Just Like Bush White House, Palin Uses Personal E-mail Accounts And Claims Executive Privilege»

palin-mccain-crazy.jpgThe Washington Post reports that Gov. Sarah Palin (R-AK) is “being asked by a local Republican activist to release more than 1,100 e-mails she withheld from a public records request, including 40 that were copied to her husband, Todd.” Invoking a favored practice of the Bush administration, Palin has claimed executive privilege to keep the e-mails secret — despite the fact many of them were sent to Todd, who is not an elected official.

What’s more, Palin and her staff intentionally use her personal Yahoo e-mail account, perhaps to avoid document release requests:

Palin also routinely does government business from a Yahoo address, gov.sarah@yahoo.com, rather than from her secure official state e-mail address, according to documents already made public.

“Whoops!” Palin aide Frank Bailey wrote, after addressing an e-mail to the governor’s official state address.

“Frank, This is not the Governor’s personal account,” a secretary reminded him.

The lawyer filing the request pointed out that the point of government e-mail is to ensure “security and encryption.” “She’s running state business out of Yahoo?” he asked. Mother Jones reports that Palin’s refusal to hand over e-mails stands in violation of the Alaska Public Records Act.

Palin’s move is eerily reminiscent of Bush administration ploys to dramatically increase secrecy in government, such as when White House aides switched to personal e-mail accounts to avoid subpoenas during the investigation into U.S. Attorney scandal last year:

But just a week after E-mails in the U.S. attorneys case became a main focus of congressional Democrats probing the firings, several aides said that they stopped using the White House system except for purely professional correspondence. […]

At least two aides said that they have subsequently bought their own private E-mail system through a cellular phone or Blackberry server. When asked how he communicated, one aide pulled out a new personal cellphone and said, “texting.”

As Josh Marshall pointed out at the time, if the White House was using personal e-mails, “they can’t have even the vaguest claim” to executive privilege. Similarly, the fact that Palin copies her husband on her e-mails and often uses a personal account raises the question of whether her e-mails are actually official executive business.

Palin’s commitment to secrecy and her stonewalling of an ethics investigation into her role in “Troopergate” are more evidence that a McCain-Palin administration would be little more than a third Bush term.

Digg It!

  5. misshusseinmolly Says:

Does anyone know what the rules are for personal e-mails? It would seem that an e-mail to one’s spouse saying “I’m going to be late — can you pick up the kids?” wouldn’t exactly fall in the category of state business, and such a message could be sent from one’s personal e-mail account. On the other hand, using a personal e-mail account for anything one wanted to keep away from accountability procedures has the potential of being seriously abused.

I would hate to think we need to spy on our elected public servants’ personal communications just to keep them honest, but it’s beginning to look like we might have to. Thanks, Bush — thanks, Cheney — thanks, Palin — you may have just screwed every other politician in the future.

No, I’m afraid they would be much, much worse than bush. It would be bush/cheney with more secrecy, more invalid use of ‘executive privilage’, and even less accountibility (due to the precident set by this criminal admin). People that speak out against them will become ‘missing’ somewhere in the last great frontier (Alaska).

Yes, and let’s remember what troopergate is all about.

And she replaced him with a two-bit hack who got fired after two weeks on the job for sexual harrassment. Good thing they don’t have hurricances in Alaska.

Hey RR, because you probably don’t have a bible and don’t know scripture, here you go:

“Woe to you, scribes and Pharisees, hypocrites! For you devour widows’ houses, and for a pretense, make long prayers. Therefore you will receive greater condemnation.
“Woe to you, scribes and Pharisees, hypocrites! For you travel land and sea to win one proselyte, and when he is won, you make him twice as much a son of hell as yourselves.”
    — Jesus Christ, Matthew 23: 14-15

Before you start with your religious bullshit, try getting a bible and reading it. I am not religious but know a HELL of a lot more about scripture than you, hypocrite!

“Why do you think America’s youth is having problems?”

    Oh, my turn, my turn!
The short answer: No Children Left Behind
A failed attempt by a failed president that is failing our children and their future in their ability to compete on an international level.

    The longer answer:
The immoral behavior of the Republican Party tells America’s children that lying is acceptable. Cheating is rewarded and f#cking everyone from a lower social stature than yourself is doing God’s work. We have a president who has been lying to the American people and breaking laws for eight long years. We have a Republican Party that for every election cycle that I can remember in recent history promotes and rewards underhanded and often illegal practices to gain power. We have a main stream media that rather than report truth and fact feels it is more important to spend their newscasts discussing teen idols and spreading Right Wing propoganda to our nation. To sum up, I will leave you with some words from one of the forerunners involved in dumbing down the nation:
“As people do better, they start voting like Republicans - unless they have too much education and vote Democratic, which proves there can be too much of a good thing”

If Obama wants to succeed in winning the Presidency,he should put all his effort in exposing the Republican party itself which ruled the country for a long time.
Attacking Palin and McCain in a ‘tit for tat’ fashion might not be helpful to Obama, because that will help McCain and Palin to escape from what the Republicans policy failures lead this country to.
Media loves these political’cat fights’,but that’s not what the issues are all about, such as the media in the last 24 hours went frenzy over ‘pig lipstick ‘remarks by Obama.
By linking both of McCain and Sarah to the failures of the Republican party,Obama can succeed, because Americans need to be reminded that in year 2000 gasoline price per gallon was between $1.19 to $ 1.25, and now it is over $3.50 ,
Americans need to be reminded that we had surplus until year 2000,and now we have huge budget deficit.
Obama must not let the GOP party escape that,in addition to war and foreign policy issues.
He should Put McCain and Sarah on the defence explaining GOP party failures over the last 8 years which both McCain and Sarah are leader in..
Sarah Palin now is a big distraction, intended or not, to Obama.
Obama needs to stay focus..and keep attacking Republicans policies whether they are local or foreign.
I think Joe Biden is doing a better job focusing on the issues and the Republican party itself, away from this ‘tit for tat’ exchange.

As the regular posters here know, I’m from Kalamazoo. Portage is a suburb of Kalamazoo. Palin’s son attend Portage Central his senior year.
Now, why would a 16 year old from Alaska attend high school here?
Because, it is reported, to play hockey, and this area is a “hot bed” of hockey talent.
    Huh?
    1) Portage Central does NOT have a hockey team. Prospective teen aged hockey players have to play in a sponsored league in Kalamazoo.
    2) This is not a hot bed for hockey talent. Sure, we are passionate about hockey here, but I know of no superstars that have budded here (unlike baseball’s Derek Jeter).
You want to be seen by scouts for hockey? Go to the suburbs of Detroit, or northern Minnesota, or Maine, but not Kalamazoo.

Of course, the hockey aspect could all be true, but in the back of my mind, I do wonder: was the sending of her son to Portage Central for his senior year a cover up for something else?
With her and her family’s track record, ya just never know!

Executive privlege and spousal privilege are treated similarly. In the instance of executive privilege, it’s designed to encourage honest and open discussion between the executive and the staff. Executive privilege is lost when the “conversation” between the executive and the staff includes someone who is neither the executive nor the staff. In this case, e-mails addressed to Todd Palin are not subject to executive privilege because Todd is not on the governor’s staff.
In the case of spousal prvilege, when an e-mail is addressed to someone other than the spouses, executive privilege is lost. Just think if polygamy was legal!!!

  109. pete Says:

Spot on, A Patriot Acting, but you missed one. The Evangelicons(TM) have, in addition to their ethics, hindered youth with their “war on science”.

Having attended school long before the “(I)Moral Majority” gained a voice, the only time religion was ever brought up was in an elective course on Greek mythology. And, as a young adult, Carl Sagan was teaching us to view ourselves as a tiny part of a vast continuum that can be described and understood even if things are left unexplained.

Now? The message seems to be that we are God’s special children and he’ll fix whatever we screw up or, at worst, the “Unbelievers” will pay the price. Science is considered much like witchcraft in the 16th century and pseudoscience is the usual prime time fair.

We are locked in a battle of Belief vs. Knowledge and the GOP is on the wrong side, to the detriment of all. It’s not a new struggle and the outcome is much in doubt. I never would have expected it would happen, again, in the era of space exploration but, the reality based community got complacent, overconfident, and lazy. Thank the fates, at least the opposition is being heard. We have joined the battle. Let’s hope it’s not too late.

Thanks for your explanation — it was very helpful. It also added something I hadn’t even thought of.

I had heard the theory that Todd Palin was really the person running Alaska, and that Sarah was just his puppet, but I dismissed that as being rather far-fetched (although in the increasingly bizarre world we live in, you never know for sure). At first, the revelation that Sarah copied Todd in on so many of her e-mails appeared to give this theory some legitimacy.

Now it seems a more likely scenario is that Sarah is using Todd to hide stuff under “spousal privilege”. I wonder if Todd even reads them.

  118. Shayne Says:

    2. Sarah Palin was married on August 29, 1988. She eloped.

    3. 38 weeks is the typical human pregnancy.

    4. 38 weeks before her son’s birthday, April 20, 1989, is July 28, 1988 - i.e., that would be the hypothetical day of conception.

    5. If this data is correct, that would mean that Sarah Palin eloped four weeks after her son’s conception.

Actually full term is 40 weeks. Like mother like daughter.

  120. DRxJ Says:

And here’s a quote from a not nicey nice link at salon.com:

Sarah just spoke in Sterling Heights, Michigan (Detroit suburb). During that speech, she told us that her son (that son who is heading for Iraq)… she told us that her son came to Kalamazoo, Michigan (NOT a Detroit suburb), and went to school, and played hockey, when he finished high school, a couple years ago.

This seems odd. Why? She did not say. We know that her daughter (Bristol, the pregnant daughter) left her high school in Wassila, and went to a high school in Anchorage last year. And we know that Sarah herself changed colleges six times, and finally got a degree after six switches.

Is there some pattern here? Most important question: How in the world did Sarah’s son get to Kalamazoo, Michigan? I will research. Maybe some of you will look into this too.

  121. A Patriot Acting Says:

    Thanks Pete-
Dead on with the science tip. Carl Sagan has been an inspiration of mine for some time as well. One of my favorite Saganisms drives home your point perfectly. Sadly it has become a bit too prophetic for me:

“Finding the occasional straw of truth awash in a great ocean of confusion and bamboozle requires intelligence, vigilance, dedication and courage. But if we don’t practice these tough habits of thought, we cannot hope to solve the truly serious problems that face us - and we risk becoming a nation of suckers, up for grabs by the next charlatan who comes along.”

  128. pete Says:

Sagan was one heck of a teacher, Patriot. But prophetic? Nah. He just knew as much about history as he did about the Cosmos. We are in a cycle that stretches back before written history. The good news is that the trends will, inevitably, reverse. The bad news is that it’s impossible to predict where the “bottom point” lies.

We could be past it or the real tumble could be just beginning. This election will tell us a lot and could mark a major shift either way. And, good or bad, I think that things will happen more quickly than we might expect. And if the “Religious” Right is splintered or soundly thrashed? The changes are virtually guaranteed to be for the better.

Then, of course, there’s the added step of hounding those in office to do the right thing. There’s someone in my Rep’s office who answers my emails on a first name basis. It may not be my Rep personally but, it’s obvious they are being read. I accept that as a small victory.

American Democracy in action. In spite of the peril of our times it’s exciting stuff. And, on good days, I remind myself that there are still strengths in our system and a motivated/angry electorate can get things done in a hurry.

  135. CitizenE Says:

Palin is a distraction, and McCain is rapidly becoming one in their say one thing, do another cult of personality candidacies.

But here’s one for the Fundies:
Jesus never said blessed are the warmongers. He was an extreme pacifist that suggested to “resist not evil” and “turn the other cheek.” Even in the more warlike Old Testament God condemned the greatest hero of the Jews, David, for his warlike nature.
Jesus requested of his followers that they keep their prayers intimate and away from the public eye,” insofar as praying for things like pipelines, we have his strongest view on acquiring wealth when he said, “It is harder for a camel to pass through the eye of a needle than for a rich man to enter the Kingdom of Heaven.”

A singular example of his anger occurred when he tossed the Pharisees out of the temple for their lending practices that exploited the poor. Our modern day Pharisees our people like McCain and Phil Graham who have worked legislation to deregualate the S&L Industry in the 80s and lending institutions that have currently led to the foreclosure crisis that threatens to upend the financial health of the entire world and at the very least will require our citizenry or our children or our children’s children to bear the financial burden as a result.
Jesus was not about zapping people through their cell phones, or creating war plans that lead to the deaths of hundreds of thousands, the displacement of hundreds of thousands more. I believe the most fundamental communication of the Christmas season has always been “Peace on earth, good will toward all of humanity.” A pit bull in lipstick is not what his words reveal that he had in mind.

It’s odd, Shayne. My (R) Senator, who’s up for reelection, answers my correspondence promptly with frighteningly wrong ideas which match his voting record. My (D) Senator, who’s in the the “off-year” provides form letters. Eventually. But, I like her voting record.

Hi Rapture Ready. When is that darn Large Hadron Collider gonna git’r done. By the way, you’re screwing up the story line by saying she was right to ban books because she didn’t. She just wanted to. This is the talking point they use (well other, than the second part)

    # Track was a full-on OxyContin addict in 2006 and 2007, the Enquirer says, and was mainlining the drug. Which is very bad.

With a name like Track, it was predestined to be an abuser.

You Democrats are ridiculous. What do you have against Gov. Palin? Are you itimidated because she is a child of God?

I’m pretty sure that his bat-scat crazy mother had something to do with it as well, aside from giving her kids stupid names.

Seems like a Yahoo email address would be easy for hackers to get into rather than a secure government server. Wink wink nod.

Willow is definately gonna grow up to join some sort of messed up cult. I’ll bet their are even some birkenstocks in this “conservative family values” clan. If it comes out that these folks ever had a volvo or a bootleg dead cassette, the jig is up

  147. the Lone Voice of Reason Says:

Palin’s office approved a state job for a friend and campaign aide with whom she shared a land investment, financial records and interviews over the past two weeks show. She hired a former lobbyist for a pipeline company to help oversee a multibillion-dollar deal with that same company.

She named a police chief accused of harassment to head the state police. And she sent campaign e-mails on her city hall account while serving as mayor of Wasilla — conduct for which she later turned in an oil commissioner on ethics charges.

Thank you Yahoo News Headlines. If any morons disagree they could look it up for themselves if they know how to surf the net. That was a direct cut and paste, in no way altered by myself. And we will have much more of the same if the McMorons get in office.

  148. the Lone Voice of Reason Says:

LibertyLover- leave God out of politics-even our Founding Fathers knew at the birth of our country that religion and ethical politics have nothing to do with each other and can be used as discrimination. Freedom of choice for religion, including the right to have none, are Constitutional for a reason. Or if you prefer, Render unto Ceasar that which is Ceasar’s, and unto God that which is God’s. Don’t lip sync the Bible to validate your bogus opinions and try to keep up with the real debaters on the real issues that affect our nation.

  149. the Lone Voice of Reason Says:

Oops!! The Header for that last post was for Rapture Ready, Not Liberty Lover. My bad. Though why do I bother to reply to that nutjob and validate his/her egotistical self-worth? Shouldn’t try to do ten things at once I guess. Mea culpa.

  150. triciaprimakov Says:

Rather than wasting time and money moving George Bush out of the White House this January, why don’t we save some money for the tax payers? We can put him in a dress and make him wear a wig and some lipstick. That’s pretty much what we will get with Palin. McCain can wander the halls aimlessly trying to figure out how many homes he owns and what kind of car he drives.

I can’t wait to hear how using your personal e-mail address and ccing your husband on them is covered under executive privilege. This adds a whole new dimension to this Troopergate drama considering her husband claims Palin had NO idea that he had met with the Police Chief. Sure she didn’t. She obviously clues her husband in on business, I don’t see why it would be the reverse.

Just what this country needs….4 more years of Bush!
