IL Attorney General launches legal effort to oust Blagojevich, says he is unfit to serve.
Today, Illinois Attorney General Lisa Madigan today filed an “unprecedented legal attack against a sitting Illinois governor,” taking initial steps to ask the state Supreme Court to declare Gov. Blagojevich unfit to serve:
Madigan filed paperwork with the state high court this morning, invoking what is known as Rule 382 that would ask justices to rule on “the ability of the governor to serve.” Madigan is seeking a temporary restraining order or preliminary injunction, urging the state high court to oust Gov. Blagojevich “due to disability.”
“Before this court reaches a final decision on the merits of this action or otherwise determines that such disability has been removed, Mr. Blagojevich should be temporarily and preliminarily enjoined from acting as governor because his continued occupation of that office could irreparably damage the state’s interests,” states the motion.
“We still think that it is imperative for the Legislature to make a decision and hopefully proceed with impeachment proceedings,” the attorney general said.

AG Lisa Madigan got her campaign fraud case covered up as he paid for the AG seat. It’s been a long plan of Lisa’s Father Speaker of Illinois House of Reps. to put in daughter in the top spot. Interesting how crooks work with other crooks Lisa was top choice for Senste seat by the current Govenor. The Madigan Family are old time Polictians and know how to play the game. Pay to play is old school to them and with the door open Lisa will cheat and steal her way to the top with the help of Daddy. Illinois will remove one corrupt Govenor for another if AG Lisa Madigan gets in office.
Let’s hope the people of Illinois use Obama’s play book of letting the people pick the Govenor this time and leave the corrupt campaigns out. There has to be one person in Illinois who hasn’t been taught the old school corrupt way of becoming a Leader. AG Lisa Madigan will play this like a piano and as corrupt as she is who knows people might get fooled once again.

It’s a lgeal maneuver, but to frame it as an “attack” is to imply that there is something wrong with what she is trying to do. She is simply trying to do what is in the best interests of the people of Illinois, whom she is there to serve. Remember that, conservatives in America: Government officials are elected to serve the people, not the chief executive.

This is a truly interesting quandary for the voters of Illinois.
Innocent until proven guilty.
That being said, the state is currently at a standstill.
ANYTHING that this governor would do would be under a cloud of suspicion, MOST of all the appointment of an Obama replacement. The Senate has already said that they wouldn’t seat any Blagojevich replacement. ANY other action other than resignation, would take about six months or more to happen.
Currently the state of Illinois is at a standstill legislatively.
You simply can’t let a state STOP ALL business because of this.
At least with Madigan’s proposal, Blagojevich would only have his powers suspended while his trial went on.

Wayne, there are some technicalities here.
I’m not a lawyer, but here’s what I understand.
Blago was arrested under a “criminal complaint”. This is not a FORMAL charge.
From what I heard in Fitzgerald’s press conference, they did it this way because they didn’t have all of the information that they wanted for formal charges, but they felt that there was a crime in progress (senate seat) that they wanted to stop in its tracks.
The prosecutor has 30 days (I’ve heard various things from 30 days to 90 days) to file formal charges.
Again, just repeating what I’ve heard.

In 2002, Madigan helped his daughter Lisa garner more campaign contributions in her run for Illinois Attorney General than even the candidates for governor that year.[11] At one point, Lisa Madigan’s $1.2 million raised was more than all the attorney general candidates in 1998 had raised, combined.[11]
