McCain’s Hypocrisy: Promises To Protect ‘Copyrighted Works’ While Infringing On Artists’ Copyrights

mccainguitar.jpgYesterday, Sen. John McCain (R-AZ) finally released a statement laying out his positions on technology policy. Under a header describing himself as a champion of “fair and open world trade,” McCain promises to “protect the creative industries from piracy“:

John McCain Will Protect The Creative Industries From Piracy. The entertainment industry is both a vital sector of the domestic economy and among the largest U.S. exporters. While the Internet has provided tremendous opportunity for the creators of copyrighted works, including music and movies, to distribute their works around the world at low cost, it has also given rise to a global epidemic of piracy. John McCain supports efforts to crack down on piracy, both on the Internet and off.

As Richard Koman at ZDNet points out, McCain’s stated desire to protect “the creators of copyrighted works” is at odds with the fact that multiple artists have accused his campaign of copyright infringement.

Just yesterday, the Los Angeles Times reported that singer Jackson Browne is suing the McCain campaign and the Ohio Republican Party for copyright infringement because his song “Running on Empty” was used in an ad by the state party, which Browne’s lawyers say “McCain and his campaign were well aware of.” Browne isn’t alone in complaining about McCain:

– Earlier this week, the McCain campaign re-cut a web ad after comedian Mike Myers’ publicist complained about the use of footage of Myers and fellow Saturday Night Live alum Dana Carvey’s Wayne’s World characters.

– Last month, the McCain campaign had to pull and re-cut a web ad after Frankie Valli’s record label, the Warner Music Group asserted its copyright claims over the use of the song “Can’t Take My Eyes Off Of You.”

– Earlier this year, the copyright owners for the “Rocky” theme song “telephoned the McCain campaign to politely complain it was being used without permission.”

Ironically, McCain has joked on the campaign trail that he has refrained from using music by his beloved ABBA because of “licensing and other concerns.” “If you’re not careful you can alienate some Swedes,” said McCain.

    McCain knows nothing about any policy until his handlers whisper in his ear what he should say. Then he forgets his position three minutes later. If it isn’t about an imminent war he can start he’s not even mildly engaged.

    You just have to wonder how “educated” McCain staffers have no clue about securing rights to artists’ material. Remember, these guys will be taking seats in the offices of a McCain administration.
    Ironic that the same staff prepared McCain’s position paper on Copyrights.
    The consequences of this kind of poor coordination of course is benign; but would not bode well for, shall we say, a position on a response to an international crisis.

    This just boggles my mind. I’m a presentation specialist, and I’ve performed this work for a number of different companies. One of the first things one learns whenever one works with communications, marketing, or presentations is the importance of copyright. I would not use so much as a piece of clip art without it being in the public domain or obtaining permission to use it.

    It’s not difficult to pick up the phone and ask if you can use something. Yes, you have to pay a fee, but that is SO much better than getting slapped with a copyright infringement suit that is inconvenient, expensive, and embarrassing. Furthermore, I have found that several times I could use something for free as long as I gave proper credit for it. And even better, once you have cooperation from the copyright owner, they are glad to give you clean copies of whatever you ask for (which will usually be much better to use than whatever can be cribbed off the web or other sources).

    I cannot believe that McCain’s (or anybody else’s) marketing firm would be so stupid and unprofessional as to try to get away with copyright infringement. It makes no sense.

    1) They probably don’t have that many friends to begin with.

    2) The friends they have, they probably just steal from, making them ultra defensive about anything they could confuse with stealing. Like people actually, genuinely sharing something.

    It’s funny. The educational trend towards nationwide standardized tests and abstinence only sex-ed, and basically this efforts to dismantle the PUBLIC education system seem to reflect repugs base traits: ignorance, fear, and deceit.

    I think they should teach basic ethics – Golden Rule type stuff minus religiousity – K through 12.

    I’ll give him a partial pass on this. I doubt he intentionally is infringing. More likely, This is just yet another example where he was on a committee that legislated something, but he had absolutely no understanding of it. (And let’s add that beyond 8 tracks and Beta, the issues of copyright involve the use on the Internet which he understands so well.)

    The problem is that the individual artists probably won’t get access to him to make it right. However, a large publishing house, is likely to be a major supporter and lobbyist. They are likely to institute some of their plans which protect the publisher while gouging the artist and public.

The military under orders not to speak out may never convey Karl Scharz’ expose’.
