Troopergate investigation finds Palin ‘abused her power.’

The investigator authorized by the Alaska Legislative Council to examine the “Troopergate” scandal released his report today, and found that Gov. Sarah Palin (R-AK) “abused her power” by pushing State Police Commissioner Walt Monegan to fire her former brother-in-law Mike Wooten:

For the reasons explained in section IV of this report, I find that Governor Sarah Palin abused her power by violating Alaska Statute 2952.110(a) of the Alaska Executive Branch Ethics Act. Alaska Statute 2952.110(a) provides

“The legislature reaffirms that each public officer holds office as a public trust, and any effort to benefit a personal or financial interest through official action is a violation of that trust.”

The investigation also found that Monegan’s refusal to fire Wooten “was likely a contributing factor to his termination as Commissioner of Public Safety.”

UpdateMcCain spokeswoman Meg Stapleton released this statement:

Today's report shows that the Governor acted within her proper and lawful authority in the reassignment of Walt Monegan. The report also illustrates what we've known all along: this was a partisan led inquiry run by Obama supporters and the Palins were completely justified in their concern regarding Trooper Wooten given his violent and rogue behavior. Lacking evidence to support the original Monegan allegation, the Legislative Council seriously overreached, making a tortured argument to find fault without basis in law or fact. The Governor is looking forward to cooperating with the Personnel Board and continuing her conversation with the American people regarding the important issues facing the country.

    The legislative panel met for six hours before making a unanimous decision to release the so-called "Troopergate" report. The vote was 12-0 to release the report, except for certain parts they consider confidential.

    Alaska lawmakers began reviewing the lengthy and politically sensitive investigative report early Friday focusing on whether Palin abused her authority as governor.

    Now, I'm not a lawyer, but I'd always heard that for a statute to have the full force of law, it's supposed to be specifically worded "shall," not "will."

    Does this mean the statute is weakly written, to allow such abuses of power?

    I find that, although Walt Monegan’s refusal to fire Trooper Michael Wooten was not the sole reason he was fired by Governor Sarah Palin, it was likely a contributing factor to his termination as Commissioner of Public Safety. In spite of that, Governor Palin’s firing of Commissioner Monegan was a proper and lawful exercise of her constitutional and statutory authority to hire and fire executive branch department heads.

    But with the vagueness of the statute, he could probably still sue in civil court. Trooper Wooten, as well, I'd imagine.

    It seems to go like this ( I just read a bunch of the report)

    2005
    Wooten and Molly Palin get divorced.
    Some time later Palin;s Dad makes a complaint against Wooten which is then investigated.
    The Palin's dad and Todd Palin make additional complaints which are also investigated, and this lengthens the investigation.

    Palin's dad calls to ask what's happening, why is the investigation taking so long.
    He is told it's because of the added complaints but the investigation is being conducted and he can't tell him anything more because of a specific legal statue that he cites that prevents public discussion of personnel issues.

    Todd Palin calls with the same question and gets the same answer ( and the specific statute #).
    Sarah Palin calls with the same question and gets the same answer. ( and the specific statute #).

    Investigation complete, Wooten gets some discoplinary action ( not sure for what)--something like a brief suspension or something. He stays on the force.Case closed.

    Todd and Sarah aren't happy about this. They hire a private detective.
    Sarah becomes governor, Todd first Dude.
    Then Todd askes Moeghan to look over his PI file, compare it to the Trooper investigation to make sure "nothing had been missed"
    MOneghan does so and two day later tells Todd that there was nothing new and the case was closed.

    UNLESS said Moneghan you want to charge Wooten with killing the moose without a licence, but then that would bring Palin;s dad into it as he'd help butcher the moose and transport etc and Wooten and a ew other people involved too.
    Nope, they just wanted Wooten.
    Other charges against Wooten like dropping his kids of at school in a cruiser turned out to be with permission of his supervisor.
    The Palins made accusations which were proven crap and the oone issue they could stick Wooten on involeved the Palins themselves too.
    Still Todd and Sarah had their staff continue to hassle Moneghan (and his own staff) about Wooten.

    It was a personal vendetta and they used the Governor's Office and it's implied and real powers to conduct it.

    My spouse has been a teacher. She still does volunteer work at learning to read.

    Stapleton failed to respond to the findings. Nobody was charging that Palin lacked to authority to fire a Cabinet member, even for no reason at all. The charge was that she abused her power as Governor by pressuring subordinates to fire Trooper Wooten. The report found her guilty of that charge and said she also violated State ethics laws with her action. The report received a unanimous vote.

    The next move should be up to the ethics committee on what action, if any, to take in regard to these serious charges. My guess, though, is that nothing can/will happen before November 4th.

    First of all, Governor Palin isn't guilty of the things she's accused of here because she has never lied about it or put forth a standard of conduct she doesn't follow herself.

    Now, what the report ACTUALLY says is being mis-construed by most of you here, that's a given. Reasonable people and lawyers will disagree. The legislative panel rendered their OPINION, which isn't the same thing as a court verdict by a long stretch. With respect to the ethics statute, it is questionable that her actions meet the standard required for a violation.

    She was absolutely within her rights to terminate that guy. Period, end of story.

    Now, I will admit that she let her personal bias affect her decision. So what? That's not an ethical violation per se, it happens all the time in government and private business.

There were a number of factors, but a big one was the Community Reinvestmant Act passed during the Carter Administration and put on steroids by President Clinton. It is simply a matter of record and historical fact that most commercial lending institutions sucuumbed to the bludgeon applied by the Federal Government to change long-held, financially sound rules for lending.

    When I mention the role of Fannie Mae and Freddie Mac, I'm not talking about the direct loans they made, but the fact they bought tremendous amounts of questionable loans from these commercial banks, re-packaged them into investments and sold them on Wall Street. Commercial banks were all too happy to make the loans because they had a ready market for them in Fannie Mae and Freddie Mac.     Tell me, what is you opinion of Alan Greenspan? Have you read the transcript of his testimony to the Senate bsnking committee (Democrat majority) in 2005 concerning the risk posed by Fannie Mae and Freddy Mac?

    The point of all this of course, is that I'm trying to get you folks to see it wasn't the President's fault! C'mon! How many time did this and prior administrations try to warn Congress of impending disaster? AT LEAST THREE - 1999, 2002, and 2005.

    Since you brought it up most BLUE states pay MORE in taxes than they get back in revenue and most RED states take in more in revenue than they pay in TAXES. That means most Red States are themselves on wellfare. Since most blue states have BIG populations that statistic is a lot more meaningful than the idiocy you tried to float.

    As I recall, the Legislative investigation did not say she stepped out of bounds by firing Moneghan. What they said was it was an ethical and statutory violation to have pressured him to fire Wooten. That is, they cited her for committing an entirely different act (pressuring to fire Wooten =/= firing Moneghan). So I don't see any actual contradiction here.
