The investigator authorized by the Alaska Legislative Council to examine the “Troopergate” scandal released his report today, and found that Gov. Sarah Palin (R-AK) “abused her power” by pushing State Police Commissioner Walt Monegan to fire her former brother-in-law Mike Wooten:
For the reasons explained in section IV of this report, I find that Governor Sarah Palin abused her power by violating Alaska Statute 2952.110(a) of the Alaska Executive Branch Ethics Act. Alaska Statute 2952.110(a) provides
“The legislature reaffirms that each public officer holds office as a public trust, and any effort to benefit a personal or financial interest through official action is a violation of that trust.”
The investigation also found that Monegan’s refusal to fire Wooten “was likely a contributing factor to his termination as Commissioner of Public Safety.”
Today's report shows that the Governor acted within her proper and lawful authority in the reassignment of Walt Monegan. The report also illustrates what we've known all along: this was a partisan led inquiry run by Obama supporters and the Palins were completely justified in their concern regarding Trooper Wooten given his violent and rogue behavior. Lacking evidence to support the original Monegan allegation, the Legislative Council seriously overreached, making a tortured argument to find fault without basis in law or fact. The Governor is looking forward to cooperating with the Personnel Board and continuing her conversation with the American people regarding the important issues facing the country.
Does this mean Monegan can sue her for reinstatement, and damages?
A good friday, for a change.
October 10th, 2008 at 8:44 pmCNN is reporting that Sarah Palin “violated an Alaskan statute”, but the banner says she “Broke no laws.” I thought violation of a statute was the definition of breaking a law.
October 10th, 2008 at 8:45 pmPalin can’t be trusted. Fact.
October 10th, 2008 at 8:46 pm“Troopergate investigation finds Palin ‘abused her power.’”
- - The report also says that Palin did nothing unlawful, she just violated the public trust. So, bupkes.
But tell us again, Sarah, how we can’t trust Obama whe you’ve just been officially “convicted” of violating the oublic trust as a sitting Governor of Alaska.
Hip. O. Crit.
October 10th, 2008 at 8:46 pmMcCrazyF ucker had to defend Obama twice today, and now this…?
HAHAHAHAHAHAHAHAHAHAHAAAAA!!!!!!
October 10th, 2008 at 8:46 pmNo wonder McNumbNuts and Failin’ Palin have been blabbering about Ayers, etc. They were launching a “pre-emptive distraction”.
Boy, when things started heading downhill for this Dynamic Duo, they sure picked up speed quickly. What could possibly be next . . . a total “exploding head” melt-down by McNumbNuts in the next debate?
October 10th, 2008 at 8:47 pmArtZ -
I read this on CNN too…I’m a bit confused, how can abusing one’s governmental power NOT be breaking the law? It will be interesting to see howw this plays out/spun by Repubs…
October 10th, 2008 at 8:47 pmI think he can still sue her and the state for damages.
The standard for proof is much lower in civil court.

Absolutely
And remember ; he now has legal documentation to back up his claim(s).
Bible Spice has her wink and a smile ……………..
October 10th, 2008 at 8:50 pmThe investigation also found that Monegan’s refusal to fire Wooten “was likely a contributing factor to his termination as Commissioner of Public Safety.”
Meaning…what?
That Monegan is partially responsible?
How so?
October 10th, 2008 at 8:51 pmDunk her in the water for 15 minutes. If she drowns she’s guilty, if she’s innocent god will let her live. Praise jeebus.
October 10th, 2008 at 8:51 pmI mean, if Palin broke no laws, does this “The investigation also found that Monegan’s refusal to fire Wooten “was likely a contributing factor to his termination as Commissioner of Public Safety.” mean Monegan can’t sue for reinstatement?

October 10th, 2008 at 8:53 pmAs a matter of principle, the GOP does not believe anything like a “public trust” can exist. Therefore Palin could not have violated it.
It’s like the concept of “public interest”. Republicans laugh at it.
October 10th, 2008 at 8:53 pmShe’s been palin’ around with the debil.
October 10th, 2008 at 8:54 pmMonegan says he was dismissed as retribution for resisting pressure to fire a state trooper involved in a bitter divorce with the governor’s sister. Palin says Monegan was fired as part of a legitimate budget dispute.
The legislative panel met for six hours before making a unanimous decision to release the so-called “Troopergate” report. The vote was 12-0 to release the report, except for certain parts they consider confidential.
Alaska lawmakers began reviewing the lengthy and politically sensitive investigative report early Friday focusing on whether Palin abused her authority as governor.
October 10th, 2008 at 8:54 pm- - The report also says that Palin did nothing unlawful, she just violated the public trust. So, bupkes.
-Badmoodman
She broke the law unless the statute was just advice or a suggestion.
October 10th, 2008 at 8:55 pmIMO here’s the key portion:
Palin violated the state Ethics Act, Branchflower found.
“The evidence supports the conclusion that Governor Palin, at the least, engaged in ‘official action’ by her inaction if not her active participation or assistance to her husband in attempting to get Trooper Wooten fired [and there is evidence of her active participation],” he concluded.
“[Palin] knowingly … permitted [husband] Todd Palin to use the Governor’s office and the resources of the Governor’s office … in an effort to find some way to get Trooper Wooten fired.”
October 10th, 2008 at 8:55 pmrinse….lather….repeat…..
October 10th, 2008 at 8:55 pmC’mon everybody! This election isn’t about abuse of power or the economy going off a cliff. This election is about one thing only: Bill Ayers.

October 10th, 2008 at 8:57 pmDick Cheney and KKKarl ‘Turd Blossom’ Rove would be soooo proud of Governor Sarah Palin!
Her Impeachment Award as qualification for running for Vice President of the United States, will rank right up there with her “Alaska’s proximity to Russia” as part of her foreign policy experience.
Totally freakin unbelievable…
October 10th, 2008 at 8:58 pmShe is a one way power grabbing wacko fake christo nutjob. What else does anyone need to know. I’d trust any number of death row inmates over the likes of her.
October 10th, 2008 at 8:58 pmListen, the woman wears white after Labor Day, and that was enough for me to find her guilty.
So, Johnny Boy, what now? First you spend the late afternoon trying to quell the riots Princess Wasilla is inciting, and now this?

Yes, yes, but since she technically broke no laws limiting her conduct as governor, can he sue for reinstatement?
Will she receive some sort of official reprimand, or is this it?
October 10th, 2008 at 8:59 pmBut her Palin-McCain campaign gave her a clean bill of health. How can this be?
October 10th, 2008 at 9:00 pmChapter 39.52. ALASKA EXECUTIVE BRANCH ETHICS ACT
Article 01. DECLARATIONS
Sec. 39.52.010. Declaration of policy.
(a) It is declared that
(1) high moral and ethical standards among public officers in the executive branch are
essential to assure the trust, respect, and confidence of the people of this state;
(2) a code of ethics for the guidance of public officers will
(A) discourage those officers from acting upon personal or financial interests in the
performance of their public responsibilities;
(B) improve standards of public service; and
(C) promote and strengthen the faith and confidence of the people of this state in their
public officers;
(3) holding public office or employment is a public trust and that as one safeguard of that
trust, the people require public officers to adhere to a code of ethics;
(4) a fair and open government requires that executive branch public officers conduct the
public’s business in a manner that preserves the integrity of the governmental process and avoids
conflicts of interest;
(5) in order for the rules governing conduct to be respected both during and after leaving
public service, the code of ethics must be administered fairly without bias or favoritism;
(6) no code of conduct, however comprehensive, can anticipate all situations in which
violations may occur nor can it prescribe behaviors that are appropriate to every situation; in
addition, laws and regulations regarding ethical responsibilities cannot legislate morality,
eradicate corruption, or eliminate bad judgment; and
(7) compliance with a code of ethics is an individual responsibility; thus all who serve the
state have a solemn responsibility to avoid improper conduct and prevent improper behavior by
colleagues and subordinates.
(b) The legislature declares that it is the policy of the state, when a public employee is
appointed to serve on a state board or commission, that the holding of such offices does not
constitute the holding of incompatible offices unless expressly prohibited by the Alaska
Constitution, this chapter and any opinions or decisions rendered under it, or another statute.
Now, I’m not a lawyer, but I’d always heard that for a statute to have the full force of law, it’s supposed to be specifically worded “shall,” not “will.”
Does this mean the statute is weakly written, to allow such abuses of power?
Or are they just stupid?

John McCain: If your campaign does not stop equating Sen. Barack Obama with terrorism, questioning his patriotism and portraying Mr. Obama as “not one of us,” I accuse you of deliberately feeding the most unhinged elements of our society the red meat of hate, and therefore of potentially instigating violence.
At a Sarah Palin rally, someone called out, “Kill him!” At one of your rallies, someone called out, “Terrorist!” Neither was answered or denounced by you or your running mate, as the crowd laughed and cheered. At your campaign event Wednesday in Bethlehem, Pa., the crowd was seething with hatred for the Democratic nominee - an attitude encouraged in speeches there by you, your running mate, your wife and the local Republican chairman.
Shame!

October 10th, 2008 at 9:08 pmViolating a state statute is a big deal, maybe not criminal, but certainly civil action is possible. That is ususally determined and defined within the statute itself.

That shadowy, underground, commie-fag-enviro terror group has been committing VOTER FRAUD!
whether true or not, it validates the Puke voter fraud meme and sets the stage to contradict the election theft charges that will surely follow the McPalin ‘victory’ in Nov…
October 10th, 2008 at 9:17 pmWow - Palin made at least 19 phone calls by this summer to get rid of the guy - barely in office 1/2 year.
Not Gov-nor for a year and already a report finding that she violated the ethics act.
Quite busy !!!
October 10th, 2008 at 9:18 pmWhat the McCain camp will hang their hat on:
Finding Number Two:
I find that, although Walt Monegan’s refusal to fire Trooper Michael Wooten was not the sole reason he was fired by Governor Sarah Palin, it was likely a contributing factor to his termination as Commissioner of Public Safety. In spite of that, Governor Palin’s firing of Commissioner Monegan was a proper and lawful exercise of her constitutional and statutory authority to hire and fire executive branch department heads.
October 10th, 2008 at 9:20 pmWhether she broke an actual law or not, the findings of this report proves Palin is untrustworthy, immoral and a sleaze. We already know her cruelty towards animals, her constant ability to lie and her insanity = witchcraft, speaks in tongues and ready for the rapture.
All in all this is one fine gopper candidate…. deserves the big R.
October 10th, 2008 at 9:20 pmIf all the truth that’s coming about about Obama’s intimate connection with terrorists won’t get the McCain campaign any traction, then this revelation about Governor Palin won’t get the Democrats squat either.
October 10th, 2008 at 9:20 pmHaving just read parts of the report, the findings are that she was within her authority to dismiss Monegan.
But with the vagueness of the statute, he could probably still sue in civil court. Trooper Wooten, as well, I’d imagine.
October 10th, 2008 at 9:20 pmThese are bad times for McCain’s campaign, and this one will be the worst he has to face so far.
October 10th, 2008 at 9:20 pmI cannot see how McCain can survive this one, specially when his electability chances are getting lesser and lesser everyday.
There is nothing worse for a candidate, specially running for vice president job, than to be found abusing his power and public trust.
Sarah Palin now is the biggest headache for McCain, instead of helping him as he hoped, she is now his biggest burden.
With 4 weeks left, time is running out for McCain.
Sarah’s attacks on Obama demanding his truthfulness regarding something happened when Obama was 8 years old will make her now a big hypocrite, when she said that she has nothing to hide regarding the case of her abuse of power as a governor.
This is the big one for McCain’s presidency.
Personally, from all I’ve heard about the trooper’s conduct on the job, he should have been fired! If I were the Governor I would have done the same thing.
What people forget is that with unions and all the civil service protections availabel, it’s nearly impossible to get rid of rotten apples.
Just look at teachers.
October 10th, 2008 at 9:22 pmBy the way, TP, your story up top is woefully inadequate and skewed against Palin.

Admit it. The press as well as Democrats, progressives and assorted radicals DON’T CARE about the obvious character issues raised by Obama’s past, not to mention his current associations with America haters of all stripes.
It’s enough to make me retch.

What do you call this…?
You will not be silent about Obama,if he did the same thing.
October 10th, 2008 at 9:44 pmAnd now she was found abusing her power as a governor.
Actually, Tim, the burden of proof is upon you. You need to prove how she didnt try to use her position to get her sisters ex husband fired.

Not so fast, slick. I want to know why YOU say it’s so.
You obviously believe it, so see if you can assemble a coherent set of connected thoughts to express yourself in something other than monosyllables.
October 10th, 2008 at 9:46 pmIt seems to go like this ( I just read a bunch of the report)
2005
Wooten and Molly Palin get divorced.
Some time later Palin;s Dad makes a complaint against Wooten which is then investigated.
The Palin’s dad and Todd Palin make additional complaints which are also investigated, and this lengthens the investigation.
Palin’s dad calls to ask what’s happening, why is the investigation taking so long.
He is told it’s because of the added complaints but the investigation is being conducted and he can’t tell him anything more because of a specific legal statue that he cites that prevents public discussion of personnel issues.
Todd Palin calls with the same question and gets the same answer ( and the specific statute #).
Sarah Palin calls with the same question and gets the same answer. ( and the specific statute #).
Investigation complete, Wooten gets some discoplinary action ( not sure for what)–something like a brief suspension or something. He stays on the force.Case closed.
Todd and Sarah aren’t happy about this. They hire a private detective.
Sarah becomes governor, Todd first Dude.
Then Todd askes Moeghan to look over his PI file, compare it to the Trooper investigation to make sure “nothing had been missed”
MOneghan does so and two day later tells Todd that there was nothing new and the case was closed.
Then Sarah calls Moneghan, just to discuss Wooten. Moneghan says you know we can’t discuss this.
Then just about every memeber of Sarah Palin;s staff ( about 6 of them) press him on Wooten and he tells them all as they should damn well know, that any such conversations would be ‘discoverable’ and that there were no firing offenses and the case was closed…
UNLESS said Moneghan you want to charge Wooten with killing the moose without a licence, but then that would bring Palin;s dad into it as he’d help butcher the moose and transport etc and Wooten and a ew other people involved too.
Nope, they just wanted Wooten.
Other charges against Wooten like dropping his kids of at school in a cruiser turned out to be with permission of his supervisor.
The Palins made accusations which were proven crap and the oone issue they could stick Wooten on involeved the Palins themselves too.
Still Todd and Sarah had their staff continue to hassle Moneghan (and his own staff) about Wooten.
It was a personal vendetta and they used the Governor’s Office and it’s implied and real powers to conduct it.
October 10th, 2008 at 9:47 pmI was always taught that vacuums sucked.
October 10th, 2008 at 9:48 pmtarazan ,

Perhaps you are not aware that most “bad” mortgages are occurring in suburban and ex-urban areas — not the inner city. Predatory lending is an “equal opportunity scam”, sweetpea. And much of it is not even the result of home purchase; it is also the result of re-financing by consumers of all shapes, sizes and colors who have been propping this economy up by living beyond the means of their current incomes for years.

Tim,
October 10th, 2008 at 10:30 pmI take a bit of offense at that.
My spouse has been a teacher. She still does volunteer work at learning to read.
After she first retired, a teacher at a nearby school developed acute kidney disease. Said spouse was asked to sub and agreed. It turned out to be a job that lasted until the end of the school term. On the last day, as she was packing up her stuff, she heard little second grade voices singing “We love you Mrs. TheMan.” and the entire class walked in with their mothers in tow. She received some nice mementoes that she keeps to this day. Also a video tape that throws her into tears whenever she watches it.
From what I heard on MSNBC tonight, Monehan CAN sue her…she can even be up for impeachment. She lied and violated the public trust of the people of Alaska….not good.Considering she’s been going after Obama regarding whether or not he could be trusted, just kind of blew up in her face! What good is she now? Interesting turn of events. They need to own this whole thing. Lock, stock, and barrel. Will be the talk of the rest of the election.Maybe she can plan on packing up and dealing with the muck she’s created in Alaska…seems everywhere she goes,S@#t follows…they haven’t even touched the story of her owing back taxes of $25,000…that’s what “NO VETTING” will get you:)Not a good day for the McCain/Palin campaign. They deserve what they get!

So, I speculate.

Actions speak louder than words. They can spin and justify just about any of their actions, but many people see them for what they are…. Typical lying repubs that can’t run on the issues so they have to smear Obama with Willie Horton type crud.

OKay. Palin knocked out the incumbent Repub. and got the Governorship.
She hired her cronies, spent most of her time at home and all the remaining Rs had to kowtow to her while doing most of her job. AND they had to tolerate Todd Palin in official meetings.
Then Palin gets to run for VP and becomes a media sensation and talks a lot of brainless crap, you betcha.
So all the established Republicans hate her effing guts for being a successful idiot carpetbagging interloper, ergo their hatred is partisan.
Can I have an Aston Martin instead? Thanks! ;)

October 10th, 2008 at 11:47 pmStapleton failed to respond to the findings. Nobody was charging that Palin lacked to authority to fire a Cabinet member, even for no reason at all. The charge was that she abused her power as Governor by pressuring subordinates to fire Trooper Wooten. The report found her guilty of that charge and said she also violated State ethics laws with her action. The report received a unanimous vote.
The next move should be up to the ethics committee on what action, if any, to take in regard to these serious charges. My guess, though, is that nothing can/will happen before November 4th.

October 11th, 2008 at 1:00 amMcCain spokeswoman Meg Stapleton released this statement:
Today’s report shows that the Governor acted within her proper and lawful authority in the reassignment of Walt Monegan. The report also illustrates what we’ve known all along: this was a partisan led inquiry run by Obama supporters and the Palins were completely justified in their concern regarding Trooper Wooten given his violent and rogue behavior.
My word, I certainlyhope they can prove that in court, because it certainly looks like the McCain campaign just libeled a private citizen. And if they did, hoo, boy. Wooten isn’t a public figure by any stretch of the imagination, so the laws concerning libel, and defamation of character are much more protective of his rights as a private citizen.
I see a big settlement coming for Wooten - and it will come right out of what’s left of the McCain campaign coffers.
October 11th, 2008 at 1:04 amThe Alaska report found the Gov. Palin “Abused her power and violated the public trust.” And Palin wants America to believe Obama can’t be trusted?
October 11th, 2008 at 6:18 amThe McCain campaign blamed the whole mess of Wall Street on Obama, although it is well known that the financial gambling barons on Wall Street were encouraged by lack of regulations which McCain and his buddy ex- Senator Graham granted them in legistlations they sponsered and passed in the Senate.
Now McCain camp is blaming this damaging report about governor Palin on Obama again.
October 11th, 2008 at 8:32 amAlthough the majority of the commission are Republicans, and the investigation started even before Sarah was selected as Vice President, there was no hesitancy on the part of McCain’s camp to blame Obama for this report.
