The right of free speech of a broadcaster, the user of a sound truck, or any other individual does not embrace a right to snuff out the free speech of others. 

There is nothing in the First Amendment which prevents the Government from requiring a licensee to share his frequency with others and to conduct himself as a proxy or fiduciary with obligations to present those views and voices which are representative of his community and which would otherwise, by necessity, be barred from the airwaves.

There is NO “public” obligation that the FCC forces on private broadcasters. They pay their taxes to use the airwaves and that should be the limit of their “obligation” to the public.

		<description>How about this - When was the last time thinkprogress noted racism from someone other than a white person? Is that racist?
My point is that it sure seems as if comments that shouldn&#039;t be construed as racist are only construed that way because of who they are. While there certainly is room for listening to someone with their background in mind, it&#039;s prejudiced (by the very definition) to listen seemingly expecting racist remarks instead of with an open mind.  If we are to take on true and factual reporting, we shouldn&#039;t use prejudice as a basis of an article.  If someone besides Chambliss had said what he said, I think we can agree it wouldn&#039;t even take on the guise of offensive.</description>

		<description>Max - I don&#039;t follow. There was an historically high turnout of minority voters who normally vote democratic.  He cites this historic turnout as an advantage to the democrats.  He then says he wishes &quot;our folks&quot; had gotten out more on election day.  It takes a whole lot of stretching to turn that into a racist remark and not just leave it at the political remark it was.  He was saying he wished republicans turned out in larger numbers. It&#039;s obvious.

Well he said &quot;let’s give the Obama people credit.&quot; No he didn&#039;t say democrats, but it&#039;s implied.  I&#039;m sure you wouldn&#039;t have felt the same way if Obama had said, &quot;let&#039;s give the McCain people credit.&quot; You seriously would think he meant &quot;white people&quot; and not the republican party/republicans?

Look, you simply cannot call people racist on a whim. I&#039;m dumbstruck by having to argue this.</description>
