Connecticut Supreme Court rules that gay couples have the right to marry.

In a 4-3 decision released this morning, the Connecticut Supreme Court ruled in favor of marriage equality, stating that same-sex couples have the right to wed. Citing the equal protection clause of the state constitution, the justices ruled that civil unions were discriminatory. From the ruling:

Interpreting our state constitutional provisions in accordance with firmly established equal protection principles leads inevitably to the conclusion that gay persons are entitled to marry the otherwise qualified same sex partner of their choice. [...]To decide otherwise would require us to apply one set of constitutional principles to gay persons and another to all others.”

The Hartford Courant notes that “the court’s ruling today will likely be the final judicial judgment in the case because it it based on the state constitution, rather then the U.S. constitution.”

UpdateGov. Jodi Rell (R) pledged to uphold the ruling, though she disagreed with it: "The Supreme Court has spoken," Rell said. "I do not believe their voice reflects the majority of the people of Connecticut. However, I am also firmly convinced that attempts to reverse this decision -- either legislatively or by amending the state Constitution -- will not meet with success. I will therefore abide by the ruling."

    There was a case decided on the same grounds in Hawaii years ago. Even Ruth Bader Ginsberg, (actually especially her because she often spoke about the discrimination she faced) voted to hear the case and to strike down the decision. I wouldn't hold my breath on the state law prevents review theory.

    It's not a 'state law prevents review theory' issue.

    It is the long held belief that the law which affords greater protection trumps that which provides less. In this case, the greater protection is afforded the individual right and not some amorphous protection given at the Federal level to the 'institution' of marriage, as traditionally held.

    It's the reason that in Hawaii, for example, greater protection against 'unlawful' search and seizure procedures are afforded by the Hawaii Supreme Court's Joao decision, which is squarely at odds with the United States Supreme Court's decisions regarding 'plain view' exceptions to the 4th Amendment protections regarding search and seizure.

    Now that New York state will recognize any legally performed gay marriage (even though gays still cannot legally marry in NY), I imagine that Connecticut didn't want to see Massachusetts getting all the NY wedding business without some competition.

    No matter. The wedding industry makes money, gays get the same rights as straights, and the world won't fall apart (despite the dire warnings of the Darylls of the world).

    That's three states now that have legalized gay marriage (California, Massachusetts, and Connecticut), and two that have legalized gay civil unions (New Jersey and Vermont). And a sixth state -- New York -- that promises to recognize all these relationships.

    Six down, forty-four to go. Progress is being made.

    Great news for the gay couples I know! They all married in 'civil unions' but this is better of course.

    I heard a rumor awhile back that McCain was considering Jodi Rell for his VP and I thought, "Oh no!" - reason being that he would have had a good shot with her, well more of a shot anyway.

    Jodi Rell is well thought of in Connecticut even though she's a Republican. I know a lot of people who voted Democratic across the board in the last election, except that they voted for her. She's a good administrator, can appeal to both sides and has been a steadying force in Connecticut.

    This is fantastic. My heart soars every time I read about the good loving couples who will now be able to marry. This is a great day for them, a great day for their children, a great day for Connecticut, and a great day for America!

    I hope that next time Biden and Obama are asked whether they support the basic civil rights of gay people their answer will have evolved from the soft bigotry they peddle now. I hold no hope for Palin or McCain.

    WHO CARES? Why on earth does that matter? This issue is not the same as a SPLOST proposal or who will serve as governor. This issue is about BASIC HUMAN AND CIVIL RIGHTS. Such rights CANNOT be put up to the popular vote. Does anyone really think that blacks would have been given the right to vote if white people got to decide on it in an election?

    -- They probably did. Financial and mortgage firms (like many other industries affected by regulation or the lack thereof) give generously to both parties. I would still be willing to bet the GOP got significantly more. But hey -- if you have some actual data proving that the Democrats got money and the GOP didn't, by all mean -- provide it.
