Troopergate investigation finds Palin ‘abused her power.’»

The investigator authorized by the Alaska Legislative Council to examine the “Troopergate” scandal released his report today, and found that Gov. Sarah Palin (R-AK) “abused her power” by pushing State Police Commissioner Walt Monegan to fire her former brother-in-law Mike Wooten:

For the reasons explained in section IV of this report, I find that Governor Sarah Palin abused her power by violating Alaska Statute 2952.110(a) of the Alaska Executive Branch Ethics Act. Alaska Statute 2952.110(a) provides

“The legislature reaffirms that each public officer holds office as a public trust, and any effort to benefit a personal or financial interest through official action is a violation of that trust.”

The investigation also found that Monegan’s refusal to fire Wooten “was likely a contributing factor to his termination as Commissioner of Public Safety.”

UpdateMcCain spokeswoman Meg Stapleton released this statement:

Today's report shows that the Governor acted within her proper and lawful authority in the reassignment of Walt Monegan. The report also illustrates what we've known all along: this was a partisan led inquiry run by Obama supporters and the Palins were completely justified in their concern regarding Trooper Wooten given his violent and rogue behavior. Lacking evidence to support the original Monegan allegation, the Legislative Council seriously overreached, making a tortured argument to find fault without basis in law or fact. The Governor is looking forward to cooperating with the Personnel Board and continuing her conversation with the American people regarding the important issues facing the country.

    The legislative panel met for six hours before making a unanimous decision to release the so-called “Troopergate” report. The vote was 12-0 to release the report, except for certain parts they consider confidential.

    Alaska lawmakers began reviewing the lengthy and politically sensitive investigative report early Friday focusing on whether Palin abused her authority as governor.

    Now, I’m not a lawyer, but I’d always heard that for a statute to have the full force of law, it’s supposed to be specifically worded “shall,” not “will.”

    Does this mean the statute is weakly written, to allow such abuses of power?

    I find that, although Walt Monegan’s refusal to fire Trooper Michael Wooten was not the sole reason he was fired by Governor Sarah Palin, it was likely a contributing factor to his termination as Commissioner of Public Safety. In spite of that, Governor Palin’s firing of Commissioner Monegan was a proper and lawful exercise of her constitutional and statutory authority to hire and fire executive branch department heads.

    It seems to go like this ( I just read a bunch of the report)

    2005
    Wooten and Molly Palin get divorced.
    Some time later Palin;s Dad makes a complaint against Wooten which is then investigated.
    The Palin’s dad and Todd Palin make additional complaints which are also investigated, and this lengthens the investigation.

    Palin’s dad calls to ask what’s happening, why is the investigation taking so long.
    He is told it’s because of the added complaints but the investigation is being conducted and he can’t tell him anything more because of a specific legal statue that he cites that prevents public discussion of personnel issues.

    Todd Palin calls with the same question and gets the same answer ( and the specific statute #).
    Sarah Palin calls with the same question and gets the same answer. ( and the specific statute #).

    Investigation complete, Wooten gets some discoplinary action ( not sure for what)–something like a brief suspension or something. He stays on the force.Case closed.

    Todd and Sarah aren’t happy about this. They hire a private detective.
    Sarah becomes governor, Todd first Dude.
    Then Todd askes Moeghan to look over his PI file, compare it to the Trooper investigation to make sure “nothing had been missed”
    MOneghan does so and two day later tells Todd that there was nothing new and the case was closed.
    Then Sarah calls Moneghan, just to discuss Wooten. Moneghan says you know we can’t discuss this.
    Then just about every memeber of Sarah Palin;s staff ( about 6 of them) press him on Wooten and he tells them all as they should damn well know, that any such conversations would be ‘discoverable’ and that there were no firing offenses and the case was closed…
    UNLESS said Moneghan you want to charge Wooten with killing the moose without a licence, but then that would bring Palin;s dad into it as he’d help butcher the moose and transport etc and Wooten and a ew other people involved too.
    Nope, they just wanted Wooten.
    Other charges against Wooten like dropping his kids of at school in a cruiser turned out to be with permission of his supervisor.
    The Palins made accusations which were proven crap and the oone issue they could stick Wooten on involeved the Palins themselves too.
    Still Todd and Sarah had their staff continue to hassle Moneghan (and his own staff) about Wooten.

    It was a personal vendetta and they used the Governor’s Office and it’s implied and real powers to conduct it.

    My spouse has been a teacher. She still does volunteer work at learning to read.
    After she first retired, a teacher at a nearby school developed acute kidney disease. Said spouse was asked to sub and agreed. It turned out to be a job that lasted until the end of the school term. On the last day, as she was packing up her stuff, she heard little second grade voices singing “We love you Mrs. TheMan.” and the entire class walked in with their mothers in tow. She received some nice mementoes that she keeps to this day. Also a video tape that throws her into tears whenever she watches it.

    Stapleton failed to respond to the findings. Nobody was charging that Palin lacked to authority to fire a Cabinet member, even for no reason at all. The charge was that she abused her power as Governor by pressuring subordinates to fire Trooper Wooten. The report found her guilty of that charge and said she also violated State ethics laws with her action. The report received a unanimous vote.

    The next move should be up to the ethics committee on what action, if any, to take in regard to these serious charges. My guess, though, is that nothing can/will happen before November 4th.

    My word, I certainlyhope they can prove that in court, because it certainly looks like the McCain campaign just libeled a private citizen. And if they did, hoo, boy. Wooten isn’t a public figure by any stretch of the imagination, so the laws concerning libel, and defamation of character are much more protective of his rights as a private citizen.

    I see a big settlement coming for Wooten - and it will come right out of what’s left of the McCain campaign coffers.

    The McCain campaign blamed the whole mess of Wall Street on Obama,although it is well known that the financial gambling barons on Wall Street were encouraged by lack of regulations which McCain and his buddy ex- Senator Graham granted them in legistlations they sponsered and passed in the Senate.

    Now McCain camp is blaming this damaging report about governor Palin on Obama again.
    Although the majority of the commission are Republicans,and the investigation started even before Sarah was selected as Vice President,there was no hesitancy on the part of McCain’s camp to blame Obama for this report.
