The state Senate Judiciary Committee voted 3-2 today to give a state investigator the power to subpoena Todd Palin, the husband of Gov. Sarah Palin, “in an investigation of whether Palin abused her power in trying to get her former brother-in-law fired.” The prosecutor, Stephen Branchflower, said Todd Palin is “such a central figure.” He added that wants to interview Sarah Palin but did not ask for a subpoena for her.

September 12th, 2008 at 5:15 pmIt depends on if they are interested in what Todd can say about Sarah's doings, or what Todd can say about Todd's doings.
If Todd is being asked to rat Sarah out, he will probably claim spousal privilege. if he's being asked to rat himself out, he will probably claim the fifth. But if he throws up any obstacle at all, it will look like there's something to hide. On the other hand, if no wrongdoing has been committed, and the whole thing is just a product of a Wooten vendetta, Todd will have no problem cooperating.
I think the state investigator just wants to get to the bottom of this. And now, so does the rest of the country.

They will discover that they must talk to her before they make their determination and will have to subpoenae her, which means they will need more time to complete the investigation.
In that way the results will be delayed until after the election.
September 13th, 2008 at 2:23 pmThere is no such thing as a 'spousal privilege' in administrative and civil proceedings. It is only in a criminal proceeding that one cannot be compelled to testify against one's spouse, and in which such a protection can me invoked.
Nothing prohibits voluntary testimony in such cases: only the forcible compulsion to testify.
Todd Palin is likely a critical player in this matter, however, as it is becoming apparent that his 'dutiful wife' does nothing without his involvement and his permission. Consistent, no doubt, with her ultra-conservative co-mingled religious and political leanings.
It's hard to get your head around such glaring inconsistencies, but there you have it.
