A New Attorney Scandal? Bush-Appointed U.S. Attorney Won’t Vacate Office Under Obama

mary.gifMary Beth Buchanan was appointed by President Bush to serve as U.S. attorney in Pittsburgh in Sept. 2001. Buchanan has held several significant posts within the Bush/Ashcroft/Gonzales Justice Department, most notably serving as director the Executive Office for U.S. Attorneys.

Just last month, the Pittsburgh Post-Gazette reported that Buchanan’s reign was expected to end. Indeed, when a new president is elected, U.S. attorneys of both parties generally submit their resignations to make way for the new appointees. But Buchanan has other plans:

Despite a new administration coming into power, U.S. Attorney Mary Beth Buchanan said she plans to stick around.

“It doesn’t serve justice for all the U.S. attorneys to submit their resignations all at one time,” she said yesterday. […]

More than that, she said she would consider working in the Obama administration. She would not discuss what her future might hold beyond the U.S. attorney’s office.

“I am open to considering further service to the United States,” Ms. Buchanan said.

She’s been described by colleagues as the quintessential loyal Bushie. “She is very focused to the department first of all,” said one assistant U.S. attorney, who asked not to be named. “She’s not independent, and I don’t think she wants to be.”

During her tenure, Buchanan has been criticized for bringing politically-motivated investigations and charges against politicians in Western Pennsylvania, none more famous than the public corruption case against a local high-profile Democrat Dr. Cyril H. Wecht. Former Attorney General Dick Thornburgh told Congress that the Wecht prosecution is “not the type of case normally constituting a federal ‘corruption’ case brought against a local official.”

Buchanan hired Monica Goodling, and she hand-picked a Pittsburgh attorney to serve as the U.S. prosecutor in Alaska, going over the heads of Sens. Ted Stevens and Lisa Murkowski. She also had a peripheral role in the U.S. attorney scandal:

She did talk with [Gonzales chief of staff Kyle] Sampson about some of the prosecutors who were ultimately fired, including Carol Lam, U.S. attorney in the Southern District of California…

But the most involvement Ms. Buchanan seemed to have in the firings, according to the report, was in meeting with former U.S. Attorney Kevin V. Ryan of the Northern District of California.

Buchanan “has been criticized because her office has brought a number of high-profile cases against Democrats during her tenure, but rarely targeted members of her own party.” And now Buchanan wants to volunteer her services to President-elect Obama.

    (Optimistic) – Mary Beth Buchanan sounds willing to “cooperate” with the new adminstration to ferret out some of wrongs from the previous Admin.

    (Cynical) – Some sort of trap is being laid to get the new administration on trouble for “firing” all US Attorneys at once when he comes into office — same thing they said about Clinton.

    This is an interesting chess move. It leaves Obama the options of A) firing her, or B) keeping her in her position.

    If the Bushco administration had never happened, and the Justice Department hadn’t become so politicized, I’d say that firing her would be a no-brainer. Terminating all the U.S. Attorneys and replacing them whenever a new president from a different party takes office is pretty traditional — Reagan did it, Clinton did it, and Dubya did it. Obama could do the same thing without causing any eyebrows to be raised.

    But Dubya kind of poisoned that well when he (or his DoJ) canned so many of his own appointees midway through his tenure so Rove marionettes like Tim Griffin could be appointed while exploiting the Patriot Act so they could serve indefinitely without Senate confirmation. As a result, any firing of a U.S. Attorney by any president will be suspect. Only if that USA was found eating live babies on YouTube would such a firing escape controversy.

    But what if Obama keeps her where she is? She will probably be watched closely, and her actions recorded. If she operates in a fair, professional, and non-biased manner — no harm, no foul (but there will be amazement, considering her track record so far). However, if Buchanan continues to target Democrats and turn a blind eye to misbehaving Republicans, there will be a good case for her termination. And if it comes to that, I hope the media will report it, and report the reason why. It will be a good way for Obama to tell the world — “we aren’t going to put up with this anymore.”

Despite having no criminal record, Buchanan went after Chong with zeal, because, she said, he had glamorized the use of marijuana in his movies. Chong received the harshest sentence of any of those arrested.”

    Yes that said 12 million dollars and 2,000 law enforcement officers.

    I’m not too worried, though. Obama already has plans for how to get around the crude, obvious traps they are setting for him. They REALLY still don’t know who they’re dealing with. It’s going to be so much fun watching their slow realization.

    Who cares? That’s what happens when a new President takes over. U.S. Attorneys serve at the pleasure of the President, and Buchanan’s pleasuring only served the needs of President Bush and his cronies.

    It won’t get Obama in trouble at all. Sure, the usual conservative talking heads will make a fuss about it, but they’re going to do that no matter what Obama does. He is entitled and expected to clean house at the beginning of his Administration.

    Any comparison to the scandal around the Bush team’s politically-motivated firing of David Iglesias and the other Republican U.S. attorneys is completely irrelevant.

    You know that and I know that, but America didn’t suddenly get smarter in 2008; they were just sick of the last guys. There is still political positioning to be done here, and posible political fallout if they can convince people (who ARE sick of the DOJ being politicized) that this is what is happening.

    However, as I said, I think Obama’s more than ready for them. I anticipate a deft response, not a bludgeoning one.

    Unfair dismissal? Based on what? Even the brain-dead MSM won’t be able to avoid noting that the mass-resignation offers when a change of administration occurs is SOP. Politically based hiring is inherently subject to politically based firing–that’s the contract, tied to the Presidential term!

    Iglesias et al were fired for ‘partisan political incompetence’, not professional incompetence. Buchanan here won’t be ‘fired’ for either–it’s simply that her tenure contract may not be renewed.

    Obama might consider offering Iglesias and the others their old jobs back as it seems they really were professional public servants rather than partisan political servants. Making the offer at least would certainly counter any ridiculous whining from the Republicans.

The public knows how badly the Bush Admin corrupted the Justice Department and will understand fully how Obama will want to start with a fresh non-partisan slate.

    This is the reason why Obama needs to ask all US Attorney’s for their resignation. If he allows one to stay, it’s going to be a total war by the Republicans. On the other hand, I assume there are a few US Attorney’s appointed by Bush who are doing a good job and are not partisan hacks. If that’s the case then Obama needs to immediately offer them their jobs back. That will be a good way to counter the “partisan politics” argument the right will be screaming about, even though it will be totally hypocritical for them to do so.

The attorney firings are still actively under investigation and while it’s perfectly ok to replace them during a transition, they’ll use this to stir up clouds of fake outrage. Unless she really does turn over real, prosecutable information I say CAN HER ASS and continue those investigations. Ram it down their throats. Honestly I wonder if these bastards won’t attack Iran and burn down the WH on the 19th.

    Ashcroft appointed her back in 03′ and her first priority was entrapping glass bong salesmen over the internet and through mail orders. 12 million in federal dollars was spent to bring down Tommy Chong’s son’s mail order business and others. This was Ashcroft’s culture war and they used the Patriot Act and other civil rights abuses to tie them in with terrorism. She’s front and center in the documentary “AKA Tommy Chong”. It was plain and simple entrapment. They didn’t even notify these businesses that they would start enforcing the laws that had been on the books for decades. They just raided the 54 companies and ruined the lives of each of them including Tommy Chong who took the wrap, serving 9 months in federal prison in a plea bargain to protect his wife and son who were the actual owners. Great, just what we need more police fighting the culture war of the 60’s and 70’s when out main concern should be within our own Justice Dept (Gonzo). IN HER STATEMENTS TO THE JUDGE DURING SENTENCING SHE USED “UP IN SMOKE” AS AN EXAMPLE OF HIS MOCKING AUTHORITY TO ACHIEVE A JAIL SENTENCE WHEN ALL OTHER INDICTMENTS ENDED WITH PROBATION. Her work for Bush after Ashcroft speaks for itself.
    Nice work. We’re all safer now.

    Nah, keep her around. If any evidence of unethical behavior on her part during the Bush administration surfaces, she’s on the hook. Not like others, who have left the government, and so, aren’t prosecutable.

    Make her a “Dirty Mary,” by giving her only child-molestation, sexual-slavery, and internet porn cases.

    Make her work for that salary.

    And have an Obama-appointed assistant, to keep tabs on her.

    Who knows? She might just surprise everyone, and do some good for the country, instead of her political party.

I applaud her style, tact, and grace as well as respect her opinion.     Actually Nobama, if you did some research, you’d find Clinton fired every US Attorney at the beginning of his administration.

    George W. Bush ALSO fired every US Attorney at the beginning on his administration.

    Clinton also fired the White House Travel office….who ALSO serves at the Pleasure of the President…..and we watched Republicans scream bloody murder about it too.

    George W. Bush ALSO fired HIS OWN US Attorneys (only like 9 of them) at his second term. (And Democrats screamed bloody murder — but the question of whether or not the DOJ (and other organizations) had become politicized (they’re not supposed to be) was conveniently ignored by the Media.

    I would imagine after the Obamas get their new dog, they could use her services to pick up the poop. She’s quite familiar with that aspect of the Shrubco administration.

    She won’t quit..huh? Well the Democrats should do what the GOP would do in this case…keep digging until they find a “scandal” then blow it all out of proportion (if they have too)..drag every member of the U.S.A.’s family into it….make sure every talking head, pundit and MSM brings the scandal up and (”embellishes” it) at least six time a day…..start a congressional (and very public) investigation….she’ll quit..trust me…!

    Hope shes having a nice 08 christmas! While her blog about her boasting about how she was responsible for investigating a small southwestern Pennsylvania business who in fact did “no wrong”. Now the small business has people laid off! Yes! Partly because of the economy, but mostly because of her and shes bragging about it. They did no wrong, but our system seems to think otherwise and they are trying to appeal. I say get rid of her and replace her, before she runs our state into the ground . Still getting rid of those dam communists.
