The Bush Administration’s Plan To Make The Endangered Species Act Extinct

ap060427022458.jpg Today, the AP reports on new draft rules being proposed by the Bush administration to gut the Endangered Species Act. This would be the biggest change to the groundbreaking legislation since 1988, and would not require the approval of Congress.

Currently, federal agencies are required to consult with an independent agency — the Fish and Wildlife Service (FWS) or the National Marine Fisheries Service — to determine whether a project would harm an endangered species. The AP reports that under the new rules, agencies would simply be able to “decide for themselves”:

The Bush administration wants federal agencies to decide for themselves whether highways, dams, mines and other construction projects might harm endangered animals and plants. New regulations, which don’t require the approval of Congress, would reduce the mandatory, independent reviews government scientists have been performing for 35 years, according to a draft obtained by The Associated Press.

The draft rules also would bar federal agencies from assessing the emissions from projects that contribute to global warming and its effect on species and habitats.

This measure mirrors legislation proposed in 2005, by then-Rep. Richard Pombo (R-CA), a close ally of Jack Abramoff. Pombo proposed weakening the Endangered Species Act. Among other measures, Pombo’s bill would have eliminated review by the FWS or the Fisheries Service, allowing agencies to pursue unspecified “alternative procedures.” Pombo’s GOP-majority House cleared his bill, but it failed to go anywhere in the Senate. Bush is now bypassing Congress to push the legislation forward before he leaves office.

The Bush administration has been attempting to bypass or kill the Endangered Species Act for years. Recently, Homeland Security Secretary Michael Chertoff used his power to waive federal laws, including the Endangered Species Act, in order to expedite building the U.S.-Mexico border fence. Unclear if the new rules are the doing of Vice President Cheney, who has been maneuvering increased control over environmental policies.

UpdateInterior Secretary Dirk Kempthorne is backing the rule changes, "saying they will ensure the statute is not used as a 'back door' to regulate the gases blamed for global warming."

    Note, all those public private infrastructure projects don't need to be held up by scientific studies. It's but one brick in the wall of Disaster Capitalism.

    The other is propping up the masters of corporations. New accounting rules, proposed by the SEC, deal with financial restatements. The plethora of restatements came from corporate executives cheating on their executive compensation, by back dating stock options. The widespread cheating cost shareholders dearly and few CEO's ended up in jail.

    One last hint as to Bush clearing brush for business. A proposed rule allows foreign firms to list on American stock exchanges, but they must post their financials in English on their web site. They don't have to follow American financial or accounting standards, just translate their documents. Amazing!

    Well, if that's the case then Obama can just as easily put it back together again when he takes office.

    But, I have a real problem with a President being able to do something this drastic without approval of Congress.

    I fear that Bush will try to totally dismantle the government before he leaves office just to create utter chaos for Obama to have to deal with.

    Congress, come back from vacation and start impeachment proceedings now. Your country needs you more now than they ever have. Please don't let us down.

    Stop, stop! People will think you have no idea what you're talking about. Take a few hours or days off from commenting and read something besides what is spewed by the Washington Times. Start here.

    And, please, spare us the "climatologists are padding their results to get rich" crap. Try inserting [all researchers in all fields] into that sentence and see if it makes any sense at all. Compare the funding from government agencies for climatology research to the levels of funding by the petroleum industry and figure out which would be the quicker route to wealth.

    An old man once told me that some of the Native Americans thought of a person's conscious as a triangular shaped stone in the middle of their chest with sharp edges.
    Every time a person did something that they knew they shouldn't do, the stone turned a little bit in their chest causing pain.     BTW, for the benefit of our trolls, the bottom line is that each species the Earth loses decreases the chances of long-term human survival. The evidence is quite compelling that we are living during a mass extinction event and humans are making it worse. Weigh the profits/losses any way you wish, the simple fact is that we humans depend on the environment we are destroying for our survival.

    P.S. Historically, mass extinctions hit the top of the food chain particularly hard and we humans are the top of the food chain.

    3. Global average temperature is at a historical high and rising.

    4. Many of the predicted effects of rising temps have been observed and a distressing number are progressing much faster than feared.

    None of these assertions is disputed by credible sources. Draw your own conclusions.

    The primary threat to polar bears is the decrease of sea ice coverage. Although some females use snow dens on land for birthing cubs, polar bears are almost completely dependent upon sea ice for their sustenance. Any significant changes in the abundance, distribution, or existence of sea ice will have effects on the number and behavior of these animals and their prey.

    I did read. And I read you listed the State of California as a "radical environmental group".

    California law set a “goal” to be reached in 2050. The Center for Biological Diversity wants to reach it now.

    Nowhere in the law suit does it say that the CBD wants to reach those levels now. Again, there are requirements on new stores construction:

    The Center for Biological Diversity filed suit Wednesday to force Wal-Mart to reduce greenhouse gas emissions from new store construction as required by California law.

    Polar bears are not American animals, per se, any more than the Siberian rubythroat is. They breed in Alaska but spend the vast majority of their lives in international or Russian territory.

    Not only you wrote that, you defended it with subsequent posts on polar bear migration and their living range -even when I was clearly talking about a Siberia-Alaska cross.

Or how about the polar bears breeding in Alaska but spending most of their lives in Russian territory? You know, because polar bears like to go island hopping.
