The Supreme Court agreed today to hear the case of Ali Saleh Kahlah al-Marri, a Qatari national who is the last person on the American mainland known to be held as an enemy combatant. By taking the case, the court will “decide whether the president may order that people picked up in the United States be detained indefinitely and without criminal charges.” The case will be “an early and high-stakes test for the Obama Administration” as “the case will not be argued before March, meaning that President-elect Barack Obama will be in the White House and decisions about al-Marri will be made by him.” Read more on the al-Marri case here.
It looks like the only way Bush can avoid having his whole damn war policy declared unconstitutional is if Obama releases al-Marri, as the Fourth Circuit ordered. Then there would be no precedent established by a SCOTUS decision, and future presidents like Bush could continue to violate the law and the Constitution. Of course, I hope that we, as a nation, would be smarter than to elect another president like Bush. Must provide more education funding to the red states.

December 5th, 2008 at 3:49 pmOne thing worth noting is that if al-Marri gets acquitted, that’ll make it harder for Obama to follow through on his campaign promise to close Gitmo.
Either way though, this is going to be the key precedent case for how the rest are handled.
I’m looking forward to getting this settled honorably. It’s just a shame that they can’t just switch places with Bush, Cheney and their cronies, to ensure that the properly guilty parties are put on trial.
