For The Fifth Time, McCain Campaign Illegally Uses Artists’ Copyrighted Music»

Last night at the conclusion of the GOP convention, the Sen. John McCain’s (R-AZ) campaign blasted the song “Barracuda” by Heart. The tune is meant to be a theme song for Gov. Sarah Palin (R-AK), whose high school nickname was reportedly “Sarah Barracuda.” Watch a clip of Republicans rocking out to the song:

The problem is that the McCain campaign never obtained legal permission to use the song. Heart’s representative issued a statement:

The Republican campaign did not ask for permission to use the song, nor would they have been granted that permission. We have asked the Republican campaign publicly not to use our music. We hope our wishes will be honored.

Last month, McCain released his technology policy, in which he promised to “protect the creative industries from piracy.” Yet as ThinkProgress has reported previously, McCain has infringed on artists’ copyrights on at least four other occasions:

- In August, singer Jackson Browne sued the McCain campaign and the Ohio Republican Party for copyright infringement because his song “Running on Empty” was used in an ad by the state party. Browne’s lawyers said that “McCain and his campaign were well aware of” this fact.

– In August, the McCain campaign re-cut a web ad after comedian Mike Myers’s publicist complained about the use of footage of Myers and fellow Saturday Night Live alum Dana Carvey’s “Wayne’s World” characters.

– In July, the McCain campaign had to pull and re-cut a web ad after Frankie Valli’s record label, the Warner Music Group, asserted its copyright claims over the use of the song “Can’t Take My Eyes Off Of You.”

– Earlier this year, the copyright owners for the “Rocky” theme song “telephoned the McCain campaign to politely complain it was being used without permission.”

    While it’s hypocritical of him, I think the more progressive stance on the issue is abolishing so-called “intellectual property” in the sense that we currently conceive of it.

    Art should not be viewed as a commercial product, nor should someone own its “rights.” Art and ideas are for humanity to use and re-interpret. “Intellectual property” should become public domain a very short time after initial release (maybe the original seven years specified by the Constitution), this way society can adopt cultural artifacts organically.

    Any marketing firm worth its salt KNOWS about copyright law and the importance of gaining permission to use anything that isn’t public domain. Furthermore, any professional marketing firm knows how to get such permission — it’s not difficult to go through the steps. And it’s unlikely that an organization the size of the McCain campaign and/or the national Republican Party would be having money issues about this.

    If this happened once, it could possibly be chalked up to a communication or administrative error. But when it happens all the time, it means the marketing firm is flagrantly violating the law with the knowledge they are doing so. And if money isn’t the issue, it must be that for most of these songs, they couldn’t get permission no matter how hard they begged (kind of says something about their popularity, doesn’t it?).

    Just once, I wish the artists and holders of these copyrights would quit with the polite “cease and desist” requests and start suing their a$$es.

    As a musician, I’m typically all about the most people hearing my stuff as possible, but I this is exactly where I would draw the line. I would be more than a little vocal if the RNC tried to pull this with my art and it would have absolutely nothing to do with the money, but everything to do with principle. They, and what they represent, is a major reason so much music and art is created and to see it co-opted by the “enemy” is simply out of the question.

    Worst.Campaign.Ever.

    It’s too scary to imagine what they would (continue to) do to our Country. Everything seems so blatantly short-sighted like attacking the media and Palin, in general, it’s just another win-at-all-cost scenario. It’s like they haven’t even considered the long-term effects of demonizing the media in regards what it would then be like if they somehow actually won the election.

    You have to wonder whether this is intentional or incompetence by McCain’s campaign and the RNC. The creative class doesn’t produce a lot of Republicans. Perhaps the Rs figure they can steal the tune a few times before they get caught and the masses never read these stories about the artist protests. Not sure whose stuff they could get permission to use. Pat Boone is a good Republican but doesn’t exactly get the crowd excited. Maybe Brittney Spears? Personally I think “Oops, I Did It Again” would be a perfect theme song for this campaign.

    A reasonable argument to make. One that would require a change in the law. UNTIL THAT TIME McCain should follow the law at this point, the law is what it is, McCain is stealing, AND as Jackson Browne pointed out trying a backdoor attempt at getting endorsements when he has a better chace of ice skating in hell then ever actually GETTING them

    The two aren’t always the same. The copyright holders are often not the artists, but the record companies who are quite eager to ensure that the next president appoints an FCC chair friendly to their needs, or whose FTC won’t aggressively pursue payola scandals, or who’ll sign legislation granting them even tighter control over their intellectual property.

    That’s why they’re so polite about it.

    Oh I dont have to wonder its intentional. Jackson Browne has been an outspoken liberal since the sixties. He is one of the guests on the Nation magazine cruise this year. McCain had a better chance of winning the Nobel prize for gumchewing with his ASS than getting permission to use one of Jacksons songs for his campaign commercial

    I am inclined to agree that the theft is intentional. Don’t assume however that McCain or his henchmen know the politics of their targets, especially since they pretty clearly don’t listen to anything but the chorus. As toasterhead correctly noted, the lyrics of Barracuda do not complement the song’s subject. The precedent of Ronnie Raygun’s attempted appropriation of Born in the USA also demonstrates how incredibly thick these people can be.

    I ment actually producing hit songs for a longer period of time. Heart produced their “hits” from about 1975 to 1982, i.e. 7 years. Brooks and Dunn had consistantly produced hit songs since 1991 to the present, i.e. 17 years. In producing hit songs the comparision between these two bands?…there is no comparision.

    I’m just saying that the properly socialist thing to do would be for all art to become public domain after a small period of time during which the artist should be able to profit from the work.

    To those who seem to think I’m a Republican troll, I’m actually more aligned with the Bolivarian socialism Chavez is attempting to establish (mixed feelings about his methods but the ideals are very nuanced, with an emphasis on human creativity and expression being essential rights, as well as community values being important).

    Furthermore, I would call myself a creative individual who composes music and literary non-fiction. I also use free software and believe information should be free to all for non-commercial uses. On that point alone, McCain should be allowed to use the songs non-commercially (though one could argue [myself included] that American elections are highly commercial!)

    Vote Nader in November, Obama will win this election anyway

    It’s no so much “permission” the artist demands, it’s compensation.

    But in order for the artist to get paid, one must first ASK permission to use the song, and very rarely from the artist directly. There are clearing houses of music licensees who handle the publishing/copyright compensation/distribution for any tune requested.

    Sometimes, the artists isn’t aware until the check comes in the mail.

    However in this case, as in most political scenes, no permission was obtained.

    My group had a song used by the Texas RNC for one of Shrub’s Austin rallies in 2000 and we nor our publisher were ever contacted, much LESS EVEN compensated for using our music.

    But as an artist, you’ve got to know these things happen and are often beyond our control (or compensation).

    Yes, I’ve listened to some of Wrights sermons- including the one where his quoting of a reagan official were taken out of context and used to smear Obama and when you listen to the whole sermon they make alot of sense.
    Something that cannot be said for Palin’s preachers sermons or the guest from Jews for Jesus her church invited TWO WEEKS AGO.
    I notice you had no thoughts on that little bit of insanity… oh, and the FULL sermon is available at my link- not just the stuff that makes it sounds crazy, ’cause it ALL sounds crazy!!

    China’s economic system is not based on a communist state planned model. This government uses capitalism and free markets to enrich itself while it’s people are kept working and silenced. It’s political system, which is basically a police state, is just like the KGB during the Soviet Union which kept the people under their boot. Do you actually think that the masses acually get to enjoy all of the wealth that the government controls? It’s just a matter of time untill the communist government collapses and democratic reform takes hold. Communism doesn’t work, never has worked, and never will work.
