Pentagon: U.S. will still detain Hamdan even if he is acquitted.

Yesterday, a military jury began deliberations in the trial of Salim Hamdan, Osama bin Laden’s former driver, on whether Hamdan conspired with al Qaeda in terrorist attacks. The trial is the first U.S. military commission since World War II. In a Pentagon press briefing today, spokesperson Geoff Morrell said the U.S. will detain Hamdan regardless of the verdict:

MORRELL: Even if he were acquitted of the charges that are before him, he would still be considered an enemy combatant and therefore would continue to be subject to continued detention. Of course, that said, he would also have the opportunity to go before the administrative review board and they could determine whether he is a suitable candidate for release or transfer.

But in the near term, at least, we would consider him an enemy combatant and still a danger and would likely still be detained for some period of time thereafter.

NPR’s John McChesney said Hamdan could remain behind bars at Guantanamo for an “indefinite time” after an acquittal. He added that “Hamdan will not get a single day” off his detention for the seven years that he has been held at Guantanamo.

    Why does anyone think we still have a right to complain about other countries? The damage that Bushco has done to our justice system and world standing may prove a more heinous crime than the invasion of Iraq.

    And I fear that innocent citizens of the United States, and "the West" will be paying the price, in blood, long after we're gone. I just hope our grand kids can reclaim the America which the neocons seem Hell-bent on destroying.

    I bet he'd also like to bankrupt a country by tricking it into starting an endless war, beginning with the invasion of a country that was no threat to America. Too bad we can't charge him with fraud, eh? It'd sure as hell be easier to prove.

    Tribbleprick still doesn't get it. An official spokesman has announced that the government is going to ignore the law rather than admit the possibility of a mistake.

    The country that I was raised to revere wouldn't do that. At the very least they would have been smart enough to just shoot the guy and bury him in an unmarked grave. But we aren't even that lucky.

    Our government is so eager to show a tough exterior that they are willing to destroy all that's best about our society. Frankly, if we fall much further, we won't be worth saving.

    so why even bother with the trials? if the individual is acquitted but still won't be released what is the point? No one seriously beliefs the "process" is fair. Just try and hold them forever (or until adults, who think about the consequences of idiotic and illegal actions, re-enter the WH) and be done with it. Seems enough taxpayer money has gone to this charade.

    Yet the government affirms that, even if he is acquitted -- that means FOUND INNOCENT, he will likely not be freed.

    So why bother with a trial in the first place?

    Even more, a trial adjudicated by the same military folks who captured him, tortured him, and have a strong vested interest in finding him guilty in order to justify their actions. And if even this kangaroo court can't find him guilty, he's still in prison.

    Pete: I am with you 100%. I am so proud of the ideals embodied in the constitution but my pride in this country has been severely tarnished by the complete disdain this administration has shown for those ideals and the people. It will take great effort and time for us to regain the international respect we had at times before, if it is even possible. The worst part of all of this, however, is the complacency of the Congress and the people over the last 7.5 years. If people continue to accept the status quo through the next administration, I'm afraid we will never recover. We're sliding down the slippery slope and we've got lots of momentum.

    And that's the $64 million question. The fact is, people who are asked this can't answer it, yet they know the answer. If they do reveal their answer, then their argument for allowing the U.S. to do this goes out the window.
