suits pending against the telecoms in court.

    Cheney hates lawyers because lawyers tend to operate by "the rule of law," which really, really irritates him.
